2009 Trial Still Possible For Plaxico?

Despite the fact that the case against receiver Plaxico Burress has languished for seven months, fueled by prosecutors who twice have agreed to three-month continuances of preliminary-style hearings, a new report suggests that Burress could be standing trial before the end of the year.
Per Oren Yaniv and Larry McShane of the New York Daily News, Manhattan District Attorney Robert Morgentheau said Wednesday that Burress could be indicted in July, and that the timetable could change.
Attorney Benjamin Brafman didn’t sound too pleased by the development.
“I don’t want to get into this,” Brafman told the Daily News.  “I don’t think there’s a story here.” 
Possible translation:  “There’s nothing I can say to spin this into my client’s favor so I’ll say nothing, especially since there’s a chance that my decision to run my mouth on Sirius NFL Radio might have served as a screeching alarm clock for a slumbering giant.”
Brafman might have erred badly, in our view, by commenting on Mayor Michael Bloomberg’s previous comments about the situation. 
“It doesn’t help to have the mayor speak publicly about pending criminal cases,” Brafman told Sirius NFL Radio.  “And it’s uncharacteristic of Mr. Bloomberg. . . .  I don’t think we’ve heard a word from him about the Bernie Madoff case in New York, which is about the biggest case in the country.”
It wasn’t exactly inflammatory stuff, but we’ve got a feeling that the man who recently bristled at a fairly innocent question from a reporter thereafter expressed his displeasure with the slow pace of the case directly to Morgenthau.
Still, regardless of whether Morgenthau decides to move this specific litigation to the top of his office’s docket, Brafman already has hinted at the lawyer’s ultimate fallback option.
I’m too busy.
During his appearance on Sirius NFL Radio, Brafman pointed out that, based on his own schedule, the earliest he could try the case is March 2010.
Which, coincidentally, comes a month after the NFL season ends.
Still, Brafman’s recent suggestion that an earlier trial date is “inconceivable” makes us wonder whether the word means what he thinks it means.

    WoW, enough is enough already. This plaxico gossip is a boring topic already, this site has become PFT, Plaxico Football Talk. He should have his own one liner section in the morning. People are posting the same comments since last Nov with him “if it was me or an avg joe, id be in jail” zzzzzz…So he is facing mandatory time in NY for accidentally shooting himself and what is stallworth facing in florida for killing someone? put a little focus on that, its going on a yr with these plax articles.

    Nobody cares about a guy that fleeced a bunch of rich people out of their money. That’s a lot less than what Obama’s doing.

    Plaxico should fire Brafman and hire Donte Stallworth’s lawyer.
    Stallworth got off with a sentence of 25 days in jail, 2 years home detention, 3-5 million “payoff”, lose driving privledge for life(or 5 years) and 10 years probation.
    Surely the black giraffe can get off with a sentence of a weekend in jail, an order to pay all of his outstanding debts, a million dollar donation to Bloombergs campaign fund, 10 hours of firearm training, and 2 years in Goodells doghouse.

    I don’t understand.
    Witness says gun was in his waistband. Hole resides in Burress’ leg. Doctor worked on Burress’ aforementioned hole. Law says no one may carry an unlicensed firearm in a public place.
    WTF is the hold up??? Put this turd in a place where people tend to burgle turds.
    BTW, any word on what is going to happen to the hospital employee (I think it was the doctor’s responsibility) who didn’t report the incident?

    At least we haven’t had to see any Patriot “news” lately. How refreshing it has been to have all the little Patriot trolls silent and hiding in the dark corners like roaches.

    One should not mess with Billionaire Mayor Michael Bloomberg.
    Brafman is over his head on this one. The powerful mayor of
    New York City has spoken……Brafman should know this and
    act accordingly. Now if Plaxico has turned down plea bargain
    deals then perhaps Brafman needs to get Plaxico Burress a
    professional session with someone who can evaluate him
    from the neck up.

    This story gets five stars just for making a great Princess Bride reference.
    Plax deserves to be in jail already. Like Florio said before, he didn’t just injure himself in his sheer stupidity, he endangered the life of everyone else around him when his gun discharged in a public location. He’s getting celebrity treatment with all these extensions plain and simple. The fact that he’s usually only a good receiver for the first half of the season (with the exception of a wide open touchdown catch in the super bowl) should really only qualify him for being half of a celebrity/sports star.

    Am I the only one that is tired of reading about Plaxico. Just seeing the headlines makes me ill. I would rather read about an actual football player that is still (and legally able) to play than some guy that thinks he is God’s gift to football. Peace Out!

    I hate to tell you this, but Plaxico Burress is in Foxborough today meeting with the Patriots. It’s amazing the change in practices there since they cut Christian Peter just after they drafted him.
