Though it has long been assumed that Giants linebacker Antonio Pierce won’t be facing criminal charges in connection with his efforts to assist former teammate Plaxico Burress after Burress blew a couple of holes through his leg, the New York Post strongly suggests that Pierce could still be in trouble.
Manhattan District Attorney Robert Morgenthau, who opted for chattiness when it came to the status of the inadvertent shooter, clammed up regarding whether Pierce faces any problems.
“I’m not going to go into that,” Morgenthau told the Post.
But the Post reports that prosecutors have considered “flipping” a security guard at the night club where the incident occurred, in the hopes of bolstering a prosecution against Pierce, who allegedly assumed possession of the gun after the shooting and transported it to Plaxico’s home in New Jersey.
“To charge Antonio and immunize other individuals engaged in the same
alleged conduct — I would hope any grand jury would reject that
outrageous proposition,” Pierce’s lawyer, Michael Bachner, said in response to the possibility.
Then again, the threat of charges against Pierce might simply be a tactic for ensuring that he doesn’t wobble when the time comes for him to testify about the things he witnessed on the night in question. While the prosecution likely doesn’t need Pierce’s words to make the case against Burress stick, Pierce’s account could go a long way to removing any doubt as to whether Plaxico’s lawyer, Benjamin Brafman, can finagle reasonable doubt at trial.

Who else took an illegal handgun across state lines in an attempt to cover up a crime? Pierce should be in more hot water than Burress is but since he’s still on the team I doubt that they’ll pursue it.

LQ doesn’t have any cameras, they are going to have to rely on a bouncer who was part of the party who escorted them into the club. It isn’t much of a reliable source, if it was a regular patron at the club, a bouncers testimony would go a long way, but not in a high profile case like this. Not to mention, when are the Burress proceedings going to begin? or are they going to let him find a new team first and in the meantime target pierce and listen to what a bouncer has to say.
