On the same day that Steelers quarterback Ben Roethlisberger launched an all-out blitz in the court of public opinion, one of the other defendants in the case filed by a Harrah’s employee who claims she was sexually assaulted by Roethlisberger filed a motion to dismiss the claims in a court of law.
Stacy Dingman, the former director of hotels at Harrah’s and supposedly the former best friend of the plaintiff, argues that there is no evidence to support any of the claims made.
The plaintiff claims that Dingman participated in the conspiracy to cover up the alleged assault.
“Despite her apparent dissatisfaction with her co-workers’ purported failure to act in response to her claims, [the plaintiff] tellingly failed to report the allegedly incident to police, failed to file any criminal charges against Roethlisberger, failed to file for worker’s compensation benefits and even failed to inform her own family of the purported incident,” the paperwork states.
“Now, in addition to pursuing her purported assailant a year after the claimed sexual assault occurred, [the plaintiff] has unjustifiably dragged Dingman, her former best friend, into this baseless lawsuit.”
But a belief that there’s no evidence isn’t sufficient to secure a dismissal at the outset of a civil suit. Dingman will be required to prove that the complaint fails to state a claim against her on which relief could be granted.
Such motions typically are successful only when the defendant can show that, even if the allegations in the complaint are true, the law provides no basis for any type of recovery.
As a result, claiming that there’s no evidence won’t be enough to secure a dismissal, if the allegations if true establish a cause of action under Nevada law. For now, the plaintiff isn’t required to produce evidence — she’s required only to make allegations that, if proven, establish a violation of her rights.
I’m no attorney but don’t defendants usually begin their defense by filing a motion to dismiss?
