New judge in Roethlisberger case

In a move that apparently isn’t uncommon in Nevada, the lawsuit against Steelers quarterback Ben Roethlisberger and others has been assigned to a new judge.

Per the Pittsburgh Post-Gazette, lawyers in Nevada are entitled to one judicial pre-emption without explanation.  The request for the new judge in this specific instance came from the lawyer for the plaintiff.

Presumably, the other lawyers representing the other parties have the same privilege.  In a case with multiple defendants, the process eventually could become ridiculous, like the process for picking a new first name for Joel Rifkin.

As a result of the move, the case has been shifted from Judge Jerome Pohala to Judge Brent Adams.  Pohala is a Pennsylvania native, and he played college football at the University of Nevada.

Though these superficialities might have triggered the move, lawyer Calvin Dunlap presumably based the decision on his experiences with and/or the past rulings of Judge Pohala. 

Some judges have a reputation for interpreting the law in a manner that tends to benefit the plaintiff in civil cases.  Other judges have a reputation for applying the law in a way that helps the defendant in such matters.  Most judges attempt to be fair, but their sense of fairness inevitably is based on their own views as to what fairness generally mandates.

And, inevitably, those views are shaped by political affiliations and ideologies.

    Asking for another judge doesn’t look like Dunlap is planning on dropping the case despite Ben’s awesome e-mails, all from biased parties, and dire threats of sanctions.
    I wonder what Dunlap has up his sleeve. He is being very quiet about this. Do you think in this whole big country he could find a gal or two that might testify Ben was a little rough with them? They say his partying and bad treatment of women is legend around Shittsburgh.
    Stay tuned. Looks like both sides are digging in for a real mud slinging war.

    I think the Pennsylvania and football connections could be a bigger factor in the plaintiff’s decision than you indicated – the next decision point in this case is the motions to dismiss, not the full jury trial. Any perceived edge the judge may give to the defendants would be scrutinized closely, as the attorneys will only have the opportunity to present their case to the judge when considering dismissal. Even if, as one poster mentioned, the plaintiff has found other women who will complain about the defendant’s rough tactics, it appears the plaintiff has a high hurdle to overcome due to her own emails prior to the alleged assault. The plaintiff’s attorney may be very concerned about the judge’s perception of the case and of the defendant, and those perceptions could be colored by the judge’s upbringing and background.

    I haven’t really followed this story, at all.
    But reading the linked source and Florio’s commentary left me with a couple of thoughts.
    I was pretty young when OJ was found not guilty by criminal jury. But then swiftly hit in the pocket in a civil suit. At the time, I was glad to see him at least be punished in some way.
    Seeing Ben hit directly with a civil suit blows my mind. If ignore how I personally feel about OJ, I can’t find any justice came from civil court. In fact, it seems like an unjust mockery of anything “fair”.
    OJ walked because the court system worked. The prosecution made numerous mistakes and they’re the ones burdened with connecting the dots. If ONE civil judge can take your assets after you’ve just been found not guilty then our freedom is a farce. “murder” not guilty to “wrongful death” bankrupt is not a technicality, it’s tyranny.
    The Post Gazette mentions it’s policy of not posting names of alleged sexual assault victims. I didn’t realize civil courts deal with victims now. Do they have a suspect?
    This should be about the presumed innocence that Ben Rothlesberger is not a violent sex offender and a burden on the state to prove to a jury otherwise. What if he is guilty? He just pays and walks free with the opportunity to assault someone else? If we’re going to use the civil court to fight criminal cases, at what point can we expect those who can’t pay their civil settlements, to be entered into the criminal justice system?

    i would say that the motion for a new judge was filed before any of the motions to dismiss were filed civil cases are long drawed out process and i would say he filed for a new judge as soon as one was appointed ,,,saying that i would hope that even this new judge isnt an idiot , i have read all the motions and even the letter that Bens attorneys sent to the ambulance chaser and this is my take on it,,,, This women evidentually looked this man up in the yellow pages under ambulance chaser, he heard Harrahs and Ben Roethlisberger and the only thing he seen was $$$$ , he first tried to shake down Harrah’s and they refused to pay the nutjob any maney so then he said well lets try benny boy, and its obvious Ben isnt gonna pay so where does that leave ambulance chaser and nutjob, and as far as it has been posted that mybe he has other women to come forward if you read Ben’s motion to dismiss he asked if it isnt dismissed then he would like the oppurtunity to gather evidence swiftly , which that sounds like what his attys are doing, in the mothion for santions, they make a reference to the fact that her ambulance chaser didnt properly invesitgate and didint interview witnessess, they said he had 3 months to find out what they found in 2 weeks, so that being said Ben’s attorneys would have the oppurtunity to deposition any witnesses that they have and look in to thier backgrounds and im sure if they’re were other women out there i would have to think that they would havecome forward before now , and we would be hearing about them on here, and if there is it was probably the same story as not job they got thier 20 minutes of pleasure and when Ben didnt call back , they were pissed,,,,end of story, im sorry this womans description of what happened has so many holes that you could drive a truck through them and i would have to think that Bens attys verified that these emails were true , that is a crime in its self tampering with evidence, and as far as the comments aboutBen’s bad treatment of women in Pittsburgh, that is just hear say my friend and i have also read on other sites, that he is a gentleman, which is also hearsay, so that doesn’t mean squat the women crying bad treatment are probably just pissed same as nutjob that they are Mrs. Roethlisberger or carrying Baby Roethlisberger , so with that being said Ben in the future carry consent forms and condems they will keep you out of trouble.
