PFTV looks at the status of the Roethlisberger case

Now that the lawyers representing Steelers quarterback Ben Roethlisberger have made a dramatic opening assault against the woman accusing Roethlisberger of sexual assault and her lawyer, the time might be right for Roethlisberger to settle the case on the cheap.

It’s a topic we take up in one of this week’s PFTV segments.

Watch it.  Comment on it.  And then watch it again.  It’s Sunday afternoon — what the hell else are you doing?

    like you do.
joe has one boss raccoon up there.

No way he should settle…he’s not guilty, any settlement only give others the idea that false accusations will ultimately result in a payout.

    I looked at it too… it’s dead.

  5. Florios_a_tool says: Aug 30, 2009 2:16 PM

    NO $ settlement with crazy people. Instead;
    1) get her fired.
    2) make her seek counseling.
    3) get a restraining order.
    4) order her to wear a Patriots jersey for 2 years.
That ought to send a strong message to all the other loonies.

I see the Davy Crockett look is still popular in Florio’s neck of the woods……..

Florio, what ever you’re doing to your hair-make it go away!!!!!
its a bigger flop and Andre Smith’s manboobs

She shouldnt get a dime if he didnt do it!
I’m sure Ben has some sort of “Liability Insurance” to deal with this sort of crap. This is a case where the Athlete needs to take a stand or he (they) will become a target of other BS lawsuits.
BTW Florio….did Moe do your hair?

  9. footballrulz says: Aug 30, 2009 2:44 PM

Ben’s lawyers should have her lawyer’s pay for all expenses as a penalty for taking on such a frivolous lawsuit. Good point! That would be the best way to avoid this type of BS.. IF the LAWYERS who accept the cases which are deemed frivilous become liable for costs then that would lead to a lot less frivilous lawsuits. There should however, be some sort of ramification on her–such as having to make a public apology, community service, etc.
Not s Steeler fan but Ben should NOT settle in any way. Just opens the door for more.

WHAT? I disagree completely. Andrea has nothing to go on, but her own imagination and her equally money greedy, attention-seeking attorney. There are no witnesses, no proof, NOTHING, not even a plausibly story. On the other hand, Ben has everything to go on, Andrea lying to immigration officials to get her green card, Andrea cheating on her own husband, Andrea’s mound of emails talking about how hot Ben is, her plan to ‘fix his tv,’ how nice he is, how she would date him, contrary proof of her own mood and behavior as she kept a running commentary through email to a multitude of people. The cards are all stacked against her and she doesn’t deserve to be paid off to go away, nor does she deserve to be let off the hook and neither does her attorney. Ben has more than enough to clear any doubt and he should keep going forward, even if it gets to trial. Let her dig herself in deeper and then go after her, press charges and file suit.

One thing I notice when my family gets together with other families is that the kids who are hellions always seem to be the ones who get rewarded for bad behavior. Their parents cave under their pressure and give in, because they feel it’s easier than putting their foot down. They condition their kids to act like brats by doing so — make your parents uncomfortable and you’ll get what you want.
That’s what it would be like if Roethlisberger is innocent and settles anyway: Doing the wrong thing because it’s the easier (or cheaper) thing to do.
It’s part of the problem with our country these days.
If Roethlisberger is really innocent, then this woman has done a horrible, horrible thing, and should be punished instead of rewarded.

    Dear Ben,
Stick to the script and avoid Florio’s legal advice at all costs. Settling is for Frontiersmen.
    Sincerely,

Ben Rapistberger shouldn’t give that whore a dime. not even to put cheese on her whopper.

  15. Wick says: Aug 30, 2009 3:04 PM

Florio hits on a very good point by assessing matters from a cost/benefit analysis to lead to the greater good all things considered.
As Florio and many of us are keenly aware from years of experience, Ben can ramp up some enormous legal fees to prove a point. In fact, my experience has shown that “a matter of principle” is a KEY driver with many people spending $25 for every $1 they recoup upon their ultimately being vindicated, after much stress, time, effort and expense later.
Civil lit has more than its fair share of such scenarios, but family law cases are notorious for letting such factors come into play to the detriment of all in play — but the lawyers. Family law matters often get litigated to unnecessary extremes when emotion, principle and spite all skew a reasonable assessment of how best to proceed moving forward.
And when considering the greater good, Ben has a lot to consider – including the 52 other members of his on-field “Band of Brothers,” plus his coaches and those signing his paychecks …. and the fans.
Florio is right – this should be looked at and assessed “globally,” where it might make sense to take 1 step backward to go 5 steps forward, so to speak.
    Just my 2 cents.

  16. FLORIO'S a HOMerrr O says: Aug 30, 2009 3:10 PM

From the looks of it Florio, you take lawyer jokes very well. So much for the parenthesized self deprecation. And by the way, you now look like a Goomba (small, brown mushroom like creature) from Mario Bros!

  17. Shackman v2.0 says: Aug 30, 2009 3:17 PM

Even though I believe Ben is innocent, Florio makes a significant point. That is, the farther the legal process goes, the more billable hours David Cornwell is going to rack up, in addition to the added court costs every step of the way. Give her enough money to cover her legal expenses plus enough cash for a shopping spree or two and a non disclosure agreement and be done with the whole ugly mess.
Florio, it looks like your suits are getting better but you should ditch the ever present white dress shirt and introduce a little flair with colors, pinstripes, etc. Then you’ll finally look the part of a successful blog CEO.

  18. LiveNBreatheFootball says: Aug 30, 2009 3:22 PM

No settlement. This is one false allegation, not a mere difference of opinion where liability is open to interpretation. He did nothing wrong. He needs to publicly fight this. If he settles, no matter the actual terms, people will think he did something wrong. Plus, to protect the judicial system from further false claims — it needs to be dealt with strongly.
And Florio — fix the FRAKING LOG IN. So annoying.

  19. spyboots says: Aug 30, 2009 3:48 PM

He shouldn’t he pay her ANYTHING. That’s what her goal is — to get money (now that she realizes her fantasy/delusion of having HIM isn’t going to happen). I agree with IceBurgh.

  20. tombrookshire says: Aug 30, 2009 3:55 PM

Only problem with your settlement optioin is that it creates a precedent, opening the door to for someone else to try it, knowing that the plaintiff will be able to get some money, merely for filing suit, regardless of how frivilous, simply because the defendant has deep pockets. The principle of the thing is all important here. If I was big Ben, I would make this gold digger of a woman and her attorney holler “uncle” so that others contemplating doing the same thing will get the message loud and clear. That is the only way to make this stuff go away for good.

  21. csloan99 says: Aug 30, 2009 4:00 PM

Florio, you’re starting to look like Mel Kiper Jr….that’s not a good thing.

  22. Florios_a_tool says: Aug 30, 2009 4:32 PM

Another reason Roethlisberger shouldn’t settle is because of the easy ammo it would provide to unscrupulous rumor mongering “sports” writers. [/cough]

  23. missy says: Aug 30, 2009 4:42 PM

you made a valid point wick but I dont think after what iI read today about the game last night that it is affecting the 52 other men on the team or his coaches and I watched the game and I dont think that it is affecting him either.. I as a fan feel if he does settle then it would look like he did do something wrong andI do not think he did, I think the only thing Ben is guilty of is not using better judgement, What I have read that Florio puts on here is that he is hoping Ben settles , I think he wants Ben to look guilty andI think Ben has this woman and her ambulance chasing lawyer right where he wants them and I would not care if it took ever dime I had I would fight this to the end and I think that other Steeler fans would agree. so it is not affecting us either, We want him to fight this. The sad thing is even when Ben is vindicated, there will still be naysayers that will think he did it and this follow him the rest of his life . So he might as well go down swinging , because in my opinion he is winning this fight.

    I agree with Tombrookshire.
I hate the Steelers, and would love nothing more than to see them fail, but when I say that, I mean on the field. I have a lot of respect for most of their players and their fans. I like Big Ben, despite the fact he plays for a team I dislike. Right from the start, I felt this woman was full of shit. Of course I took part in some of the fun involved with with taking a stab at Ben and the Steelers, but when push comes to shove, I am on big Ben’s side. For him to settle this case, would be a travesty. It’s like admitting guilt, as well as opening up the gold digger door.
This chick is full of shit, and trying to take advantage of the system. You can tell she’s just angry that Ben didn’t make her his main squeeze. She was hoping that her magic box was just “that good”, but sadly for her, it failed to impress. Get over it bitch.

  26. SmackMyVickUp says: Aug 30, 2009 5:14 PM

Ben isn’t married like Kobe was. Kobe should have settled sooner before the details were released, sticking it in stinker, three different dna samples collected from “victim”.
Stuff like that is bragging rights to single guys though, no reason for Ben not to fight it.

    Straw Poll:
To anyone who has ever uttered the phrase “Kill all the Lawyers”, please briefly describe the first time you met Mike Florio.

Kill all the Lawyers? Kill the person that’s doin’ Mike Florio’s hair!

  29. tsenator says: Sep 2, 2009 9:50 AM

I keep seeing where people are saying Andrea McNulty is married……Where has that been said?
Anyone have a link? Or is this a nasty rumor.
Also where is the info on her having imigration & green card problems?
Unless you have some sort of proof and links stop posting stuff with ~nothing~ to back it up
BTW I have followed the case and she looks like she is a certified “nut case” and just plain unstable person. IMHO Ben should not settle it just to make it go away. This can be a message for other loony gold diggers (can you say Rick Pitino, Kobe, etc etc). and their SLIMEY lawyers. We need to find a way to strongly punish these plantiffs and lawyers with these types of frivolous lawsuits
