Roethlisberger again pulls no punches

In response to the hollow settlement offer from the woman accusing Steelers quarterback Ben Roethlisberger of sexual assault, Roethlisberger hasn’t simply said “no thanks.”

Keeping with the trend of pounding away mercilessly at the claims, lawyer David Cornwell has issued a statement that rejects the offer in aggressive and colorful terms.

Here it is:

“Ms. McNulty’s contemporaneous statements and conduct prove her allegations are false.
Against this backdrop, her proposal is bizarre and it insults women who have legitimately
suffered from sexual misconduct.  We will not participate in a destructive farce.  
 
“We offered Ms. McNulty a graceful exit.  Apparently, Mr. Dunlap convinced her that
they can dig themselves out of this rancid hole.  The ‘settlement’ offer is rejected.  We
will continue to press our defenses and claims and pursue our application for sanctions.”

The reference to a “graceful exit” implies that, at some point, a modest cash payment was offered in exchange for a dismissal of the claims.  By all appearances, any offers from the Roethlisberger camp are off the table, and the case will now proceed.

    How do you figure “graceful exit” suggests a cash payment? I would say offering for her to back out without any counter suites is pretty graceful since the allegations are completely false.

    What? That’s a pretty irresponsible thing to claim, when there’s no basis for it.
    Hasn’t Roethlisberger’s team offered McNulty the chance to drop the suit, without them going after her? Or the offer to have her join them in going after her lawyer?
    Never crossed your mind that those offers could be the “graceful exit” that was mentioned?
    There’s nothing to suggest that Roethlisberger offered this woman a dime; especially given how aggressively he’s been fighting the charges. To just pull that out of your posterior and throw it on the front page as truth is irresponsible.

    Florio you tread dangerous ground insinuating that Ben offered her a cash payment. Perhaps the graceful exit they are referring to was when Ben told her just to drop her false allegations, and that the next move would be filing a slander lawsuit.
    Man you are always quick to try and read between the lines when the story is so up front. Do you honestly think that if Ben offered money that Mcnulty and her lawyer would have kept quiet about it? Sometimes in your attempt to stir the pot you just end up coming off as stupid.

    According to foxnews.com, there was no monetary offer. “Roethlisberger and his lawyers demanded in an Aug. 19 settlement letter that she drop the lawsuit and write a letter of apology to the NFL star. In return, Roethlisberger would release both the woman and Dunlap from any legal liability stemming from the “conspiracy to extort and defame” him. Those demands have been rejected by the woman, Dunlap said in his letter.”
    So as I take it, Roethlisberger and his lawyer gave her a free out. She didn’t take it, so now they are going to roast her for making public lies and attacking his character. I hope they don’t let up. This lady is not only an obvious gold digger, but as Cornwell pointed out, she is insulting women who have actually suffered from rape.

    To defend Florio,
    Some times it’s actually cheaper to offer a modest settlement to expedite the situation, rather than pay a top of the line attorney to take something to trial.
    So, while Big Ben probably didn’t offer money, it’s entirely possible, and in some situations, the prudent thing to do.

    This move by the accuser looks pretty desperate. I have said that this women was not raped, but has sex with Ben in a manor she was not comfortable with and has since convinced herself it was rape. Her text messages and emails are just a way for her to joke about it because of how it affected her. Problem is, that still is not rape. Regret is not rape. This women has found a foolish lawyer and a silly reason to pursue this case. I expect her to eventually drop it altogether.

    How quickly people forget that Mr. Florio was praising the accuser’s attorney and his “credibility” at the begining of this suit.
    Obviously he did not investigate any of the accusations before filing suit.

    The sanctions against the attorney who brought this suit ought to include:
    1) all the inflated defense costs yet billed and incurred by Mr. Roethlisberger
    2) Polishing the judge’s gavel and bench.
    3) Requiring him to wear a Roethlisberger jersey for every court appearance for a year. So he will be a marked man in the Nevada Courts.
    4) Participation in an episode of Reno 911.

    Does anyone seriously think this “settlement if you admit you did it” idea was Andrea McNulty’s? I used to scorn this woman, now I just feel sorry for her. Clearly it’s her lawyer who’s the instigator of all this — and who should suffer most when the truth is outed.
    Such irresponsible posturing is disgusting even for the legal field. He should be disbarred at the minimum should the whole thing be proven a hoax as it seems.
    Maybe Andrea and Tila Tequila can get together for some shooters and become the new Thelma and Louise. What a movie that would make!

    Subtle difference in the two nicknames you mention. ‘Rapistberger’ is based on allegations, all seemingly false, of a woman who was nutty enough to want to marry a fictional soldier. ‘Cheatriots’ is based on the cold hard fact that the pats cheated and were busted by the league. No amount of Tom Brady worship is ever going to change that.
    However I do agree that Ben’s choice of female companionship was pretty sad in this case. That said I am the last man to begrudge someone of a weak moment in a casino hotel after a day of boozing it up on the golf course.

    Cheatriots was really stupid, but at least it was true. They did cheat, not that it really mattered. Anyone who has paid any attention would know that Ben did not rape or “near-rape” this nut.     Good! He should pursue this to the end, including launching his own defamation case.
    Listen these events happen all the time. Virtually every time the accuser is found to have made a specious claim they never see prosecution for said inventions. All that does is create a no-lose situation which encourages more of these character assassinations. And it needs to stop. I applaud Ben and his legal team for making a stand.
    The tragedy of course is that these specious accusations simply undermine the plight of women who have been legitimately been raped or abused. But you can’t let the situation continue where these types of malevolent actions go unchecked. Unfortunately for the most part, they do. This is a huge issue and it doesn’t just affect the wealthy. It’s just as easy for claims like this to be made within the context of divorce or custody proceedings. It’s just as easy for some Joe somewhere to get accused of something like this because somebody has an agenda or a personal grievance. And these average guys don’t have the resources to fight it. For many reputation is all they have. There needs to be a change in the law to put checks upon this kind of unconstrained abuse. It has to stop.

    Florio’s position seemed much more clear in the “hollow settlement offer” link above. All should read that first fefore defaming Florio (in this case) though I will agree Florio does tend to sway with the wind.
    On a different but pertinent subject: The only settlement I am aware of (and I know only what I heavily researched on the Net) that included “cash” offered by Roethlisberger was an offer to pay for psychiatric evaluation/care for McNulty if McNulty provided a written apology and/or agreed to drop the charges.
    Since I was not in “the room”. I remained neutral before reading (as they surfaced) all the IMs/emails from/between McNulty, her work peers, her work superiors and her ficticious “lover” (provided by Harrah’s and/or Roethlisberger’s attorney).
    I remained neutral before reading the court dockets from 2 of her work peers/friends.
    Bottom line…Ben…you need to exercise better judgement. I’m a 55 year old woman speaking to you like your Mom may not (but would like to)…don’t let your pee-pee lead you around like a compass. Use the head on your shoulders.

    The sad thing about this case is that Mr. Dunlap is calling the shots for the benefit of his legal practice and does not have Ms. McNulty’s best interests in mind. The last thing Dunlap wants are to have his legal practices discredited. He didn’t investigate his client before moving forward with the case. He is now stalling to avoid admitting he is a fool. Along the way he has harmed his own client.
    In the end I hope Ben and his legal team take a pass on McNulty but go after Dunlap to the fullest legal extent. His behavior has made it more difficult for women who have been harmed to legitimately bring cases.

    Pretty slick move on her part – trying to look innocent by offering to drop the charges with an offer she knows he can not take. Maybe Kobe’s girl should have tried this route too?
