Court denies several motions in Roethlisberger case

On Tuesday, the judge presiding over the sexual assault civil suit filed against Steelers quarterback Ben Roethlisberger issued rulings on various pending motions.

And, for the most part, the rulings favored the plaintiff.

The Court denied Roethlisberger’s motion to dismiss a fraud claim arising from the allegation that he lured the plaintiff, an employee of Harrah’s, into his hotel room by claiming that his television wasn’t working.  In a one-page ruling (most of which was taken up by the caption of the multi-defendant lawsuit), the judge found that the allegations “are sufficient to state a claim upon which relief could be granted.”  The Court also pointed out that a motion to dismiss “is only proper where it appears beyond doubt that the plaintiff could prove no set of facts which if true, would entitle [her] to relief.”

The Court also denied Roethlisberger’s motion to dismiss the case based on the plaintiff’s failure to sue Harrah’s directly, finding that the claims against Roethlisberger are independent of any other claims the plaintiff might or might not make.  (The plaintiff has since filed a motion to amend the complaint to add Harrah’s as a defendant.)

Moreover, the Court denied a motion from Roethlisberger to expedite the pre-trial discovery process, and a motion to strike the complaint based on the argument that the allegations are too salacious and graphic.

The only good news for any of the defendants was that a motion to dismiss the claims against defendant Stacy Dingman, a former co-worker of the plaintiff’s, was granted in part as to a trespass claim asserted against Dingman.  The Court also required the plaintiff to provide more specificity as to a claim of civil conspiracy.  But the Court denied a motion from Dingman to dismiss four other claims, including intentional infliction of emotional distress, defamation, invasion of privacy, and a claim for punitive damages.

Despite the fact that all of the motions filed by Roethlisberger failed, his legal team is taking a glass-half-full approach to the language of the Court’s orders.

“Notwithstanding the result,” lawyer David Cornwell said in a statement released to PFT, “we are encouraged by the Court’s specific reference to the standard by which it considered the motions.  Finding that the plaintiff survived this round because of a generous ’beyond [a] doubt’ standard indicates that, at these early stages, the Court is inclined to give plaintiff her day in court.  Of course, this cuts both ways.

“In any event,” the statement concluded, ”her allegations remain false and we remain committed to a vigorous defense.” 

And so the case eventually will proceed, with a trial date established and various deadlines set for pre-trial maneuverings.  At some point after depositions are taken (that’s not an angel getting his wings — that’s the lawyers’ cash registers churning), Roethlisberger and the other parties will file “motions for summary judgment,” a tool for challenging the legal validity of all or some of the claims without a trial.

Still, at some point, the plaintiff will need to explain away a series of pre-incident e-mails indicating that she wanted to have consensual sex with Roethlisberger.  Absent a sufficient explanation for her written words, we doubt that the case against Roethlisberger will make it to trial.

    Great analysis Florio. I agree – the summary judgment stage is going to be the key. Dunlap better come up with something better, plus an explanation of her emails, if he is going to get this case in front of a jury.
    In the meantime, I wish Roethlisberger would stop making TV appearances for WWE, Shaq, etc… – its a bad vibe (despite the charitable nature of the WWE appearance). He should be laying low until he can get a dismissal or until he pays her off.

So why would the judge continue this farce now only to dismiss later?
    Disagree w/mixman 34 on the Roethlisberger updates. Though my brother is a practicing criminal defense attorney and rabid Steelers fan, when he’s in court–as he is today–it’s easier to come here for your take than to reach him. So I appreciate your coverage. But mixman34 is right on the big picture. Fans shouldn’t have to be talking about stuff like this during the season–and if the judge had done his job, we wouldn’t be.

    The attorneys have not even been allowed the opportunity for oral arguments or responses yet – the dismissal, if it comes, would be much more likely to occur when the judge rules on motions for summary judgment.

    Good post Florio, Thanks for explauining what is going on, I think this does need to go to the phases but like another poster on here I think once they do the motions for a summary judgement and can look at everything I think then it will come into a better light , from what I ahve read about the other defendants lawyer, she is no push over and she has already stated that the emails will put her scheme into light..I cant wait to hear her explanation for the emails, this ought to be good, because I am sure that Bens attys and the other ones attys have alot more on her than they are letting out, I think Ben has tried to give her easy out, so now lets go to court when you are exposed for the lying Ho you are countersuit…i say this because of the half-full note, Bens attorneys do not seem to be worried about this going to court. For one, who cares if it comes out that they did indeed have sex, any one with a brain can figure that one out, I dont think it has hurt him so far, I do not think he will/or should not settle with her , why pay for something that she obviously gave up freely, or why would Dumblap have made the statement in their last motion to add Harrah’s that Ben has neither acknowledged or denied any sex with Nutty, I believe that he should not have to admit anything till it goes to court, But will an admission of sex with said Nutjob make me look at him any different, NO, he is single , and the last I checked consensual sex is not a crime, I agree with your finish I think once the motion for summary judegement is done , I think it will be dismissed then, but it should have been before now, but that leaves the door open for Ben and the rest of the defendants and Harrah’ because given what this judge has done so far I look to read any day that he has added harrah. they can sue her for everything that she doenst have,a nd have her ambulance chaser disbarred.

    @Ravenmaniac – Did you see Kevin Kolb tear up the Kansas City Defense? Nuff said. The Ravens barely eeked out a win vs. the Chargers depleted defense. And beat up the Browns (who hasn’t/who won’t this year?). If the Ravens win the next 3 games I’ll be very impressed.
    As all fans of championship teams know its not how you start the season, its how you finish it. Lets see…
    Flacco’s senior year @ Delaware loses to Appalachian State in the Championship game.
    Flacco’s rookie year = throws a beautiful pass to Troy Polamalu in the AFC Championship game, which was returned for a touchdown. (I can still visualize his beautiful hair flying in the breeze..LOL!)
    Wanna know more about Ben’s 4th quarter comebacks/clutch-ability look up the stats, educate yourself, and get back to me.
    Flacco has a much better offensive line and running game to his disposal than Ben. Similar to what Ben had earlier in his career.

    @Ravenmaniac – if you want to play the “what if” game, the Steelers could be 3-0 “if” they didn’t allow two 4th quarter comebacks. And I agree they could also be 0-3. The Ravens could easily be 2-1 “if” they let the game against the Chargers slip away.
    Just because the Steelers are in 3rd place right now doesn’t mean that they will finish that way. Just because a team starts fast (two wins against KC and Cleveland) doesnt mean they will be successful in January and February. Lots of things can change between now and then.
    I’m not going to argue or say that Joe Flacco is not a good quarterback because he is and has proven it. Lets just see what he is made of when it counts (again). Do you really trust the receiving core that surrounds him? They can put up big numbers against Cleveland, San Diego, and KC…but can they do it against elite defenses in the NFL. We’ll see.

    Motions to Dimiss are notoriously hard to win at this stage. Courts are big on access and giving everyone their day. So, unless there is an actual writing out there saying she made the whole thing up, those Motions were going to fail. They had to be filed to preserve the issue for appeal, but they were longshots.
    Doesn’t mean she has a strong case (she doesn’t), just means the judges are giving her the benefit of the doubt — for now.

    I’m hoping the ravens take it all away from him and he cries big tears. I’m hoping that Big Ben learns his freakin lesson with regards to women and hotel rooms. Did he sleep through that intro course when Steelers signed him that taught women and hotel rooms don’t mix? He’s certainly sleeping through his play calls and no I don’t think the offensive coach needs to be fired. He’s giving Ben the freedom to calling the plays and running them.     Judge Brent Adams is a KOOK! I had a case in his court and after the case was settled in a pre-trial settlement, he forced all of the involved parties (myself included) to watch a video. What I thought was going to be a video on the aftermath of settling a civil case was, instead, a rambling video about Rose Kennedy! All of us that were in his chaambers looked at each other in total amazement and although words were not shared in the chambers, my attorney told me afterwards that he NEVER saw or was privy to something as bizarred in his entire legal profession. Of course, this was before Judge Adams went into rehab! Another example of a person who has no business being on the bench or, at the very minimum, needs a psych evaluation. This case is an abomination and a character asassination of a professional athlete who will have to defend his reputation for quite some time!!! A kook for a judge, a kook for an attorney and a whackjob for a client! No wonder why people hate the legal system
    First Judge Adams denies a request for a change of venue even though the purported crime didn’t even take place in Washoe County. Then he denies the defense the request to speed up the sharing of information. And now he has denied motions to dismiss the case.
    All of this is reflection Judge Adams’ modus operandi. He sees this as an opportunity to satisfy his monstrous ego to handle a case of a national celebrity. No doubt, TV cameras will be permitted by him so he can bask in the lime light of national TV. No one should be surprised when Judge Adams – the self professed master of mediation – is milking this for all its worth. It’s good source of income for his lawyer friends and good for Judge Adams who has made no bones over accepting “donations” from any and all parties whose cases he handles.

    Like I said I am anxious to see what happens over the next few weeks. At the beginning of the year I would have said I am not confident in our receivers, but after the last 3 weeks, I am confident in not only them but in Flacco as well.
    Like you said, we will see what happens against the elite defenses (although I think there are only 2 elite defenses in the league and we both know who they are).
    To me, the steelers will be ultimate test for Joe.

    I noticed that too. And he is still too much of a coward or too ashamed, one or the other, to even admit who is team is. I think he just looked at a list of NFL teams and saw who won the most super bowls and decided to go against that one. The coward probably doesn’t even know anything about football.

    You should write for television. You’ve created an entertaining fantasy that proves:
    a) you know absolutely nothing about the workings of top-flight hotels
    b) you didn’t read McNulty’s original 36-page complaint against Roethlisberger because your timeline doesn’t fit
    c) you haven’t bothered to read any of the time-stamped e-mails and text messages McNulty sent by McNulty before and especially after the fact because they blow your scenario all to hell.

    No, you don’t have this right. You sound like a small child comparing apples to baseballs. Michael Vick committed a crime. He was caught red-handed, confessed, convicted, sentenced, served his time, and now, yes, he deserves to go on with his life.
    Technically, Ben Roethlisberger has not even been accused of a crime. A year after the fact, a woman has alledged something without one shred of evidence to back up her claim. Rather than seeking justice as a crime victim, she has asked for $3 million instead. No matter the outcome of this case, he will not be convicted or go to jail. And there is a great deal of evidence that he didn’t do anything more reprehensible than choosing the wrong woman for a one-nighter.
    You make a good point about the value of human life, but you’ve picked a silly case to do it.

    The whole Harrah’s incident proves that he’s not smart at all, just horny…
