No charges against Tom Cable

The Napa D.A.’s office announced today that it will not file charges against Raiders head coach Tom Cable in connection with an incident that left former Raiders assistant Randy Hanson with a broken jaw.

D.A. Gary Lieberstein said he decided not to file any charges after a lengthy investigation of Hanson’s accusation that Cable knocked him out of a chair and broke his jaw.

In a written statement distributed to the press today, Lieberstein said, “We have concluded that the facts and evidence developed do not warrant criminal charges be brought against Tom Cable in regards to an incident which occurred on August 5, 2009 in a hotel room at the Oakland Raiders’ training camp in Napa.”

In a press conference outside his office, Lieberstein added, “Our decision is based on a full review of the evidence.”

Lieberstein noted that there were “many inconsistencies” in Hanson’s statements. He said Cable declined to speak with his office.

Describing his findings on the August 5 incident, Lieberstein told the assembled media today, “Coach Cable did apparently get angry and move toward Mr. Hanson. A couple of the other coaches stepped in between. There was no direct contact that we’ve been able to establish between coach Cable and assistant coach Hanson. There was possibly a situation where Mr. Hanson had his feet up on the table. It looks like that’s what occurred — he was either bumped into or lost his balance. He did fall over backward.”

Although Lieberstein said there were verbal threats made toward Hanson, he added that, “There is no evidence whatsoever that would support that Tom Cable ever physically struck or physically pushed or assaulted in that manner Mr. Hanson.”

    They didn’t file charges because the Raiders hold their training camp there… Al Davis paid them off…blah, blah, blah
    Get over yourselves. The Raiders have a closed training camp, no one comes to Napa to watch them and subsequently spend money. The only entity in Napa that makes money off the Raiders is the Mariott.
    Maybe they didn’t file charges because Hanson was looking for a payday and his story kept changing. He got his jaw broke, but we’ll probably never know how it really happened so move on.

    Pathetic. There’s a reason why there are no charges. This DA is too much of a whimp to lean on the Raiders’ staff who witnessed this Neanderthal behavior from Cable. They’re all going to keep their mouths shut for fear of being labelled snitches throughout the NFL. If Roger Goodell had any guts he would have leaned on the Raiders to get help get Cable indicted. The Raiders are simply the most inept NFL organization in modern times. I’d feel sorry for their fans if I didn’t think those idiots with the black and silver greasepaint were so stupid.

    After discussing several examples of Hanson not cooperating with the police, the press release says:
    “It should be further noted that within the past week and a half, Mr. Hanson showed up unannounced at the police department and made a statement to the effect that since the Raiders had not given him what he asked for, he would now fully cooperate with the prosecution.”
    Additionally,
    “The evidence is overwhelming that Mr. Cable did not intend to inflict the injury suffered.”
    It is over as a criminal matter. There’s always the possibility of civil action. That will not be nearly the distraction. Most likely the NFL takes no action against Tom Cable.
    In other, unrelated Raiders news, there will be a blackout in Oakland due to slow ticket sales.

    UM, Michael, you are the only person reporting that verbal threats were made by Cable. Every other report I have seen have said that it could not be confirmed, whats up with the bias statements, I am posting one of the many reports I’ve looked at. It’s on examiner.com (Patrick Patterson)
    After review of all of the evidence, Randy Hanson’s broken jaw was not the result of a a punch thrown by Tom Cable, but in in fact due to an accident.
    Cable ‘was approaching’ Hanson and ‘bumped’ into Lionel Washington who was coming between Cable and Hanson, this knocked into Hanson who was leaning back in his chair, and this resulted in Hanson breaking his jaw. This story was confirmed by the other coaches who were present. (The district attorney could not even confirm Hanson’s allegations that Cable made verbal threats.)
    Cable has maintained throughout that once the story came out he would be vindicated, and he would maintain his faith in the system. With the district attorney not only neglecting to file charges, but clearly stating “This case is not worthy of the criminal justice system” his assertion has been borne out.
    Randy Hanson told the district attorney’s office, “Since I am not getting what I want from the organization, I am going to aid in the prosecution.” The question becomes what did Hanson want from the Raiders. Did he want a promotion? Cable’s firing? This exposes questions about the background of the Raiders organization.

    “If [Hanson] had been punched, slammed against a wall, and threatened to ‘kill him’ we would be having a very different conversation.”
    “Hanson was making statements more extensive to the media than he had to law enforcement.”
    “There were many inconsistencies and that contributed to our decision in this case.”

    So how come when the initial story (http://profootballtalk.nbcsports.com/2009/08/17/cable-allegedly-punches-assistant-coach/) broke Hanson wouldn’t say who did it, but Nancy Gay indicated it was because Cable sucker punched him? How does an accident, which is what the police are trying to sell here, get characterized as a sucker punch when the guy who got hit won’t name the assailant? How does the concept of “sucker punch” even enter into the story when nobody is copping to it?
    Maybe because the people who saw Cable hit Hanson are too pussy to admit the truth when it matters. Regardless, Goodell has enough material here to move on it. This will be an interesting test for him. My guess is that he’ll, incorrectly, pass.
    And those cops? They should be ashamed of themselves.

    Ok first off, you mis-spelled wimp. Second off, If anyone thinks this is the first time coaches have gotten into an altercation behind closed doors, you are sorely mistaken.
    Additionally, it says right in the story I read on a news site, that Mr. Hanson showed up at the police station and said he would go along with the prosecution because the Raiders didnt give him what he wanted.
    So what does that say about what kind of guy this is?
    And to the guy who says that the Raiders are the most inept organization in modern times. Dude….they just made it too the Super Bowl nine years ago, and they wouldve made it to a couple more if it werent a cheap hit on gruden by a certain Balt. Raven, and another instance I will not mention! They were a pretty damn good team with Gruden the whole time.
    Dont get me wrong there has not been a lot to like and being a Raiders fan is tough right now. They seem to make mistakes at every turn. And every time you think there is a light at the end of the tunnel. The lights snuffed out before you know it.
    I am glad this is behind the team and the NFL. Who knows maybe Jamarcus can complete more than 50% of his passes again this week!

    Have any of you seen a photo of Hanson? He looks like somebody who would be found on the National Sex Offender Registry. He’s one shady and creepy looking dude, aLa, serial killer style.
    Anyhow, dude’s jaw was broken, but how bad? I never saw a story indicating how bad it really was. I remember my buddy broke his jaw doing a faceplant while skate boarding and he couldn’t talk for 3 weeks. He even re-broke his jaw at one point by getting a simple nudge.
    If Hanson’s jaw was really as bad as it was painted to be, how did he talk to police?
    Was it a hairline fracture?
    After ready all the stories (bay area and national), Cable was tried and convicted in the media. All the stories and comments coming out were downright ridiculous at times.
    Sure the story came out and I was all over Cable. He outweighs Hanson by 200 pounds or more. And plus Hanson’s jaw was broken.
    Then the stories and radio talk shows started talking about Hanson (shady character, undermined both Kiffin and Cable — allegedly — a drug abuser) and I started to believe him less.
    Now we have the Napa DA saying Hanson showed up randomly and changed his story over and over?
    I’m more inclined he was bumped, fell backwards on his chair, tried to catch himself and banged his jaw on a cabinet, than I’m inclined to believe Cable punched him at this point.

    Cable had the rare good sense to follow his attorney’s instructions. Don’t be naive. Innocent people do get convicted or have their lives turned upside down before being exonerated–and it often starts with them assuming they can talk freely because they have nothing to hide. Words can be twisted by people who need to make them fit a scenario. Don’t assume it can’t happen to you because you’re a good guy who never gets into trouble. That’s what Richard Jewell (if you don’t know, Google him) thought.
    Right now, half the people on this board assume Cable assaulted Hanson just because Hanson accused him and Cable works for a dysfunctional organization. That’s not much evidence, but they’re still demanding jail time and league suspensions. Oh yeah–Hanson also has a broken jaw, but what does that prove? I tripped over my own feet in the sixth grade and broke my arm. It happens.

    a) how Hanson says he was punched but won’t say who when he’s in the hospital. Hanson might have jump on the opportunity bus at some point but it sure wasn’t right after the incident.
    b) Nancy Gay breaks the sucker punch story using her sources (obviously can’t just be Hanson here)
    c) the players start chanting Cable-bumaye around their coach
    d) Cable wouldn’t talk about it. If it’s an accident what does he have to hide?

    The league needs to take a stand now. Otherwise they risk saying it’s not ok to touch Tom Brady’s helmet, but it’s perfectly fine to slam an assistant coach up against the wall breaking his jaw.
    Workplace violence is a huge problem. The league needs to set the example.

    Um, people, it’s over. In the eyes of the law, there was no assault. The authorities concluded Cable DID NOT break Hanson’s jaw. So there’s NOTHING for Goodell to pursue. Reporters and blog posters can convict on wild speculation. But courts need evidence beyond an injury (which can happen any number of ways) and unsubstantiated finger-pointing. You may not like it. But it is what it is.

    To what degree was his jaw broken? They say he is completely healed. No jaw wiring etc. I bet he went in and they told him he had a hairline fracture. He saw payday.

    He could file a civil assault case. Assault occurs by creating a reasonable apprehension of immediate harmful or offensive contact with intent on the part of the defendant to bring about the apprehension. Cable didn’t actually have to touch Hanson. If he went after Hanson and was threatening him and Hanson believed there was an apparent ability for Cable to contact him, even if he could get out of the way, that is enough. Cable did not need to intend injury. Because assault is an intentional tort, Cable would be responsible for all damages arising out of the initial action, no matter how unforeseeable they are. Crazy part is, I just took an exam on this stuff a month ago. I’ll have to pass this scenario onto my Torts professor. She can have a fact pattern for next year’s exam surrounding the crazy happenings of the Raiders organization.

    The claim that Hanson fell over backwards and broke his jaw is just ridiculous. There is no possible way that someone could fall BACKWARDS and break their jaw. And the only people buying that story are the paid-off DA, and the desperate Raiders fans who keep hoping that one day their team won’t be the biggest joke in the history of professional sports. Wake up people, as long as Al Davis is allowed into the building, your team is going to continue to decline.
    The Raiders are so freakin’ dysfunctional and messed up, it’s beyond a joke, it’s just downright insane. For the fans, the players, AND the coaches. Someone needs to do the NFL a favor and just put Al Davis’ crusty old arse in a retirement home and throw away the keys. SERIOUSLY. What is it going to take to kick this guy out of the league? Does he have to run over someone with his car during one of his Alzheimer bouts?
    This is serious. Al Davis has obviously been struggling with dementia for years now, and nobody has done anything other than coddle and enable him. It’s a shame to Al Davis’ early legacy, a shame to his family (why aren’t they getting this guy the medical help he obviously needs?), and a shame to the NFL. I’m not kidding, and I’m not saying that just to “hate” on the Raiders. God knows I’d love to hate the Raiders but I just can’t bring myself to do so. I actually FEEL SORRY for you guys.

Nah, I’d say your problems started way back in the early 90′s, when Al Davis ran Marcus Allen out of town. The only thing even remotely interesting about the Raiders since then has been wondering how much crazier things can get, and then finding out a few weeks later when Al Davis once again makes some outrageously stupid (and insane) move and everyone around him acts like maybe, just maybe, he isn’t a crazy old man suffering from Alzheimers, and that maybe he actually knows what he’s doing. And then he runs off and fires a coach, alienates a star player, his coaches start threatening journalists or other coaches, oh man… the list just goes on and on and on and on.
    The dementia has ruled so long in Raider Nation that even the fans are starting to get into the act. Well, you know what they say: It all starts at the top.

    It’s Napa man, they make far more money off of the tourists who come from all over the world for the wine. Those same tourists who pay full price for hotels, meals, etc. So yeah, Napa would probably benefit more economically if the Raiders didn’t hold their camp there.
    I know you all wanted more food for your Raider hating appetites but it isn’t coming from the criminal charges against Cable.
    It’s okay though, you can continue to speculate and call BS, it doesn’t bother us. Because as much as you want to say the Raiders are insignificant, you continually prove yourselves wrong by reading and commenting on anything Raiders related. I will believe that the Raiders are insignificant when all posts involving the Silver and Black stop being some of the most commented on articles on this site and others. You can’t stop though. Love ‘em or hate ‘em, the Raiders are good for the NFL.

    @DavetheDude … Yeah, Davis has issues. But they’re his issues and don’t affect the Seahawks, so why are you so bent out of shape? Hanson could have hit the desk going down … twisted when he fell and hit face to floor … tumbled and had the chair land atop him. It’s not that mysterious.
    @Vito … True, assault doesn’t require physical contact. But the DA clearing Cable makes it tougher for Hanson to pursue a civil case.
