The Pittsburgh Post-Gazette reports that Washoe County Judge Brent Adams issued the stay on Monday. Almost two months back, a judge denied a motion to move from Washoe to Douglas County. In mid-October, Roethlisberger appeal that decision. His appeal is reportedly in its "early stages."
Roethlisberger is accused of sexually assaulting a Harrah's employee that PFT reported has since resigned from her position with the company.
Delay ... delay ... delay ... meanwhile the plaintiff now has no visible means of income ... and none will be soon forthcoming. Good move.

Because Douglas County has jurisdiction where the Lake Tahoe Harrah's Casino is located (where she claims the assault took place) and would be the logical place to file charges -- not in Warsaw County (which is where she LIVES).

I think that this particular cases always favors the male in court. It is above and beyond sad but its the truth. Women who are viticms of sexual abuse and rape are often blamed for those actions. The "you shouldn't have wore that" sort of thing. It is without a question one of the biggest problems with our criminal justice system. As a woman I would assume you would understand and try to give her the benefit of the doubt due to this history. Just because you are a Steelers fan, and your QB is a fat statue, doesnt mean that you can ignore justice.

The defense has produced text messages that conflict with both her story and timeline and affidavits from coworkers to whom she bragged about her one-niter w/Ben. When they wouldn't back her rape allegation, she sued them, too. You feel bad about the pressure she's under? What about her coworkers? If I were one of the people she sued, I wouldn't be inviting her to lunch.
The thing is, she never expected to still be working at this stage. She sued for $3 mil and her lawyer convinced her Big Ben would write a Big Check rather than risk his rep fighting back. Things haven't quite gone as they planned.

It infuriates me because women like McNulty make it more difficult for real rape victims to get justice. And yeah, if it were Romo or Flacco in the same circumstances, I'd be just as furious. What this woman is doing is wrong.

Several reasons pertaining to advantage. No matter what a legal team thinks of their case, they should always strive to put their client in the best position to win. Especially in a high profile case such as this one that will further careers if won.
There is a much higher median income in Douglas County compared to Washoe County. Douglas County is much smaller than the mini metropolis (Vegas lite) of the Reno-Sparks area. AKA more NFL fans...less bleeding hearts.
The Reno-Sparks area of Washoe County produced the Ozzie Osbourne lyrics lawsuit. Of which some kid committed suicide and his parents blamed it on Ozzy's song lyrics. AKA the frivolous lawsuit capital...

I could have used a burger but seriously, as a Cowboys fan who has to hear "Tony Homo" all the time, that gets annoying. He is a fat statue and again, he is protected by the best o-line in football. They get crap because Willie Parker is a terrible back and Ben holds the ball for too long because has no ability to scramble to give his receivers time. Obviously Denver's defense had some holes with 29 y/o Ty Law being the teams nickel back after being on the team for 3 days.

I disagree, this woman became less believable by her own words. She bragged to anyone at the hotel whom she worked with. So where is it justice, to see a man falsley accused. And Yes I say this as a woman , and not just as a fan of the "fat statue " as you call him. The only thing Ben is guilty of is not using better judgement. Nothing more. I would feel this way if it was any other guy that was being wrongly accused.
So answer me this, if she wanted justice, why not put him in jail? Huh , she never went to the police never went to the DR. wouldnt justice be better served with him in jail? No she chose to go to a lawyer and go after his money. And a year after the fact.

With all due respect, I'm sure the women on this site don't need instruction from men in how to react to rape issues. Most of us have either been there or have held the hand of a friend who has. I've spent time with dozens of victims of all ages who've been through things you could not imagine in your worst nightmares. And neither could Andrea McNulty. My first inclination is ALWAYS to believe the woman. I don't care WHO Ben plays for, if I thought he'd raped someone, I'd want him to pay for it.
But I've read every word of her complaint and gone over it with a practicing criminal attorney who's represented both victims and defendants in similar cases. From a victim's perspective and a logistical perspective there are BIG problems with her story. The pieces didn't fit from the outset and the witness affidavits plus her time-stamped text messages and e-mails, which have come out since, refute her account.
A woman who makes a false rape claim to bilk an innocent man out of $3 mil is no better than a man who victimizes women. And it would be easier to believe you're sincere in your concern for women if you weren't telling us we should condemn Roethlisberger because he's a "fat statue."

I said that the criminal justice system tends to treat the women unfairly in rape cases. So I will accept your apology to that point. This I would totally disagree with. In most states and cases all that is needed is a woman's word and it is in both the newspaper and the courtroom.
Whether the man is innocent or proven innocent by a decision of 11 unknowns in a courtroom is pretty much immaterial...the damage to his name is already done.
Admittedly I do not know much about this case other than what I quickly researched from the post-gazette above. But other than the fact that Ben risks any crazy ex-girlfriend or former one night stand coming out of the woodwork (a risk already on the table now)...he might as well apologize and pay the $100,000 to the committee to aid abused women. As opposed to take the risk of losing in court and ending up with a long term prison sentence.
Because once he has been accused of this, the damage is already done...

She originally sought $490,000 total in actual damages from Ben and several coworkers plus an unspecified amount from Ben in punitive damages.
On Sept. 10, the Washington Post (where I first read it) and other news outlets finally reported that the unspecified punitive damages included $1.5 million for emotional stress and $1 million for damage to her reputation. That's 2.5 mil plus $490,000, which comes to $2,990,000. I rounded up to $3 mil.

Okay, so Ben counterpunched by introducing evidence that she'd bragged to others about wanting to be with Ben beforehand and about hoping afterward that she was pregnant w/Little Ben. They have text messages/e-mails she sent about him, etc. THAT'S when she made this counteroffer you're quoting. But there's a catch.
She claims Harrah's covered up for Ben. If Ben didn't do anything, there was nothing to cover up. (And if you'll read her complaint, you'll wonder what they could have covered up. Her story doesn't include any witnesses or physical evidence that needed to be covered up.) BUT if Ben took her counteroffer and said he did it, she'd suddenly have a very good BIG BUCKS case against Harrah's. Interesting how all that works, huh?

No risk of jail time for Ben. She waited a year after their one-night stand and filed a civil suit. She never approached police and they've stated they have no evidence a crime ever took place. Since she's filed no criminal complaint, no charges will be pursued. From the beginning, this case has been solely about money.

The Washington Post is rock solid...nobody here should have any qualms about their info.
So basically we have Ben-Harrah's standing in one corner with an agreement to drop the whole shebang (ooops is that a pun?) provided they kicked down a generous $3 mil...and Andrea McNulty, a former Harrah's employee, who blew her cover with text messages bragging about bagging the quarterback and by not having any witnesses or hospital records that coincide with her story.
Further proving my earlier point about all that's needed is her word to get this into a courtroom and in the newspapers.
So Ben's name is pretty much ruined...he now faces a courtroom battle with his freedom, career and future at stake...while she plays the victim and denies any culpability.

I am a rather realistic fan on all levels and believe me, I'm not even a Steerler hater. I wasn't alive in the 70's so the only Superbowl I saw against the Steelers displayed Larry Brown destroying you guys. So you can drop that one.
