Let me tell you about the state of georgia……anything over a single ounce (28 g) makes you a dealer in the eyes of the law.
Also, possessing two separate bags also makes you a dealer (bringing the intent to distribute charge) in that state. Meaning….if this cat had been riding around with 3 dime bags totaling less than a quarter ounce, he’s getting that same felony intent charge that he got here.
It’s ludacris.

Why even write 40 grams, so that all the nerds of society can be like, oh my gosh…40!
Its is an ounce and a half. If it was 3 bags, than it was 3 half ounce bags.
In man states, an ounce is de-criminalized. In many countries, it is legal.
This is stupid for an nfl player to be driving around with, but there will be no jail time for this. And whoever is behind writing 40 grams, should be shot. The only thing were weighing in grams is the white powder.

Intent to deliver???? What crap! Yep, ganja should be legal, but short of that, the amount of pot you have should not change how you are charged. If a pot buyer can buy it less often in bigger quantities, doesnt that reduce the drug traffic in neighborhoods wehre pot is sold? Wouldn’t less traffic, lower the possibility that there will be violence? Come now people, pot is smoked legally in 13 states, and a state such as GA is still moving possesion into the Felony neighborhood? What flippin joke!

In addition to the possession charges, Babineaux is charged with having no tag light and driving without a license and with an expired tag. He also was charged with tinting his car windows too much.
Babineaux has been arrested before in Gwinnett County. In 2007, he was charged with killing his girlfriend’s dog, a pit bull-mix , but the animal cruelty case was dismissed nine months later.
An autopsy ruled the dog, Kilo (YES…that’s right…the dog’s name was KILO), died of blunt force trauma to the head.
