NFL cracks down on "Who Dat" merchandise

It’s one of life’s great unanswered questions: Who dat say dey gonna beat dem Saints?

We do know, however, who the NFL say can’t make any more Who dat t-shirts.

WWLTV reports that many businesses in New Orleans have received cease and desist orders for printing and selling Who dat shirts.

“I really thought the ‘Who Dat’ was something that belonged to the
people more than to the Saints or to the NFL or anything else,” said one shop owner Josh Harvey.

NFL spokesman Dan Masonson disagrees:  “Any unauthorized use of the Saints colors and other
[marks] designed to create the illusion of an affiliation with the
Saints is equally a violation of the Saints trademark rights because it
allows a third party to ‘free ride’ by profiting from confusion of the
team’s fans, who want to show support for the Saints.”

A nearby Loyola professor believes there is some legal gray area here, but the small shops are wary of taking on the league.

It’s a wise move.  Not many people beat dem NFL officials either.

    Make the t-shirts with no Saints logo, and black/gold/white. Without a Saints logo, there isn’t sufficient linkage to the team’s trademarks.

    Shop owners should take a page out the the “Red Cross/ Wyclef Jean” book and say the proceeds are going to help the people of Haiti.

    The NFL has been fine with these same places selling these same types of shirts with the Who Dat phrase for years. The difference now is that the Saints merchandise is selling like hotcakes and the league wants a cut.

    Who Dat was started locally before the Saints were even around. It has been widely adopted by Saints fans and the team, but doesn’t origin have something to do with all of this.
    But then again, how is the mom and pop store down the road supposed to take on the NFL.

    The Bengals copied off the Saints. The Saints copied off the local college/high schools in the area that had used it in the 60’s.
    But that’s just sports related. The origin of the saying goes back way further than that. So in reality, they’re all copying.

    Florio seeing as you are supposedly a lawyer, do you want to maybe chime in with some legal stuff here? This seems shady unless WHO DAT is a trademarked logo than it seems unlikely that the NFL would have any right to tell these places to stop selling this. If I make a shirt that says “I love my football team from the city of San Francisco” am I in violation of some NFL rule?

    First, the NFL can’t copy right ALL fleur-de-lis, only the SPECIFIC design the Saints use. Personally, since the fleur-de-lis belonged to the City of New Orleans for 100 years before the NFL even existed, maybe the city should send a cease and desist order to the League demanding they take the logo off the helmets and uniforms, since the league used them without permission.
    Second, Who Dat is a phrase, created by the fans. The NFL has NO jurisdiction over that, the greedy b–tards.
    Specifics
    @djn21, the shirts dont have the SAINTS logo. They have a fleur-de-lis, which is the city’s logo, and Who Dat, which was created by the fans. Its a real reach for the NFL to say because the colors black/gold/white are used in conjunction with this, that they own it.
    @DocBG, you’re just an idiot and I probably shouldn’t even respond to you. To start, the city is at 85% of pre-Katrina population, the unemployment rate is one of the lowest in the country (did I hear 12.4 % California?), and there has been no free ride. If anything the govt still OWES us for what THEY destroyed and refused to pay for. I lost $500K in business and personal assets, DIRECTLY due to federal Levee failures, and I didn’t get a penny from the govt. This city has rebuilt itself IN SPITE of the government. Its been due to volunteers and the locals ONLY. As for crime, it happens only in the ghetto, sorta like EVERYWHERE else in the country.

    Well, they should start trying.
    First, the Saints have no trademark rights in the colors black and gold. In order to trademark colors, they need to have some secondary meaning. The Saints are hot, but when people around the Country see black and gold, I don’t think the Saints are the first thing comes to mind.
    Second, the I’m struggling to believe that they have any proprietary interest–either trademark or copyright- in the a common phrase such “who dat”?
    Thirdly, trademarks are all about preventing a “likelihood of confusion” and promoting economic efficiency. The selling of cheap black/gold Who Dat t-shirts violates neither of those premises. It’s interesting that the NFL talks of free-ridingm ), but surely it will have no problem free riding on the surge in popularity that the cheap shirts will give to the game, the team, and the league.

    The NFL thinks of it as a business. And as a business they will defend their assets. Just we would if we ran the business.
    Remove the Saints logo and trademarks and there will be no problem. Don’t and you violate copyright laws.

    Freaking ridiculous. I made an Ickey Woods T-Shirt in 1988 with puffy paint and orange and black markers. It had Bengals stripes on it as well as the team name and Ickey’s number and last name. Should I be worried about being sued by an overly litigious, fat, greedy, corrupt organization? Is there a statute of limitations on such things? Now that I think about it, should I be worried about Ickey trying to sue me? Since he’s been such a success off the field?

    Not an issue of copyright but of trademark. And I doubt the Saints have trademarked the phrase. These small businesses should band together and try to approach as a class action. As long as they’re not using the Saints’ logo, the league can’t stop them from using “Who Dat?”
    Fans wanting to create a custom “Who Dat?” shirt for their own use can do it at some online vendors that sell in single quantities. I often make custom Steeler gear because it’s the only way to get shirts in the right sizes for the kids. Because the NFL cracked down, they won’t print anything with an official team logo or player photo but anything else is okay. Of course, I still buy logo stuff from the team, but I like having unique shirts, mugs, etc., too.

    The judges are pretty much in bed with big business in general, and the NFL specifically, so if you make a shirt like that even if it doesn’t violate the trademark law, the judges will say it does, that’s why everyone loses when they go against the league, it not that the NFL always in the right, they’re just ruled to be in the right.

    The phrase “who dat” has been around the New Orleans area for way longer than the Saints have been around (1967) and semi-officially was adopted by the team in 1983, even though fans had been using the phrase way before 1980. Think about it, who is more likely to talk like that, people from Cincinnati or people from New Orleans, really? I am originally from the area and it’s kind of embarrassing what comes out of the mouths of some of the locals…..

    This is a prime example of the league overstepping their bounds and banking on the army of lawyers they have on the payroll scaring the dickens out of the mom and pops before anything ever makes it to litigation. If the shirts simply say “Who Dat” and have a fleur di lis on them, then the NFL has no stake in what’s going on. As it’s been mentioned above by other readers, they have no trademark on the colors or the ancient symbol that sits on the helmet. If they want to claim proprietary property here, they should have picked a unique logo.
    This is also a prime example of why we need a league like the UFL to compete with the NFL. If you’re the only kid on the block that has the popsicles, you get to set the prices and decide who gets to eat your popsicles. Add another popsicle vendor and the competition will eliminate bull$h!t like this from happening.
    Too bad the UFL sucks and won’t make it…

    New Orleans wasn’t destroyed by looting, it was destroyed by flooding when the levees gave way. And plenty of federal money went to clean up the Mississippi Gulf Coast, too.
    Just as it’s gone to clean up flooding in the Midwest.
    And mudslides and fires in California.
    And hurricane damage in Florida.
    And earthquake damage in California.

    I will never forget seeing the owner of the Cowboys, Jerry Jones on an TV show. He stated that when they brought in a check for his signiture made out to the Raiders he asked what is this for. I forget how many million it was for.
    All the other owners in the NFL had the same honor of writing million dollar checks to Al Davis as well. So you are wrong and some do beat the NFL and beat them bad lol.

A part of me would love to be a lawyer for the NFL one day, in which case, exercising this kind of intimidation and control over marketing rights would be a major power trip. On the other hand, I hate that “the man” can screw over the little guy so easily on such an innocuous activity. The NFL has rights to the term “Who dat?” Come on. Laughable. But still, you gotta respect them as an organization. They have their sh*t together, and they provide a GREAT product.

So spare me the we owe you crap. Because when you say govt you are saying people of the US, ( that is where they the govt get there money from us tax paying people )
    Perhaps the city’s money that could have been used to help its citizens were in your congressman’s freezer, what was his name uh uh Congressman Jefferson.

    Second: “Who Dat” is not only older then the Saints, it is older then the NFL. It has been around since the 19th century and was re-popularized in the 1920’s and 30’s by jazz musicians.
    Third: If you needed to give the U.S. an enima, you would put it in Indiana. You can crack on “Who dat” as soon as you explain what the hell a hoosier is.
    And finally: I am waiting to see if the NFL sends a cease and desist order to the Catholic Church.

    the fleur de lis on saints helmets was a symbol of the french monarchy. only in louisiana, louisville and quebec and other places in north america was it NOT rejected and replaced after the french revolution which happened to bypass all these french colonies in north america.
    so as for that fleur de lis on saints helmets, if king louis and marie antoinette had not lost their heads they’d be suing the nfl today for using the bourbon emblem of their family without paying “royalties”.

    I lived through Katrina and spent many a day and night not only cleaning up my own neighborhood, but I spent more time in New Orleans through my job cleaning up the mess that New Orleans residents made. I KNOW what I’M talking about. Sure there was flooding in a certain portion of the city and I feel for people who actually went through and lost family members, and you can sure as hell blame your leadership for that. No true evac orders, Governor refusing the help of the federal government then making it look like Bush didn’t want to help them. Not to mention, that they knew the levees weren’t strong enough for the last 30 years, but did nothing to make them better. The rest of the city however? Looting and self destruction. I was directly involved in the renovation of 4 malls. People even broke into a hair salon and stole all of the damned weave!!! Groceries stores I worked in were fully intact with food, but stores Foot locker, The Gap, Banana Replublic, and Old Navy were cleaned out. I was here through the whole mess. New Orleans got nationwide press over and over again and all we heard about was how the big bad government was doing nothing to help them, meanwhile people in southern mississippi went to work helping out their fellow neighbors. Churches got together and put aside doctrinal differences and we did what we had to take care of one another. I didn’t see that happening in New Orleans, nope, victimization and me, me, me, Bush is the devil was all I saw and heard. Like I said before, I feel for anyone in New Orleans who actually had some real loss, but blame YOUR leadership that you continually re-elected for it.

    I am not complaining about the money being spent/misappropriated there. I am just sick and tired of hearing about God damned Katrina everytime there is an article about the Saints. yes they have given their city a rally point and good for them. they should be applauded for it. but good God, I remember when Charley came through Fla. it devastated everything here. after the strom for about a year or so people paid attention but after that we rebuilt and carried on as we should have. its time New Orleans stops crying about it and gets back to living life. yes its sad it happened but in ten years are we still going to be talking about this? its scientific fact that that city sinks further into the earth every year and sooner or later it was bound to happen. it will happen again and anyone who is dumb enough to stay there and watch it happen all over again I will not feel sorry for. that makes as much sense as the people who live in tornado alley buying new trailers everytime theirs get blown away by a twister. stupid is as stupid does. sooner or later you have to learn from your mistakes.
