Michael Irvin accused of rape

Former Cowboys receiver Michael Irvin is back in Florida this week as part of the pre-Super Bowl festivities.  He’s broadcasting his ESPN Radio Dallas show from the Media Center in Fort Lauderdale, and like many of the former players milling about Radio Row he looks like he could still suit up and go right now.

But any sense of celebration has been tempered by the news that a civil suit alleging sexual assault has been filed against Irvin.  According to the Miami Herald, Irvin allegedly raped a woman at the Seminole Hard Rock Hotel & Casino. 

A decision on whether criminal charges will be pursued is pending.

The alleged incident occurred in July 2007, a month before he gave a stirring speech upon entry into the Pro Football Hall of Fame. 

Irvin, through his lawyer, denies the allegations, calling them “totally untrue.”

The action comes after negotiations on a financial settlement stalled.  The woman reportedly wanted $1 million, then dropped her demand to $800,000.  

“This complaint is tantamount to criminal extortion,” attorney Larry Friedman told the Herald.  “There is no merit to the complaint.”

Though it’s rare for anyone to admit to engaging in criminal conduct, Irvin is entitled to the presumption of innocence in a court of law.

In the court of public opinion, Irvin’s history might work against him.  But he seems to have changed his ways, so he merits in our view the benefit of the doubt.

    Actually, if we were going with Irvin’s history, we would say he’s been accused of such things before, along w/ Erik Williams, but was vindicated when it was determined the female was lying. As Irvin said “report that with the same intensity that you did the accusation” of course it won’t happen that way but it should…I for one, don’t believe it to be true…sounds like a another moment in gold digger history

    Sorry Florio, with Irvin’s past……i can’t give him any benefit. If this happened back in 2007 and if “negotiations on a financial settlement have stalled”, it tells me that these negotiations have been going on “for a while”. IF there isn’t fire where there is smoke in this case, why the hell would you spend 2 yrs negotiating a settlement??? Especially with Irvin’s past, it’s not like he has this squeaky clean image to maintain. He is no stranger to drug and sex allegations so his image is no more damaged than what he had already caused it to be.

    Michael Irvin is a scumbag. He was part of the Dallas Cowboys “White House” back in the day. Talk about sex, drugs, and alcohol at that place. Then he got busted for cocaine. Now accused of rape. He’s one hell of a great guy. Should not be in the Hall of Fame. I personally can’t stand him. At his Hall of fame speech he said he was a bad son, father, husband.     Irvin wouldn’t be the first to try to negotiate a settlement out of false accusations. Multiple celebrities or figureheads have done it to avoid damage to their reputation. Even if they are false, it follows you the rest of your life. Sometimes it’s easier to just pay them off and let it go.

I know this guy is was a crack fiend and a complete douche but that is a far cry from rape and we do have to assume he didn’t do it until he is convicted (by the way Mike, saying that he has the presumption of innocence is not the same as presuming he is innocent).

    As with the Roethlisberger case (and we all know how embarrassing that’s gotten for the plaintiff), any woman pursuing civil charges as opposed to criminal charges in a sexual assault case is seriously putting their credibility on the line. When I see a 2 and a half year gap between the actual incident and the accusations aimed solely on monetary gain, I’m just inclined to say, “next, we don’t believe you.”

    I think I read once that Wilt Chamberlain went through a phase where he asked every chick to pose semi-nude, smiling before he did her. He was afraid of a rape accusation with racial undertones.
    Sounds to me like all pro athletes should adopt the same rule.
    There are great reasons to negotiate. Suppose you will easily spend 500 hours of lawyer time @ $300/hr = $150k. That number is if it gets thrown out. You could easily spend 5 times that amount if it goes to trial.
    You wouldn’t negotiate? I would.

    Let’s see, her story is that Irvin got her drunk, lured her to his hotel room, presumably to watch SportsCenter or toast marshmallows in the fireplace or whatever, then when she got there, Irvin and another man started stuffing her clothes with money and demanding sexual favors. The other guy held her down while Irvin raped her, then demanded that she perform oral sex on him. THEN, Derrick, Irvin’s brother, took the woman into another room and did what, I dunno, she says that he “assisted in covering the sexual assault and rape up,” according to the lawsuit. Sounds like an elaborate, nefarious and preconceived plan to deprive this young lady of her virginity, does it not?
    Then the next day she signs a waiver of prosecution because “she wanted to put it behind her and not have it be splashed all over the newspapers.”
    What? “Jane Doe” signed a waiver of prosecution so that it wouldn’t be splashed all over the newspapers? Did I read that right? How about not telling anybody that it happened, if that’s what you really want. By the time you get around to signing a waiver like that you’ve already let a lot of people in on the secret. That won’t keep it out of the news. In fact I believe it would be a part of the public record and you can bet your ass that the name “Michael Irvin” would throw up a lot of red flags, particularly in Miami.

    2007 and criminal charges are being mulled? I don’t think so. You file charges then agree to drop them when you get the check — IF something really happened. You don’t ask for money, when the check doesn’t arrive, file suit and then threaten criminal chargers.

    Plus the fact that the alleged incident happened 2.5 years ago. Such a long space between the alleged incident and an accusation gives me reason to suspect another gold digger failed at her attempts at extortion and is now seeking another way..

    How pathetic is our world? This quote is something we would worry about as a whole. I can tell you what…… If that is my daughter I am not going after Irvin with a gun or a knife. I am going after him through the law and hiring my best prosecution attorney’s I can. Then if that doesn’t work, well I might just go with what Ving Rhames said in Pulp Fiction, and I might go after him with a couple of pipe hittin mother f-ers. I can guarantee you that.     It amazes me that with barely any of the facts known in the Roethlisberger rape case, Florio BEGGED people not to jump to conclusions when judging his guilt or innocence.
    But even with a 2 and a half year gap between incident and reporting that screams ‘I am looking for a payday!!’, Florio finds that Irvin only ‘merits a benefit of the doubt’.

    1. Costs of litigation may be much greater than costs of settlement
    2. Settlement = non-disclosure agreement = no damage to public reputation from false accusation
    3. Juries are unpredictable; may return a guilty verdict even if you’re innocent
    4. In rape cases, physical evidence may favor the plaintiff even if sex was consensual
    So yeah, attempts to negotiate a settlement don’t always mean much.

    I hate piling on, but here is a story that happened to us in Dallas. We were hanging out for a friends bachelor party. We met a group of girls at the hotel bar while waiting for a couple stragglers to get ready and they followed us over to the ghost bar. We get in the elevator after paying the $20 cover to get in, and guess who gets in the elevator with us, Micheal Irvin.
    The bachelor says “holy $hit, your micheal irvin,” he replies yea and moves closer to his corner of the elevator and closer to his security guard he has with him. My friend then says ” I saw you on that pros vs Joe show and i love when you punked that guy” We suddenly are now Micheals’s best friends and he gives the bachelor one of thos chest bump/man hugs. We ask for a picture with him and he says “naw, i’m not supposed to be here tonight”
    After this we hang out with him for a bit at ghost bar, and then him, his security guard and one of the girls that was following us around disappear in to the VIP room. Her friends freak out and after about 45 minutes she returns, and brags to her friends about hooking up with micheal irvin. It was completely consensual in this case, but all it would have took was for her to scream rape, and she could have been extorting him, just like this girls.
    You go around to random bars/hotels and sleep with random girls because you used to be a star and eventually one will get money hungry……

    Everyone saying it happened 3 YEARS AGO doesnt understand how these things work. Lawsuits take anywhere from 2 to 6 years. This has probably been going on sense right after the incident happened.
    It takes monthes just to get all the evidence, paperwork, and the lawyers and platiniffs schedule in order before the law suit is even filed. Then you have to wait for the devendants to get a lawyer and all their papers in order. Then you have to set dates for mediation. It could take years before you even start to talk about settlements. Then you have understand how long settlement talks can take.
    It said settlement talks stalled. That means time after time of setting up schedules and meetings they could come to an agreement. All this could easily take up to 3 years to happen.
    So anyone who thinks this girl all the sudden brought this up after 3 years is wrong. Dont automatically asume he did nothing wrong or its ok now b/c i happened years ago.
    All it means is Michael Irvins lawyers were extremely worried about this getting out and did a good job hiding it. IMO trying so hard to hide something makes you more likely to be guilty.

    Maybe her lawyers knew that the evidence they had wouldnt be allowed in a criminal case but would be allowed in a civil case.
    Maybe you thought this is a better way to get back at him.
    Maybe she thought him going to jail wouldnt make it any better for her.
    Maybe she’d rather have money then see him in jail.
    What ever her reasoning is doesnt make a difference. The only thing that matters is if she was or wasnt raped. Pressing charges wouldnt make a false rape accusation true and not pressing charges doesnt make a woman who was actually raped accusations false.
    I dunno if Irvin raped this woman or not. I just know that most of the reason everyone has given as to why they think it is or isnt true is totally unfounded.

    The responsible position for journalists would be to wait for the local DA to file charges, if they do that, then there is merit. If the DA doesn’t file charges, then Irvin’s reputation (or what’s left of it) doesn’t take (another) hit.

    Why engage in negotiations if he didn’t do it? Mud sticks. If Irvin had consensual sex with her there may well be a lot of people who saw them together. While she may not be able to prove rape, he wouldn’t be able to prove his innocence either. The unproven allegations alone would be enough to cost him a lot of money.
    Why engage in negotiations if he is innocent, because in the long run it might be cheaper just to pay women off.
    I am not saying he did or didn’t do it. There is precisely no evidence either way. However, there are plenty of reasons for entering negotiations (if indeed the report is accurate).
    If you are as rich as Irvin, spending a hundreds of thousands of dollars to avoid the hassle of dealing with a false accusation of rape probably seems like a bargain.

    Just saw the Sportscenter coverage on this…I love it when they change the headshot of an athlete to one that looks “meaner”, where he’s frowning intensely. Same thing with Tiger. I love the media.
    Besides, it’s Michael Irvin for God’s Sakes! Just show one of a million clips where his eyes are lidded and he looks completely cracked out. It’s happened every week since September!

    Now for all of you who want to say he is guilty because of some kind of negotiations. It never said he had negotiations with her. It said she ask for a million and then drop it to 800,000. As far as anybody knows, he could have said hell no each time because I did not rape you.
    The very fact that so many of you want to beleive he raped because of his past could be the very reason she choose Michael because it would be a lot easier to convince people. This is so crazy.

If you have some sort of flag to carry that isn’t fully about football then you should probably be flying your flag someplace else.
