    Guilty or not, he still has the constitutionally-protected right to not say anything. Exercising that right is almost always a good idea. It shouldn’t influence anybody’s opinion as to his guilt or innocence.

    Really, this is the 3rd or 4th Roethlisberger update today alone. And they’re not even news stories, they’re just rehashing the facts and rumors and giving haters a chance to whip out their “Rapistburger” and “Ruthlessberger” nicknames that it took them months to come up with.
    Think of all of the real news around the league that’s being overlooked or missed because Florio is too busy watching his email for updates from Google Reader for the keywords “Roethlisberger Sexual Assault”.
    Maybe we need another sellout plug for Sprint instead of these updates.

    The reason for not talking makes sence to me. when read your rights, according to t.v, goes as follows. “you have the right to remain silent. Anything you say can and will be used agaisnt you in the court of law.” If you see the second sentence it does not say, anything you say will help you in court. so silence is the best approach.

    The GBI investigator keeps saying Roethlisberger’s people are fully cooperating, so he doesn’t seem concerned. Garland will arrange an interview when and if he feels it’s appropriate. Richard Jewell gave investigators everything they wanted and the public still crucified the poor schmuck, only to later make him the poster boy for railroaded innocents. Who cares what a fickle public thinks?

    A woman in Nevada had a one-niter with Roethlisberger. A year later, she hired an attorney, said it was rape, and sued him and the casino for $3 mill. She never called police and there’s NO evidence of rape. Her friends said she bragged about the sex and said she hoped she was pregnant. She was texting her boyfriend about having fun hanging out with Ben AFTER the supposed rape. Does that sound like a rape victim to you?
    A woman in Georgia met Ben out clubbing and spent the evening with him. Then she told police he “sexually manipulated” her. The police said it was not rape.
    So he may have “sexually manipulated” one woman. There’s no evidence he “rapes women.”
    Michael Vick confessed to brutally slaughtering animals. It’s not worse than hurting people. But it’s still a CRIME and he CONFESSED. Were the authorities supposed to ignore it? He did his time and it’s over. The two cases don’t compare. Let it go.

    I couldn’t agree with you more . . . nobody – guilty or innocent should volunteer any information to the police. Unfortunately to many times the police have pre-conceived opinions of guilt or innocense and this leads them to intentionally or unintentionally persue the evidence that leads them to their beliefs and ignore the evidence that doesn’t.
    I teach all of my children that if the police stop you under suspicion of something you are to say the following “I am officially exercising my right to remain silent, please end this interview and get me a lawyer.” A bunch of people are probably going to jump all over this post, but during the initial interview a person, especially a young person, is nervous (guilty or not) and prone to give a jumbled description of any activities that are probed. Given that, a person is only going to hurt themselves if they have inaccurate or inconsistent recall due to nerves or perception . . . you can always give a full description of events at a later date . . . after consulting with an attorney . . . you can never take back any statements once made to the police.

    Ben has nothing to gain by talking to the police. In my opinion, the Court of Public Opinion is already against him because this is the second time in a year he has been accused of rape. Proudly proclaiming his innocence and/or defaming his accuser probably won’t sit well with the public the second time around.

    I love both your posts because they’re perfect examples of the wide expanse between intellects on PFT.
    jlbay understands the system, Constitutional protections, the tendency of even well-meaning cops to make bad judgments and stick to them, and the tendency of even innocent people to say very stupid things under duress. If jlbay’s children are ever questioned in difficult circumstances, they’ve been taught exactly the right thing to do.
    Krow is an idiot with the IQ of a palm frond who would end up sitting in a cell wondering how he could have been wrongfully convicted after being so helpful to the cops. After all he’s just an average guy and only guilty rich people need to lawyer up.

    No charges to this point really don’t mean much of anything as far as the probability of him eventually being charged is concerned. Well, other than the fact that he isn’t cooperating. Most of the time when there are quick charges against a criminal, it happens because the criminal admits what he did.
    However, the likeliest result of this other than what Florio mentioned in his Sporting News article is that BR is exhausting whatever supply of good will the Milledgeville police force had for him… IF and it’s a big if… they actually believe he did it.
    That means that if and when the charges actually come, he will pay for his lack of initial cooperation in a variety of annoying and generally unseen ways, poorer food during incarceration, breaks taken at inconvenient times for him instead of when he wants to go out, less ‘buddy’treatment from the cops, etc.
    It’s generally not a good idea to hark off the cops who are investigating your case. Doing so generally has very little to do with whether or not you are eventually convicted, but it does tend to make your time in their custody a lot less pleasant when and if it comes.
    The only real thing to be taken from the news of the day is that them wanting to interview the Nevada accuser means that they are still investigating. So until they announce the case is dropped or they announce that they intend to arrest him, everything else is speculation.

    That’s true, people in this country are regularly persecuted by various government agencies for defending their rights as Americans. Do yourself a favor and research the case of Jeffrey Scott Hornoff, a Rhode Island POLICE OFFICER who thought he could trust fellow officers when he fell under suspicion for a crime he didn’t commit.
    Whatever the cost, in terms of bad food or inconvenient breaks, which are actually rather tame examples of what could actually happen to you, never let cops trample your rights. Others have sacrificed much more.

    Whether or not Ben Roethlisberger is guilty remains to be seen. In the end we may never know. Whether or not he cooperates with authorities is his affair.
    What bothers me is that this man keeps putting himself in these types of situations. Eventually his luck will run out, and he will be doing hard time in one this country’s fine and wonderful prison facilities.
    Big Ben needs to realize that these are very unwelcome distractions to his team as they prepare for the 2010 season.

    Don’t take anything from no charges yet being filed:
    1. As you assume, they may be having difficulty compiling evidence to charge.
    2. GBI investigator Davis said they have a heavy case load. So perhaps the investigation is just moving slowly.
    3. Perhaps, they’re getting their ducks in a row because of the high-profile nature of the case.
    They are under no obligation to quickly file charges. This may drag out for a while.
    @suvantar … You’re jumping to conclusions, my friend. Investigators just reiterated that Roethlisberger and his attorneys are fully cooperating. They don’t sound even mildly annoyed, let alone ticked off. They know how this works.
    My bro just gave me a couple of scenarios on why they might want to talk to Nevada–not necessarily negative for Roethlisberger. So like you say, the only thing to conclude from that is they’re still investigating.

    He’s got himself a page-hit goldmine with all the haters chiming in with their guilty verdicts.
    They really don’t have a clue, but they’re definitely rooting for him to be guilty, which speaks volumes about them.
    It’s all pretty amusing actually considering the guy hasn’t even been charged with a crime yet, much less arrested, and the longer it goes the less likely it becomes that he will be.
    Face it folks, if any actual evidence existed BR would be in jail. Right now.

    Ben has never been interviewed by the national media regarding the first accusation. McNulty filed a civil suit and Ben stepped to the podium and read a statement saying it was untrue. He did not take questions then and has refused to answer questions since regarding McNulty’s complaint.
    He still hasn’t been told exactly what the woman in Georgia is alleging, but has proclaimed innocence of any criminal wrongdoing through his agent and his attorney.
    The only difference between the two cases is that with the first he read his own statement of innocence and with the second, his attorney and agent read the statements of innocence. No accused in a criminal proceeding should speak to the press under any circumstances. Anything he says could be used against him whether he is guilty or innocent.
