SportingNews.com: Roethlisberger decision hints at possible settlement

We’ve danced around the subject a few times, and we’ve decided to take it by the horns.

The manner in which the Ben Roethlisberger case in Georgia resolved invites speculation that he confidentially reached a settlement with the alleged victim, and that she agreed to request that the charges be dropped.

    @Florio – you should note though, when asked, prosecutor Bright said that even if she had not dropped her request for charges, that he felt he could not put together a case. He repeatedly stated that she was extremely drunk, and that she could not recall information or be relied upon for info. Her state of intoxication appears to be the biggest problem, along with an almost complete lack of DNA, and no DNA that could be matched.

    The prosecutor’s mantra is the same as a doctor’s. “Above all do no harm”. Or is shoucl be. Bright clearly took that to heart.
    If the girl and/or her advisors felt there was the possibility of additional harm to her person, her privacy, her character, or her lifestyle in proceeding with the case, then the responsible thing to do is not proceed. Bright made the best of what he had left by stringing out his decision for as long as possible to let Roethlisberger dangle in purgatory, before finally pronouncing him guilty without filing a charge.
    I thought it was masterful. The girl is off the hook (substantially) by virtue of her letter, Roethlisberger spends the rest of his time trying to reacquire lost respect, the electorate of Oogamooga County or whatever the hell it’s called spend 0 dollars on trying the perp.

    As a lawyer who handles civil cases…and has had several such cases related to the commission of a crime…I fully agree that this reeks of a settlement. Why? Let me add something that Florio did not: If I’m representing a crime victim, I want the criminal prosecution to play out. It happens much more quickly. The State handles the investigation with far more investigative powers than I can bring to bear, and if the defendant is convicted, my case is won.
    Why would I lose out on all those benefits to my prospective case? I wouldn’t…unless the case is already settled.
    It’s always possible that this young woman and her parents simply decided they wanted no involvement with any of this…that she had a multi-multi millionaire on the hook & just decided she wasn’t interested. It’s definitely possible…but that would make these folks unlike anyone I’ve ever known in my almost 20 years of practice. Even the most die hard conservative Republican anti-lawyer types change their tune when they are the ones who feel victimized, smell blood in the water & money in their bank accounts!
    Unless a civil suit follows…which seems highly unlikely given the lack of cooperation with the prosecution…I’m personally convinced that Ben bought her off.

(Go to Scout.com, Steeler page) During the Q and A session he said he meet with the girl and her family and felt money wasn’t on their minds. He feels that they are a “good family” and just want their privacy and to put this behind them. Clearly the girl’s behavior bears scrutiny too. Is she totally without culpability here? Did she put herself in a bad situation? Could she have exercised better judgement? Ask yourself Florio, is it possible that Ben did nothing wrong? Of course there is. In this country you are innocent til proven guilty. If you weren’t such small potatoes you should worry about slander and defamation of character.

    Except that those facts, in any state not in the Bible Belt (even though it’s still on the books) would be slam dunk evidence of rape by intoxication (and the DNA is inconsequential since he admitted contact).
    Someone intoxicated can’t legally give consent, even if they initiate sexual contact (this also applies to contracts).
    If it had been just about any other state, he’d be facing up to 8 years….you know, if he wasn’t famous. Obviously.
    If you’re curious why this law exists, just look to your defense….she couldn’t remember the details so was unreliable….which would mean you can get away with raping the hell out of anyone you come across who is drunk or passed out….as long as you’re done before they can remember it.

    Earlier when it came out the girl was not going to go on and than a week later they came back out and said that information was wrong. Was a time when Big Ben did not like the amount of dollars it was going to cost him. The girl jumped right back in to help the DA.
    Someone talked the punk into paying up explaining to him if charged he was done. The clear tail sign as to if the girl has been paid off is if no Civil case is brought by the girl. If that should be the case it will say all one needs to know.

    It also hints at that no crime was committed. But that would be too convenient for Florio to mention.
    Let’s not forget that the accuser could have won a settlement in a civil case, whether charges were laid or not. And requesting some form of settlement by either party would have damaged either case. If Big Ben pursued a settlement that could be perceived as evidence he was guilty and trying to make this go away. If the accused pursued a settlement, Big Ben’s lawyers would have jumped on that as proof she was only in it for the money, similar to the Nevada case.
    So what does this all really suggest? How about an entirely plausible scenario such as “girl gets drunk fawning over NFL superstar, allows herself to get fondled up, maybe a bit too aggressively, and then starts regretting it the moment the tequila starts wearing off”.
    I agree Big Ben is likely a scumbag, the growing evidence certainly points to that. He’s always come off as a prima donna with an over-sized sense of himself. But the last time I checked that wasn’t a crime and would describe half the planet.

    But to prove rape, you still have to prove penetration. If you listened to the press conference, the DA said he had to prove three things to prove rape:
    1. penetration
    2. that he did it
    3. that it was not consensual
    He said he couldn’t prove ANY of the three.
    And speaking as a rape survivor now: Women are responsible for their bodies. If you choose to drink yourself into oblivion, you are responsible for the consequences of that choice. Women who drink themselves blotto and climb all over a man or let him climb all over them, then call it rape because they were too drunk to consent have no idea what rape is.

    There is no evidence that this woman has settled with Ben. Zip. If I were going to settle with an accuser, I’d want her to recant the accusation–to at least say she couldn’t be sure of events. She didn’t do that. She reiterated the accusation but said she didn’t want to go through the trauma of a public trial. If he paid her off, he didn’t get a good bargain. The DA said she didn’t come across as a gold digger, that she and her family seemed sincere. To me, articles like this one slander her more than Roethlisberger.

    Florio. I’m actually on your side throughout all of this, and all of you readers should keep one thing in mind.
    95% of you don’t know the terrible details of what happened. The entourage blocking off the backroom…the tapes mysteriously being taped over just under 24 hours after the incident (yeah, more like bought)…I mean, did you see the investigation of the defendant’s body alone? There were details I’d spare a message board that could have children in it. Something brutal happened.
    If Ben were accused of rape once, and he’s at home thinking “whew, I’m lucky to have that behind me. I was wrongfully accused but now I got out of it. How to celebrate? I know! I’ll get a 20 year old drunk at a bar and doink her!” Honestly? He was already accused of RAPE!!! No one innocent of rape goes right back out to put themselves in that situation!     I live in the South. I’m very aware of how things work.
    1) You don’t need penetration for sexual assault
    2) He admitted to having contact
    3) She was drunk which negates her ability to consent, ergo it was not consensual.

    As I mentioned before, this law also applies to contract. I.e. if we get drunk and I sell you my house for $10, it can be voided because of my state even if I initiate it.
    While I agree that women (and everyone) are responsible for their bodies and their own safety, that doesn’t mean if they choose to compromise their safety, it gives anyone who comes along the right to do whatever they want.
    If you get drunk and pass out at a party, and someone steals your wallet, is it your fault? Partially. Is it still a crime? Yup.

She said she didn’t know. He sent her to the hospital. They could not find evidence that she’d had intercourse.
    All that is in the press conference. Try listening to it.
    Later, after she’d sobered up, she went to the police station and said they’d had sex but she told him no.
    He said he hoped she’d learned a lesson. He said she and her sorority sisters were drinking too much. He said there was plenty of blame to go around and he hoped they all learned something.
    Prosecutors who think rapists are getting away do not tell the “rapists” to grow up but you’re welcome back here anytime as long as you keep your nose clean–which is what this guy said about Ben. He clearly thinks Ben is an ASS. And I agree. But he also thinks she screwed up.
    Now why don’t you grow up and get your facts straight. Both these people engaged in some unsavory behavior. But calling it rape is a slap in the face to women who really have been raped and don’t have to think twice to be sure of it.

The attorney carefully worded the letter to the DA, so the DA can not come back and file charges against her for making a false report.

    One of the problems here is that ESPN and the NFL Network in their infinite irresponsibility cut off the press conference after the first 16 minutes. It lasted 71 minutes. If you’d listened to the ENTIRE press conference, you’d have heard some enlightening information regarding your points:
    1) You don’t need penetration for sexual assault
    No, but you do need penetration for rape. The DA said clearly that the allegation was rape. They were investigating rape, not sexual assault, not sexual battery, not anything else. He repeated that several times.
    2) He admitted to having contact
    NO, he DID NOT admit to having ANY sexual contact with the girl. The DA stressed this point, saying the press reports were in ERROR.
    3) She was drunk which negates her ability to consent, ergo it was not consensual.
    Yes, legally speaking. But since he didn’t admit to having any sexual contact, the point is moot.
    The DA went on to say that they were engaged in highly sexualized conduct and conversation. That when first asked if she was raped, she said NO. When first asked if they’d had sex, she said she wasn’t sure. The rape kit found no evidence that she’d had sex.
    I still maintain that if a woman willingly gets drunk, willingly becomes engaged in highly sexualized behavior with a man, and willingly begins making out with him THEN decides later she regrets it, that is not rape in the true sense of the word. I know the law disagrees.
    Ben is a scuzzy guy. I’m not defending his behavior. The DA’s last line: I prosecute crime, not sin.
    Sorry I called you a prick. Try not to use that language. I get very heated when people unjustly insult the South. Living here and being a Southerner are two different things. I have a friend who is one of Bright’s ADAs. He’s an amazing, intelligent, ethical, cool person. This has been handled much more responsibly than the debacle that was the Simpson trial in oh-so-cosmopolitan L.A.

He didn’t know Ben went back there. According to the woman’s statement to police, the incident with Ben began in the hallway–so she must have been on her way back–then they went into the bathroom.
    One of the woman’s sorority sisters had been ejected from the VIP room by Ben, though no one is sure why. The sorority sisters were also very drunk. The bodyguard was stationed outside the VIP room. The sorority sister says she told him her friend was too drunk to be back there, but he didn’t respond. The club owner said a couple of sorority girls told him their friend was too drunk to be back there, and he showed them another way around where they could go and check on her. But he said they didn’t go.
    That’s the story the DA told later in the press conference. He also said that after interviewing everyone who was in the club, the woman was only in the bathroom for approximately 10 minutes.

    I’m just going by what the DA said. No, I do not believe the hospital skewed the results of a rape kit because Roethlisberger was involved. When first asked, the girl said she was not raped and then said she wasn’t sure she’d had sex. There was trace bleeding, which could have been caused by other activity.
    I’m not condoning Roethlisberger’s behavior. I think he’s an ass. And I think it’s wrong to keep saying this woman was paid off with no proof to support that. I agree with the DA–a lot of drinking and a lot of things got out of hand with plenty of blame to go around.

    People should realize that it can also be considered rape when a person is too drunk to consent to sex and the DA mentioned several times that this girl was highly intoxicated. So what Ben did still doesn’t make it right. Stop trying to come up with all types of excuses for the creep.
