The key is there has to be evidence. The only evidence they could have had is the rape kit. And clearly there wasn&#039;t enough there to prove it.

Totally agree with everything you said. How easy was that? :-)
For me this has been about issues of innocence until guilt is proved, trial by media, unpopular behavior vs. criminal behavior (for instance, the public deciding the Ramseys were child killers because they put their daughter in pageants). And I have a problem with the belief that if two consenting adults get drunk and have sex, the woman can later claim she couldn&#039;t consent because she was intoxicated. (Your 1976 episode doesn&#039;t fit that category. If she&#039;s unconscious and two strangers assault her, it is rape.)
None of those issues absolve Ben of responsibility for his behavior or choices. I&#039;m opposed to league suspension because it sets a precedent of suspending players who haven&#039;t failed a drug test, been arrested, or committed egregious disciplinary violations. But the team should take strong action. Whether he&#039;ll get it, I don&#039;t know.
Can they make him clean toilets at the stadium?]]></description>

What was he like as a kid in elementary school or junior high or high school?  Did he barely squeak by?  What was his grades in college and what type of classes did he take? How many players have gone from rags to riches and couldn&#039;t really handle the money well and blew a lot of it?
Look at Chris Henry. He got into a lot of trouble.  Then he decided to grow up and stay out of trouble. Then he found himself dead.

1. Ben was buying drinks for the girl ... because she was not able to buy them herself.
According to the DA, the woman was drinking illegally before she joined Roethlisberger&#039;s group. He was buying drinks for the room. Purchasing drinks for someone underage is a misdemeanor but the mirror charge is underage drinking. They could not charge him without charging her and elected not to charge either. Both were intoxicated.
2. After she was intoxicated over double the legal limit ...
Because of HIPPA laws, her BAC has never been released.
3. Ben&#039;s bodyguard escorted her to the bathroom and Ben followed afterward. HE arranged it through his bodyguard.
A reporter asked the DA to clarify the bodyguard&#039;s role. The DA said she asked a bodyguard the way to the bathroom. He showed her the way and came back. Later, Ben went back there. The bodyguard DID NOT KNOW Ben was there. According to the witnesses, they were only back there 10 minutes.
4. There is nothing that says that she was slobbering all over Ben. He got her so drunk that she could not make proper decisions and then he tried to take advantage of her.
The DA said that, according to witnesses, Ben and the woman were engaged in highly sexualized conversation and conduct all evening. He would not reveal the salacious details. He said there was plenty of blame to go around. He said BOTH had too much to drink, BOTH made mistakes, and he hoped BOTH learned from it.

I think the thing that many people seem to forget is the FAR MORE IMPORTANT thing that he said and that he needs to be smart and not get into those situations. Frankly, I don&#039;t really care about whether they were both drunk or she started dry humping the entire bar, he is a professional athlete that didn&#039;t need to be in that situation because he&#039;s already facing scrutiny from the last one. He doesn&#039;t need to be a monk but he&#039;s an idiot for getting into that situation. SHE is NOT the blame for his stupidity and I don&#039;t care if he raped her or helped her up when she fell down - he should have never put himself into the situation in the first place. He WON&#039;T listen to anyone and unless they make him miss more than a game or tow, he NEVER WILL. Let me tell you something, I was with a friend of mine back in 1976 and we were out partying with some of his friends and I decided that I had enough and I went to sleep. Well, I woke up and my friend was beating the crap out of two of the guys because HE woke up and they were going after it with a girl that had passed out but woke up when they having their &quot;fun.&quot; It was her crying and pleading that woke him up and when he realized what was going on, he gave them what for. Now, they tried REAL hard to claim that it was her fault and she had changed her mind in the middle of all of it but one of the guys who didn&#039;t participate but watched them, told a far different story. The thing about it was, she had gone to the party with several of her friends and after she passed out, they just left her there.
Now, despite the fact that she had several witneesses to it, she didn&#039;t pursue it because of the stigma and because they would have put her through the wringer.
Let me tell you about drunk. My next door neighbor used to say to me that it had been a long time since she had a guy over and I&#039;d have to take her back to the bar that she frequented so that they could tell her that she had left with someone the night before.
Anyway, the fact is that since you and I have been conversing about Ben, I&#039;ve pointed out out his immaturity and that he didn&#039;t seem to learn from the past and that continues to be the case. I honestly don&#039;t care whether he&#039;s guilty or not and you shouldn&#039;t, either. What&#039;s more important is the fact that he&#039;s got $100 riding on his stupidity and a billion dollar franchise that would be set back for years, if they have to start over with a new QB. It&#039;s not just Ben, the franchise really needs to stop coddling him and the others and letting this crap get out of hand. The Bengals did it for years and look at how it kept hurting them. The Rooneys took care of Holmes but I consider that too little, too late.  They&#039;re just as culpable in this because they should have sat Ben down after he refused to listen to them about the motorcycle and show him who the boss was. Deb, in case you&#039;re not aware of the facts that have been published, Ben was buying drinks for the girl in Milledgeville because he was not able to buy them herself.  After she was intoxicated over double the legal limit, Ben&#039;s bodyguard escorted her to the bathroom and Ben followed afterward.  There is nothing that says that she was slobbering all over Ben.  She didn&#039;t slobber all over him and lead him into the bathroom.  HE arranged it through his bodyguard.
It&#039;s Ben that did what he should not have done.  He illegally purchased alcoholic beverages for someone who was underage.  He got her so drunk that she could not make proper decisions and then he tried to take advantage of her.  He stated at the scene to the police that he had sexual contact.  What type of sexual contact hasn&#039;t been described to my knowledge.  This girl was probably paid by Ben so that she would not press it further. But, like many women who have been sexually assaulted, she decided that she did not want to be in a court room describing details about the encounter.
A person who commits sexual assault is a person who likes to commit a violent act against someone.  Do you really think that a football player, a person who experiences violence on a weekly basis, wouldn&#039;t fit the profile of someone who likes to use violence against others?
The attorney in Massachusetts made statements saying that there was a situation that occurred in Las Vegas, in which he was retained to investigate, which was nearly exactly like the situation in Milledgeville.  Attorneys would not put their firm in the position of being liable in a case where statements are publicly made so you can be certain that this attorney is speaking the truth.  In that case, there was no civil or criminal case because the woman decided that she didn&#039;t want to proceed further.  Was she also paid by Ben to keep it quiet?  Probably.  The attorneys wouldn&#039;t work for nothing so they were paid for their time.
A little common sense here, please.  Can you name any other NFL quarterbacks who have had anything even remotely like this happening to them?  Tony Romo? No.  Tom Brady?  No.  Joe Flacco?  No.  Mark Sanchez?  No.  Anyone?  No.   Just Ben and now multiple times.  He&#039;s got a problem and I&#039;m sure that this news has been sitting on Goodell&#039;s desk before he spoke with Ben today.]]></description>
