Lawsuit against Brady, Bundchen dismissed

Last year two photographers sued Patriots quarterback Tom Brady and his wife, supermodel Gisele Bundchen, saying that bodyguards for the couple shot at the photographers while they were trying to snap photos of a Brady-Bundchen wedding celebration in Costa Rica.

Today that lawsuit was dismissed by a New York judge who said Brady and Bundchen don’t live in New York and the lawsuit doesn’t belong in the state.

The photographers, Yuri Cortez and Rolando Aviles, claim the guards shot at them and narrowly missed their heads.

The lawsuit originally was filed in federal court in New York and then was filed in state court.

    Wait, how can you sue someone over something that happened in a foreign country?
    Either way, the only shame here is that the bodyguards missed.

    So if a resident of New York is accused of a crime while they were living in NY and then moves to another state, let’s say, Massachussetts, then the state of NY won’t pursue the allegations.
    What if these two go to Mass court and the couple moves to California. What’s Mass excuse going to be?
    Brady and wife should be happy the state of NY is not mad at them, because if they were, they would definitely pursue the case.

    Where are the photos of the shooting?
    The dearly departed Bob Brown got the shots before he was shot in Jonestown, Gyana.

    @LeeB: If said crime was committed in Costa Rica then NO, NY does not have any responsibility to investigate or prosecure any allegations.

    If it was anyone other than Brady, would Goodell have suspended him for hiring thugs who shot at photographers? If an unloaded gun gets a player suspended, what should the penalty be for hiring security people who shoot at photographers? If Pacman had hired these guys, would he be permanently banished from the NFL?

    the “alleged” ( steeler fan lingo) shooting happened in another country.
    They should have tried to sue in Costa Rica, maybe Giselle could have sent them a bunch of bananas from Brazil as payment which is all their lawsuit was worth.

    The suit was not dismissed
    Goodell had it destroyed, along with the two photographers — lest some other paparazzi were to get ahold of them and gain a “competitive advantage”

    Who was the lawyer that thought it was a good idea to file this case in NY? Any attempt to obtain personal jurisdiction over Brady and Bundchen would most likely be unconstitutional.

That security detail were merely hired agents, not some “posse” comprised of hoods from the hood. Everyone needs to just move on, there’s nothing here that could give the NFL a black guy.

    Huh? You do realize that neither Brady or his wife were being investigated for any crimes…despite LeeB’s hypothetical scenario? The story is simple, really. They were is Costa Rica. While there, they hired some local security to watch over them. These two photographers claim that during that time, two of the guards shot at them. They never claimed that Brady or his wife knew it was going to happen, let alone ordered it. They were suing Brady and Giselle for two reasons: it supposedly happened while they guards were being employed by Tom and Giselle, and Tom and Giselle are the ones with the deep pockets. They have never been accused of any wrong doing. So LeeB, the civil suit (as opposed to the criminal chargers you talked about) was dismissed because the event supposedly occurred in Costa Rica, and Tom and Giselle weren’t living in NY at the time. As such, the NY court had no jurisdiction. Oh, and in case you’re wondering…you can’t avoid criminal charges by moving to a new state. We have this thing called extradition, and all states must extradite suspects to other states (unless they’re in the process of trying them for other crimes). I guess what I’m really saying is: don’t be an idiot. Massive difference between what’s going on and what you’re talking about. Not even an apples and oranges deal. More like an apples and automobiles scenario.
