Restaurant owner: Video shows Vick leaving three minutes before shooting

Michael Vick and his lawyer could have a major timeline problem.

The owner of the restaurant that hosted Vick’s birthday party last week says he has video of Vick and “his entourage” driving away from the restaurant at 2:07 A.M., only three minutes before gunshots were fired in the direction the cars went.

Florio is spending some much deserved time with the family, so I’ll say it: wow.

“I’m not saying that Michael Vick did the shooting,” Allen Fabija told
the Daily Press. “But
he did not leave [long] before” the shooting like Vick told police, according to
Vick’s lawyer.

Vick’s camp has consistently painted a picture of the Eagles quarterback leaving his party well before the shooting.  First, we heard 30 minutes.  Vick’s attorney Larry Woodward told the AP on Tuesday that his client left at least 10 minutes before the shooting and up to 20 minutes before.

Now there is possibly video evidence putting the number at three minutes.

Woodward and Vick better hope the video proves Fabija lied to the newspaper.  Otherwise, Vick’s entire account to police will be called into question.

Seriously, WHO cares? Who? I want one member to come in here and say they care about Michael Vick and are surprised that something like this would involve him again.
The best part of my experience on PFT is NOT reading about these people like Jones, Benson, Roethlisberger, and whoever else causes people to have to cover their pathetic behavior.
I find the Days Without An Arrest meter funny like most people here, but seriously, why not make a conscious effort to cover the positive things players are involved in as well. Wheres the meter for that? Community Service(elected, not forced)? Activism? Foundation news? I mean come on, I am so tired of these types of stories. Its why I dont even go to CFT anymore because its nothing but reports of underage kids drinking and getting arrested for stupidity.
    Change. Seriously.

Vick’s entire account to the police was called into question when he, you know, opened his mouth.
    Dogs? I didn’t ke-e-e-l no stinking dogs!
Shooting? What shooting? Ah, I was long gone when that happened. If it happened. I don’t know, because, ah, I wasn’t there. Because I left right after the shooting started. What? Did I say that? No, I meant I left long before the shooting happened. Because I didn’t want to be there when the shooting happened. Uh? No, sorry, that implied I knew there was going to be a shooting. Ha, ha, ha. Oh my, silly me. No, no, no, I meant I was gone. Period. As in wasted. Crap. No. Not that kind of wasted, like on drugs wasted. Ha, ha, there I go again. Bad Mike, bad mike, I will put you down like a dog Mike. What? INSIDE VOICE! Use your inside voice! Okay, let’s get back on track here. What did I tell you? Uh, huh Oh yeah, right. I left. Before the shooting. Thirty minutes. Unless there is evidence to suggest otherwise, in which case this whole conversation didn’t happen.

The guy who was shot SHOULDNT have been at the party to begin with, that is some gangster mafia type stuff though by vick…ha
in a court of law, a LOT of evidence has to be proven more then 3 minutes to link vick to the shooting without reasonable doubt…
vick will be free, and its up to the commish to lay the law down if he wants or even can…
how do we know vick didnt get tipped off by someone like , so and so is gonna get shot , or was it vick who ordered the hit… or
JUST A COINCIDENCE in that he left 3 mins before and the guy got shot…
    i mean, i’m just saying folks…

To those who think this whoole thing is overblown, I’ll put this in the Ben Roethlisberger “Will-he-ever-learn?” school of thought:
You are suspended for criminal activity; you beg to be allowed back into the NFL; you are presented with a list of conditions and readily agree to abide by them in order to GET back in the league….. you DON’T start hanging out with felons, around weapons, throwing lavish parties for yourself with 300 guests; you stay HOME for a year or two and play Choir Boy.
And you sure as $hit don’t LIE about it!
    Stupid, stupid people.

What this does show is no matter what happened the guy is lying through his teeth..and after his past of being untruthful, ecspecially with the commish i think has to kill his nfl career, crime or no crime.. and very possibly send his ass back to prison.

  25. Mike Vick says: Jun 29, 2010 9:22 PM

There is video footage clearly showing the entourage leaving the crime seen significant period of time before any shooting transpired. It is irresponsible and malicious of the media to insinuate that any incident that transpired thereafter was some how connected to yours truly.
Taking the story to its logical conclusion, what would the reaction be if an isolated shooting incident transpired at an autograph signing? Would yours truly be held accountable? At what point does the gutter press call it quits?

Question for the Geniuses: If you LEAVE someplace, how can you be held accountable for knowing exactly when something happened when it happened AFTER you LEFT??????
Am I missing something? If I left my bank before someone robbed it. Then later I said “I left long before that happened.” If it’s later discovered that the bank was robbed by someone else only a minute after I left – does that mean I robbed the bank???

  32. kliquid says: Jun 29, 2010 9:38 PM

Okay so… Let’s think about this for a second.
If he wasn’t AT the party during the shooting — how would he know when the shooting happened? He probably gave his best guess-timate, like any of us would.
Obviously he didn’t shoot anyone, so I don’t understand why this is even a story.
I love this website, but it’s this kind of journalism that really annoys me.

  33. The Hogster says: Jun 29, 2010 9:39 PM

This website is the only media outlet that is going through such great lengths, and making such broad leaps in logic to connect Vick to something, ANYTHING that could put him out of the league and back in prison.
This is very discomforting. What’s the motive?

  34. Meat Tuperello says: Jun 29, 2010 9:40 PM

    @Hogster.
Ever asked someone to do a favor for you and then left home, or the place where you were at?
If this were some random hump named Leroy, then Vick might have a slim chance of being involved. But considering it was one of his co-felons and after what has been described as happening happened. There is not much chance at all that Vick wasn’t involved, or had a hand or in the very least knowledge of about what was about to go down.

  35. tdowdy11 says: Jun 29, 2010 9:45 PM

  37. gavinmac says: Jun 29, 2010 9:50 PM

They should check Vick’s cell phone and text records to see if he got a call/text right after the shooting telling him “It’s done.”

  38. philcommander says: Jun 29, 2010 9:53 PM

Playing in the NFL is a privelge. If you kill dogs and go to prison for it then you dont deserve to be in the NFL. But if by some miracle you are allowed back into the NFL then you dont ever and I mean EVER throw a party with 300 people. You just dont.
If you do…bad things might happen and you will look bad.
And thats what happened and now Vick looks bad.
It just shows that he hasn’t learnt how to behave and should NOT go to jail…but also should NOT be allowed to play in the NFL.
This is why the NFL has an image problem.

  48. Coach says: Jun 29, 2010 10:28 PM

Where is Jon Evans? Is he taking over Vick’s case now?
The thing that struck me as odd from the beginning is how Vick said “we left 20 minutes before the shooting”. Unless he was involved or someone called him to tell him, how would he have any idea when the shooting occurred? If he was so innocent why didn’t he tell police something along the lines of “By the time I left I know that no one had been shot”.
Now it appears he left in the same direction as the shots minutes before…coincidence??? The shooting did not happen in the club, but outside the club…hmmmm.
Not sure what happened, but I can guarantee that Vick had some involvement, will be released from the Eagles and barred from NFL, next stop Federal Prison. Like Jon Evans said best “I am 99.9% positive, the 0.1% because I wasn’t actually there”. Peace and OUT!

Isn’t lying to cops you know, a felony? Even if they can’t prove Vick knew anything about the shooting, evidence that he did not cooperate or be completely honest with the investigators would constitute a crime and therefore what would likely be a lifetime ban for Vick. Even if his lawyer got a plea bargain in that scenario to avoid a conviction, the precedent has been set that a guilty verdict isn’t necessary for punishment.

Also to everyone who is talking about if he was leaving how could he know when the guy got shot… He doesn’t need other peoples accounts or guesses of the time. If he left 3 minutes prior to the shot or shots being fired, he would of heard them. I don’t know if people know this, but guns are loud. I’ve been around them, and shot them my whole life. He would of heard. Unless his driver was speeding, and blaring music. Which I will admit is also a possibility.

  65. jibfest says: Jun 29, 2010 11:21 PM

To any of those out there who are too dumb to make sense of this, let me help you.
Vick is on thin ice with the NFL. Now you have a co-defendant who he shouldn’t have been around getting shot. Vick and his crew say he left 20, 40, 50, 30 minutes whatever. The video apparently shows him leaving 3 minutes before. So what that means for Vick is his case of “I wasn’t even there, I was gone” takes a hit when we find out three minutes later someone gets shot. I’m an Eagles fan and I say he should be gone from the league. People saying this isn’t a big deal are complete morons.
So Einsteins, you have someone of bad character who consistantly makes bad judgements. His character takes another hit when we find out he is lying about when he left.
Surely enough to boot him from the league.

the AP reported that Phillips was the shooting victim and the New York Post reported Phillips and Vick had a confrontation — Vick may not have necessarily violated his federal probation, said James Garrett, a Virginia Beach attorney who specializes in probation law.
Garrett said that for a person on probation, a chance encounter with a felon would not in itself be a violation.

  68. Coach says: Jun 29, 2010 11:26 PM

anyone who would kill their own dogs would not hesitate to hurt a human. On the other hand I know a lot of people that would hurt humans and never hurt an animal…just saying.
Over 70% of people that are convicted of animal cruelty go on to bigger, more serious crimes (murder, rape, etc…). When the animal cruelty includes multiple murders of animals you are looking more at potential serial killer status. The number jumps to over 85% that commit serious crimes afterwards.
I doubt that Vick is a changed man. Would you trust your kid with a child molestor as a babysitter just because he served his time and has a good job? Seems like a good guy that learned his lesson?

  69. snnyjcbs says: Jun 29, 2010 11:32 PM

A vehicle sure can cover a lot of ground in 3 minutes. Looks like Vick has proof that he was no where near the place at the time of the shooting. Funny how you people grasp at straws, I bet you stay up nights on your knees just hoping that he was there at the time of the shooting.

Semi-related: Goodell doesn’t even have time to be a commissioner anymore; he has to play the role of babysitter. Vick, Roethlisberger, VY… I think it’s time he hired a lead investigator, or some sort of psychologist type who knows athletes and can read people — and delegate so that person has the authority to counsel athletes he thinks are worth saving, or suspending ones he doesn’t. Maybe then Goodell can focus on football.
Related: Gone is gone, like many have already said. I couldn’t tell you exactly when I left a bar, unless I was going to another bar. That being said… “three minutes before the shooting” changes Vick’s story from “innocence proven” to “suspicious coincidence.”

anyone who would kill their own dogs would not hesitate to hurt a human.

I am, by far, a Vick Fan. Look at your watch. In 3 minutes you can travel a long way. Where he was, he could have been on I264 before the shots were ever fired. Maybe Phillips was noticed when he went out after Vick, Vick unknowing he was even there. Someone that didn’t like Phillips went after him. The fact is VICK wasn’t there when the GUN went off. NO proof that he knew he was there. Case Closed. This was VICK’s Party so Phillips, if anyone, is in violation of the probation NOT VICK. I think Vick is a POS but I also don’t think he should be banished because someone else broke the rule. Leave him alone.

Ok morons, read the article. There is “video of Vick and “his entourage” driving away from the restaurant at 2:07 A.M., only three minutes before gunshots were fired in the direction the cars went.”
So his car went in a direction. Three minutes later shots were fired.
This doesn’t prove anything, but circumstantially, this is probably more than enough for Goodell to act.
Why do the people that defend him defend him? They can’t all be Eagles fans. And even if they are, there were and still are plenty of Steeler fans that blew up the Steelers threads demanding trades for Ben and Holmes. So why are people who aren’t Eagles fans defending him? And if you are an Eagles fan, what does it bring to your team to keep him? Why not call for him to be dumped very loudly?

The story states Vick left the club 3 minutes before the shooting and he left in the direction that the shooting happened. The shooting didn’t happen at the club. It happened near the club, down the street. Soon we will hear about a witness that saw Vick’s SUV at the exact spot the guy was found. Shots fired from an open window on the passengers side I believe. BTW, Vick rarely ever drives anymore, it is rumored his drivers license was revoked and he is driven around. Could Vick have been the person in the passengers seat???? You figure it out.

    ————————
Lying to law enforcement officers while on probation is grounds for arrest, at the very least. Have you never watched ‘COPS’ when the guy runs, they catch him and they say “Why’d you run?” and he says “I’m on probation”

So far what we have is nothing that proves Vick did anything wrong. If you are going to tell me it was stupid to have the party, I won’t argue the point. If it found that he committed a crime, he goes to jail. If it is found he broke the conditions of his parole, he goes to jail. If it is found that he broke any of the conditions for reinstatement into the NFL, he’s out of a job. And even if none of the above happens, the Eagles will make a decision as to whether or not they still want him on the team. If they decide it is in their best interest to keep him, they will. No matter what, I am going to cheer for the Eaagles.

Not legally, but in terms of employment.
He blew it, was getting paid $5mm to do nothing except make an old white man, Andy Reid, feel like he could have saved his own kids had he tried a little harder.
Reid may be getting played, my guess is Lurie won’t stand for it.
Ya know who Lurie is? He’s Officer Prezbeloeski (SP?) from The Wire, when he becomes a teacher.
Remember when Dookie comes to the school and asks him for money? And Prez tells him he will help, but if Dookie is lying he doesn’t want to see him again? And Dookie goes right back to the junkman and shoots heroin?

No, I just think that Vick has a more established track record. Now, do I believe that Roethlisberger is a rapist? Absolutely I do. I think he did SOMETHING to that girl in Nevada (although the circumstances are a little sketchy) and I think he absolutely raped the girl in Georgia. He should be banned from the NFL and probably banned from the human race. That being said….Vick, my god. What HASN’T he done? Ron Mexico, stealing a rolex, water bottles, flipping off fans, running an illegal gambling ring and, oh yeah, torturing and murdering a WHOLE BUNCH of animals. It’s also all been established as fact and has been proven beyond a reasonable doubt in a court of law. People will still give Roethlisberger the benefit of the doubt because they don’t understand the difference between “Yeah, he did it because they proved it in court” and “Yeah, he did despite the fact that they were unable to prove it in court”. They don’t want to believe that the 2nd one exists. Don’t jump for the race card just because it’s convenient.

For all the dumbasses focusing on “he couldn’t have been involved in the shooting no matter if he left 30 minutes or 3 minutes before it occurred.”
The actual points are two fold. He lied about when he left. Which calls into question his motivation for lying if 3 minutes or 30 minutes does not latter.
Did he have contact with Phillips or not? Part of the 30 minute claim is that he was gone before Phillips arrived. If he lied about his contact with Phillips he is screwed. So did Vick leave and within 3 minutes Phillips arrived and got shot?
Who is buying that on first blush?
Its the timing issue and playing loose with the facts, not the shooting. Remember often the cover up is worse then the crime.

@EverybodyGotAids: I like your response. It is rational and well written. I see the logic and actually agree with you.
My point is that the sorts of things that people here say about Vick is borderline insane.
He has stayed virtually problem free since being relased from the federal penitentiary — aside from drinking a Vodka Cranberry at an airport restaraunt. I just think that it is Un-American to believe that a citizen who plead guilty to a crime – served 2 years in the penitentiary – and lost many millions of dollars has paid what he owed to society. Much more than what the average guy here would have paid. With that said, you don’t have to like the guy 3 years later, but wanting him to rot in prison, or die is just irrational.
It’s not the “race card” but there used to be certain situations where the punishment did not fit the crime – hanging. Based on some of the comments here, many wouldn’t mind if Vick met that fate. That’s just wrong.

And, by the way, it has been long proven that anyone who would kill a pet would have no problems with killing a person. Every serial killer started out killing the family pet or the neighbor’s pet. So basically, don’t be surprised if it is Vick is the one who shot him.

Hogster, your own response contained a key phrase: “SINCE BEING RELEASED FROM THE FEDERAL PENETENTIARY”.
I think alot of it has to do with the fact that none of us were born with the athletic ability to have someone give us $130 million (or hell, $5 million…or $1 million for that matter) to play a game. Vick got that opportunity and he blew it. He doesn’t get it. He doesn’t understand how lucky he was to be BORN that way, through no doing of his own. He was born fast. Did he keep in shape? Yeah, but he was born fast. It’s frustrating to see someone CONSTANTLY get 2nd, 3rd, 10th chances because of this ability (which, again, is through no doing of his own) while others are without jobs, struggling, whatever (personally I’m doing fine, but I’m not making millions of dollars per year). It’s just one of those “Why were those gifts wasted on such a POS human being, when it could have been me, or at least someone more deserving?”. I think that’s what really gets people.

I smell an EXTORTION PLOY – Starring:
    Hoodlum 1: (Phillips)
    Hoodlum 2: (Shooter)
    Sucker: (Vick)
Hoodlums 1 and 2 know Sucker has a lot to lose. Causing trouble that could sink Sucker for good would be a good way to get some money out of Sucker.
Hoodlums 1 and 2 crash Sucker’s party to cause scene that would sink Sucker if Sucker is implicated.
Weeks later, when heat turns on Sucker, Hoodlum 2 approaches Sucker or friend of Sucker with an offer he can’t refuse. Give Hoodlum 2 $$$$ or else he’ll tell the cops that Sucker told him to shoot Hoodlum 1.
If Sucker is indeed a sucker and pony’s up the $$$$$ Hoodlums 1 and 2 share the loot.
Hustlers and criminals pull capers like this all the time.

Suspend this man now! He was not charged however he was there! That equals a suspension! Fair is fair..

Hogster, you over-complicate it. It is what it looks like. Some clown punked Vick, and his people took care of it. Weather or not they were ordered by Vick doesn’t matter since he looks to have been gone by the time it went down, so he has no exposure LEGALLY.
And why would anyone target a broke-ass bitsch like Vick? Guy has negative equity, he owes the world money.

  128. funi says: Jun 30, 2010 6:36 PM

He left 3 minutes before shooting, however where did he go? Drive around corner then shoot him? GUILTY!!!!

–yes but when Roger Goodell is deciding whether or not to bring the hammer down, he will look at the apparent discrepancy. Let’s see, vick’s co-defendant shows up, smashes cake, leaves, get shot. PLUS he gets shot three minutes after vick leaves. Im not a vick hater but he SHOULD be gone from the NFL. A man who interacted with vick at a party was shot later…..

GO STEELERS! Number 7 (Super Bowl ring & Big Ben) is coming. The rest of you losers be prepared.

No Sweed, no Holmes, no Colon, No Big Ben, No Super Bowl.
    ———————————————
Sweed? Really? The Limas Sweed? That is the first player you want to point out? Seriously? I just, I can’t really fathom who in their right mind would list him first when describing reasons for a team, any team, not winning a title.

Well, that proves it. He’s guilty! Of what? I dont know…celebrating his birthday, walking around, breathing, getting a second chance..I don’t know, just guilty.

Getting lost in all this hyperventilating is who got shot. Quannis Phillips? Ha Ha Ha! I don’t think that is even a misdemeanor in Chicago. You can shoot them guys all night long here and not get in any trouble.

All of you people are hypocritical idiots…NONE of you know Michael Vick. Michael Vick is NOT Marcus Vick. Marcus is a complete thug and failure. Michael has made terrible decisions about who to trust and who to give money to (the thug who got shot deserved more time than Mike, has intimidated him and is stalking him)
Michael saw a guy slap cake out of his fiance’s hand into his face, walked away and left. He had NOTHING to do with the shooting….PERIOD. He walked away and got out of what was becoming a dangerous situation. IF Ben Roethlisberger had done the same thing in the same situation, he’d be praised for his restraint…but you people are blaming Michael for something his brother may or may not have done.
The guy who got shot…by the way…deserves whatever he gets…he’s not a victim…he’s the instigator.

Vick gives racist people an acceptable person to spew their hatred and vitriol. It’s quite sad.
Rothlisberger raped two girls. Vick killed dogs. I’d bet that you’d hate the guy who raped your mom, sister, or daughter, a little more than the guy who killed your pit bull.
But, then again that is the logic of racist and hateful people. You guys are more subhuman than Vick by a long-shot.
The degree of hate for Vick is irrationally disproportionate.

LOL This is all 2 funny – the people that defend Vick are 2 funny…
