Plaxico applies for work release again

Plaxico Burress wants to get back to work and out of prison.

The former Giants receiver has applied for work release for the second time, according to the New York Daily News.  Burress was denied in November and his appeal was also shot down.

“There are a number of very prominent anti-gun and anti-violence
organizations who have written letters on his behalf and who are
supporting his release,” Burress’ lawyer Peter Frankel said.

The district attorney that prosecuted Burress and opposed his last release is now out of office, so there is hope.  Either way, Burress won’t hear anything back for a few weeks.

  2. Yes….grant him work release…but only arriving to the site from an Orange Bus…wearing and Orange Vest….while toting a stick and a plastic bag along the highway!!! Bet he will change his mind about a “work” release.

    Murderers and manslaughters are still playing, but he and Vick get locked up?

  7. wow, just let him out already. They’ve already changed the law that got him in trouble. Municipalities cannot deny the right to carry firearms as is granted by the Constitution anymore. So basically the charge he caught was unlawful to begin with.

  11. Man, he has done plenty of time. Let him out. I can’t believe one guy drives drunk/high and kills someone but is already on a team while Plax shoots himself in the leg – didn’t hurt anyone else – and does so much time. Not fair. Plus, according to the constituton we should all be able to carry firearms anyway.

    I’m all for gun rights, but he fired his weapon (albeit accidentally) inside a private business. That would NOT have been covered under any law past or present.

  15. It’s really sad that he’s in jail for committing a crime that has no constitutional basis.

  16. People need to stop crying about this being a constitutional issue. This is a case of someone being an idiot not a DA trying to abuse the constitution.
    First: Plaxico doesn’t have an concealed carry permit.
    Second: He was carrying a gun in a place where they serve alcohol. Even if he did have a legititment concealed carry permit he’s still violating the law.
    Third: New York city has very strict gun laws.
    All these add up to screw Plaxico in the ass.

    He was offered a very sweet deal by the DA. He would not have missed ONE day of football. All he had to do was a few weeks in jail and then some community service. Plax CHOSE to go to trial. I fail to see why Plax turning down a sweetheart deal and taking his chances with a jury and losing said trial is not fair. He had a choice. He chose wrong. Just like when he brought an unlicensed gun into a nightclub tucked into his jeans (He could have easily afforded a holster and NYC carry permit). Why would you feel ANY sympathy towards a moron that caused his own misery?

  21. Yes Plaxico should be granted work release. The only draw back given the hoodlum and thug element that exists. Will this open up the gates for a large amout of work release players in the NFL? Goodell certainly will not allow this because it will effect the NFL brand that he is trying to maintain.

  23. He took a loaded weapon, loosely secured into an upper end establishment(not some dive). He had Antonio Pierce with him. Plax later claimed he had the gun for personal protection. Here is this big, strong NFL player with an even bigger and stronger teammate with him. Who in their right mind would have come up to give these two any grief? Plax accidently allows the gun to go off. It is a small miracle that no one else was hurt.
    If this had been you or me we would be still doing our time. Plax showed the IQ of pocket lint in this entire episode. Let him finish out his term. It just might smarten him up.
    I am not anti-gun, but anyone would tell you he made a huge mistake.

  25. He was in jail for 2 months and he asked to be released from jail?!?!? Of course your not gonna get out! I agree with schpetz, If hes granted work release he shouldnt be alllowed to go back into the NFL right away. He should work for the community. Not do what he wants to do, he gave that right up when he walked into a club with a firearm. Thinking he was above the law.

  27. Burress’ crime has nothing to do with his right to own a firearm. He was charged with being in possession of an unregistered firearm. The primary charge was possessing a firearm without a permit. The other charge was reckless endangerment from when he shot himself in the leg with the gun he did not have a permit for. Both of these charges were felonies and had nothing to do with his constitutional right to bare arms. This is not a constitutional issue and it in no way infringes on his right to bare arms. Burress is in jail because of two stupid decision he made: owning an unregistered firearm and acting irresponsibly with it, which resulted in him firing it in a private club.
