Raiders' grievance against JaMarcus Russell may have just gotten a lot stronger

NFL_davis.jpgAfter cutting quarterback JaMarcus Russell in May, Raiders owner Al Davis filed a non-injury grievance against the first overall pick in the 2007 draft.  The grievance hopes to recover more than $9 million in base salary advances.

The grievance, when filed, was regarded as weak.  At most, the grievance was regarded as a preemptive effort to obtain an offset as to any base salary earned by Russell with another NFL team in 2011 or beyond.

A league source tells us that Monday’s arrest of Russell may have resulted in the grievance getting considerably stronger.

If, as the source explained, the contract contains language voiding future guaranteed base salaries in the wake of a suspension (a tactic upheld in a grievance resolved last year against running back Larry Johnson by the Chiefs) and if the NFL suspends Russell if his codeine-possession charges result in a conviction, a guilty plea, or a plea of no contest, the Raiders would be able to argue that the guaranteed base salaries have voided — and that any advances provided to Russell on those voided guarantees can be recovered.

So, in other words, that may have been a very expensive batch of sizzurp.

Jamarcus makes 30x my annual salary for each TD pass he throws.
    Just a little perspective.

  4. ehatem says: Jul 5, 2010 8:53 PM

Okay, but can he be suspended? He’s currently not an employee of the NFL.

  5. KUHawks2010 says: Jul 5, 2010 8:54 PM

Hey Tom Martinez, you still think the Raiders were the cause of this idiots failure? This guy is a complete waste, and never will amount to anything in life. He will be bankrupt working at McDonalds in 5yrs…

  6. Humboldt420 says: Jul 5, 2010 8:57 PM

    @ ehatem
Didn’t Hollis Thomas, a free-agent defensive tackle, just recently get suspended for performance enhancers? Technically, a free agent isn’t an employee of the NFL, right?

if I was Jamarcus I wouldn’t go back to the NFL. Id take my 30 million and drink and smoke my ass off and laugh and these fools for paying me so much to plays a children’s games.. i love football but its stupid to pay these people so much money to play a game.. Id roll a blunt and blow smoke in Goodell’s face and tell him where he can put his suspension

Now what do the folks think about his old QB coach the other day saying Russell was all that and would have been taken ahead of Sam Bradford. And people wondered why when he would talk to the Press he was always slurring his words. This dude is nothing but a bum, and he said early on he wanted to work and be like P Manning. If Al Davis thinks you have the talent he will give guys bunches of time to show it. The Raiders had old players that use to play for the Raiders living with this guy 24/7, they knew he was done and the talent he does have would never see the light of day.

  12. Nickelman22 says: Jul 5, 2010 9:06 PM

Her’s the thing, yes he can be suspended, he’s a free agent seeking employment. The NFL can just say when he signs a contract he has to sit 4 games or whatever.
Also, I’m glad that the Raiders have an opportunity to sue his ass for part of the salary that they ADVANCED him. When you sign a contract to work somewhere and request an advance and then suck hind tit at work and get canned, you should owe that money back. Jamarcus Russell is such a tool. The only reason he went number one in the draft back in 2007 is because he could throw a football 85 yards or something ridiculous like that. I don’t care is he can throw a semi truck 85 miles, if he can’t hit the broad side of a fat Minnesota woman’s ass then what does it matter? Enjoy the sizzurp you damn invalid.

i doubt the Raiders knew anything about this. Lane Kiffin is such a douche that he would have talked all about it just to make himself look good and the raiders look bad

Not going to happen! ;) Let it be!

  17. RyanT. says: Jul 5, 2010 9:47 PM

If he had an anti-narcotic clause in his contract than the Raiders will get that $9 million back!
Codeine is a narcotic. It is an opiate.
It is made from the same plant as heroin.
Just because it can be obtained through prescription does not mean it is not highly addictive.
Like Oxycontin which is also an opiate it is highly addictive.

So, the PoPo have the time and manpower to go undercover after cough syrup abusers?
Since word was already on the street about his favorite beverage, me thinks Big Al called in some PoPo favors and got him busted so he could put the stinkeye on that 9 mil.
    Watcha think dog?

  22. burntorangehorn says: Jul 5, 2010 10:38 PM

Maybe we could up the potency of the cough syrup and weed consumers of purple drank out of our population?

  23. ItalianArmyGuy says: Jul 5, 2010 11:19 PM

@Florio – you think Big Al personally planted that codeine in Russell’s house, then called the cops on him – Don’t you?

  24. Blk&SlvrSoldier says: Jul 5, 2010 11:19 PM

Hahahahaha, I love every word of it! My whole arguement was that leaf was a bigger bust because he landed his ass in jail, and Jafata$$ would only surpass him as the biggest bust once he found himself in cuffs which we all knew would happen. But Damn!!! Two months after being cut, frickin classic. Hope the raiders get back some of that fat cash (no pun intended).
Also great pic of half dead Al. The Raiders are def gonna rise up through the ashes this year!!!!

  25. Grimmlock42 says: Jul 5, 2010 11:43 PM

The NFL really needs to step in and make an example of this guy. Raiders might not get there money back, but hopefully in the future the NFL will make sure other teams don’t get screwed like we did.

Not really following the logic that a company can recoup money for services previously rendered, due to the fact the former employee did something after he was fired. Once that employee was fired the conditions of that contract are null and void; you can’t continue to hold him to the terms of that contract on one hand yet not employ him or reimburse him on the other hand.

  27. DarthGable says: Jul 6, 2010 1:15 AM

    You signed a contract.
    Sucks for you Raiders.
    Jamarcus is playin now.

  28. stablereyesir says: Jul 6, 2010 1:48 AM

I think Tom Martinez is the cause for Jamarcus drug problem. All the Raiders ever did was ask to see if Tom could help out with Jamarcus constantly coughing up the ball and choking in games.

  30. FinFan says: Jul 6, 2010 2:57 AM

The shame in all this is guys like quincy carter, mike vick, vince young, and now jamarcus makes teams second quess drafting black qbs. Just sayin… But its true, not the best position to draft regarding party boys

  31. joetoronto says: Jul 6, 2010 6:23 AM

    How dumb is the walrus?
Dumb enough to think he could ripoff Al Davis and get away with it, that’s pretty damn dumb.

    ——————-
    Don’t read well, do you?
“The grievance hopes to recover more than $9 million in base salary advances.”
Meaning, it wasn’t for services previously rendered. It was compensation for services to be rendered in the future, which were not rendered due to negligence on the part of the employee.

Al is the one of the most generous owners in football and that means he is sometimes taken. Hope he gets another championship while he can still enjoy it, and I’m not a Raiders fan.
But still don’t understand how Russell’s actions now, months after he’s been cut, any bearing at all. Does that mean Al next going after Todd Marinovich’s bonuses for chasing the dragon after his Raiders days were over?

  34. XLI says: Jul 6, 2010 9:32 AM

Raiders Fans should file a grievance against the Raiders for drafting this tub of waste if the first place.
Raiders, YOU DRAFTED HIM. It’s your loss, your responsibility, your checkbook, your fault. If you didn’t want to pay him, you shouldn’t have drafted him.

Set for life? Are you kidding me, every week there is a story about an athlete who is bankrupt or broke after making an astonishing amount of money.
The agent took a percentage of his millions, taxes took another chunk. He likes Vegas, how much has he blown there? How much awful bling has be bought? How many hanger on does he have? Now an arrest, lawyers aren’t cheap. So yeah, go ahead he should smoke and drink all he wants, and he’ll be broke before you know it

  36. moolah954 says: Jul 6, 2010 11:42 AM

@blacktoothgrin ………………………………………………………………………………Your talking about the few morons who don’t know how to manage there money or lives right. (They get 10 million dollars and buy a 11 million dollar house) You can indulge on things in life and if you have the right mental capacity to handle what your doing then you should be fine . the few people that you speak of are mentally weak and let small things like money make them instead of it being the other way around…… and when u quote me put the full quote not just your spin on it
