Favre camp to Sterger camp: “Give us a lawsuit”

After months filled mainly with silence and one denial of the existence of settlement talks, Brett Favre’s camp has made its first substantive communication regarding the NFL’s ongoing investigation into the question of whether Favre violated the league’s Personal Conduct Policy in 2008 via his interactions with former Jets in-house sideline reporter Jenn Sterger.

With the Favre camp now convinced that litigation is inevitable, their message is simple:  “Give us a lawsuit.”

So said Richard Gerakitis, an Atlanta-based employment lawyer who recently spoke extensively with PFT in the wake of Phil Reese’s Thursday appearance on The Dan Patrick Show, at which time Reese presented in frenetic detail many facts (some relevant, some not) as to the ongoing situation.

Reese’s comments, which can be heard at DanPatrick.com, carried three major points:  (1) Reese said that Sterger won’t sue the league, the Jets, or Favre if the NFL suspends Favre and adopts a “program” aimed at preventing sexual harassment in the workplace; (2) Reese said that Sterger never complained to the Jets about Favre’s behavior; and (3) Reese implied that Sterger never communicated to Favre that she found his behavior, whatever it may have been, to be offensive or unwelcome.

The significance of Reese’s comments cannot be overstated.  After his first point strongly suggested that a lawsuit will happen if a suspension doesn’t, his next two points potentially undermined any eventual lawsuit by tending to prove that Sterger wasn’t truly bothered by Favre’s actions, a key ingredient in proving sexual harassment based on the creation of what the law classifies a hostile work environment.

We suspected that the remarks would be enough to prompt a response from Favre’s camp.  And they did.

“What is this?” Gerakitis told PFT regarding Reese’s comments.  “Give us a lawsuit that enables us to find out what her allegations are.  We can defend against a lawsuit.  We can’t defend against the attempted manipulation of the media by trying to only give selective portions.”

Gerakitis, who has been working on this matter behind the scenes with Favre’s agent, Bus Cook, since September, believes that a lawsuit is inevitable, based on Reese’s remarks to Dan Patrick.  “Reese sounds desperate,” Gerakitis said.  “He sounded desperate on that interview with Dan Patrick.  Reese spoke with such anxiousness I kept wondering, ‘He must see this cratering and he’s going to pull out all the stops.’”

Sterger’s lawyer, Joseph Conway, tells PFT that a decision to file suit has not yet been made.

“I can’t say definitively,” Conway said.  “From day one, whether the public wants to believe it, the number one thing is to clear Jenn’s name.  Although she hasn’t done anything wrong, there is a perception that she bears blame.  We want justice done.  We want the person to be punished, and we think that will vindicate Jenn.”

As to the punishment issue, both Conway and Reese backtracked from Reese’s suggestion to Dan Patrick that a suspension will be required.  “If there’s a finding by the NFL in our favor and some kind of program put in place, we will not sue,” Conway said.  “If not, the possibility exists. . . .  [The NFL] would have remedies other than suspension.  If they come out with a finding against [Favre], we’ll live with what the NFL thinks the right punishment is.”

So why did Reese tell Dan Patrick a suspension will be needed?  “I was amped up, I was pissed off, I was tired, I hadn’t slept in three days, I felt like I had been jerked around all week,” Reese told PFT.  “I was referring to a conversation with the league before the interview [of Sterger], where they said, ‘If you meet with us voluntarily and you present evidence that clearly shows [Favre] was in violation of the Personal Conduct Policy, this Commissioner holds all players accountable for their actions and takes a hard-line stance against sexual harassment and [Favre] would be suspended.’  I’m not calling for the NFL to say [to Favre], ‘You’re not playing on Sunday.’  I’m looking for an acknowledgment from the league that he did something wrong.”  (Reese said that the representations were made by NFL V.P. of security Milt Ahlerich in a meeting that occurred on November 8, three days before the actual interview of Sterger by the league.)

Though Conway said upon his initial involvement in the case that he will be pursuing any legal remedies available to Sterger (he now brushes that off as standard lawyer talk, and that it didn’t actually reflect Sterger’s intentions or objectives), Conway says that Sterger only wants her name to be cleared.

“A finding of wrongdoing clears her name,” Conway said.  “From when the story first came out, she has taken a beating in the media.  She has lost her job.  She’s unemployed.  There’s a perception that she did something to cause this.”

Gerakitis doesn’t see the connection.  Gerakitis explained that, in his view, “it makes no sense” for Sterger to try to clear her name via a finding of wrongdoing against Favre in light of the “path” she has chosen for her career, which has included posing for publications like Maxim and Playboy, working for the Jets in revealing clothing, and attending Florida State games wearing only a bra.

“It’s hard to imagine any judge wouldn’t look at her background and experience, her modeling career, her relationship with co-workers, her attire on the sidelines when she worked for the Jets,” Geratikis said.  “I can’t think of many Falcons employees who dress that way when they’re a ‘sideline hostess.’  I can’t imagine Erin Andrews or Jill Arrington or Wendi Nix dressing that way.”  Gerakitis also explained that a legal proceeding would entail a review of, for example, language used by Sterger in the workplace, which would help shed light on whether she truly was offended by or objected to any communications she may have received from Favre.

“She cannot show that she’s the victim of sexual harassment,” Gerakitis said.  “She has no claim against the league, Brett, or the Jets.”

The frustration in the Favre camp flows from the fact that, within the confines of the NFL’s investigation, Favre has no ability to clear his own name, at least as it relates to the contention that he sexually harassed Sterger.  Gerakitis believes that, with Reese publicly introducing the possibility of a lawsuit, the matter would best be resolved in the court system.

It’s hard to disagree with that.  Though the league has shown in the context of the Ben Roethlisberger case a willingness to split from the legal process and make its own decisions, some matters simply can’t be resolved absent an ability to gather all facts, to cross-examine the parties, to compel any reluctant witnesses to testify, and to apply legal standards of evidence and proof to the question of whether a violation of the law occurred.

Sexual harassment is a serious charge.  In our view, the league isn’t equipped to make a reliable decision that it did or didn’t happen.  Regardless of whether Favre is guilty of sexual harassment, it’s now clear that the people working on his behalf would strongly prefer an opportunity to explore and present the case in a forum that allows for full, fair, and complete investigation of all potentially relevant facts and circumstances.

In the end, the question from a legal standpoint (and from the perspective of the Personal Conduct Policy) isn’t whether Favre sent inappropriate text messages or photos.  The question is whether he engaged in severe or pervasive behavior of a sexual nature that Sterger found to be offensive and unwelcome.  The circumstances call for a much more careful view of her actions — and inactions — than the NFL is able to provide.

We’ve got more information from both sides that we’ll be posting over the next 12 to 18 hours as to specific issues relating to the case.  Already, this opening chapter has extended far beyond the ideal duration of an article written in this medium.  Check back later tonight and tomorrow morning for further updates.

    The women needs to go hide under a rock until this blows over, then the gold digger can work a a 7-11. She handled this the wrong way from the word go. Obviously she toted with the man and only now she wants something out of it. Favre obviously has something that showes she was not offended at the time.

    Sterger, her agent and her lawyers are nothing but bottom-feeding gold diggers. It’s like a prostitute after how many years wanting “to get her reputation back”………..Sterger intentionally established her “reputation” years ago with her actions and it is what made her money and gave her “exposure” (double entendre intended) to the media and public but now she wants to “cry wolf”. Sorry Jen but it doesn’t work that way, you made your bed and now you must lie in it.

    Nice piece of work Geratikis is spinning. Make the issue the conduct of Sterger (ie; the Maxim piece, the “bra only”, etc.) and take the spotlight completely off of Brett Favre and the issues of whether he e-mailed a photo of his manhood and tried to get a “hook-up” with Sterger.

    Yeah, it’s all about HER, not about Favre, right?

    Her posing half nude in any magazine in no way absolves Favre of sending pics of his penis to her.

    she evidently did not take him up on his many offers to “chill” and is the one getting raked over the coals. Although he’s probably dealing with his own home drama, poor guy!

    and yea, I’m sure favre really wants a lawsuit over this…………..

    I love how Viking fans come to Favre’s defense. Three years ago they would have been throwing him under the bus and calling him all types of names. I remember all of them calling him a wimp, etc when he was crying after a Packer game.

    The league “isn’t equipped to make a reliable decision”? How hard it is to check phone records and confirm that the those pics did or didn’t come from Favre’s phone. Not like you need to be a CIA investigator to confirm these sorts of things.

    You are basing your opinion on a false premise. You seem to think that Favre has done something wrong (i.e. illegal or a violation of the Personal Conduct policy) simply by sending those pics. That is not true. For the purposes of this investigation, he has only done something wrong if he sexually harassed her. If she was a willing participant in a flirtation, then he was not sexually harassing her. The league and the law have no interest (nor should they) in punishing him for being a bad husband.

    I think it’s a pretty clear message to all the young ladies out there; if you’re assaulted or harassed by an athlete or any other celebrity, just keep your mouth shut and pretend it didn’t happen. There is no upside to reporting it or saying anything. They’ll score another TD or make another movie and everyone will forget anything happened.

    So the head of NFL Security told Sterger’s manager that “this Commissioner hold all players accountable”? But he didn’t hold Vince Young or Brandon Underwood accountable, did he? But as you point out, in Roethlisberger’s case he split with the legal system and did his own thing.

    Young, Underwood, Roethlisberger, and now this heel-dragging with Favre don’t prove this Commissioner holds all players accountable. They prove the more public the case, the more the more likely the Commissioner will do something to imply he is holding all players accountable. After all, this Commissioner is a very expedient man.

    This isn’t about anyone’s personal views of morality. The only issue is whether this is sexual harassment or an opportunistic woman pretending she was victimized. ALL we know–as Geratikis says–points to the latter.

    Since Favre’s history of infidelity has long been documented, I had no illusions about his character. But all these years, his wife has chosen to stay in the marriage; it’s their business. That doesn’t mean I condone his behavior. I don’t know whether he sent the penis photos. If he did–with or without an invite–he’s an idiot. But Sterger’s behavior over the past two years still says it wasn’t harassment.

    Wish you’d apply your righteous indignation to women who extort NFL players by pretending a victimhood they never experienced.

    I personally think that “Lord” Favre should not be suspended based on what has been alleged. On the other hand, if this would be a civil action, isn’t the burden for prevailing only “preponderance of evidence” (i.e., more likely than not)? The downside to lawsuits is that oftentimes everything is dragged out in the open. Do Favre and the NFL really want to go there? It’s possible that Favre may eventually decide to reconsider not playing ball with the Sterger camp in the event a complaint is filed. If the allegations are in fact false, then Favre should play hard ball and fight to the end, as he has done so often on the football field.

    Call me stupid but I would say 1) How do you know if it is un-wanted if the other person wouldnt say so 2) in most places you have to complain and the employer not do anything about it to even have a leg to stand on
    3) whay wait so long 4) this is about her (she brought it up two year later
    5) I am sure the NFL has a policy in place to deal with this and if they dont i will be each team already has and i will bet she didnt follow the procedure

    This whole thing is starting to feel like the Maurice Clarett situation a few years ago. He found out what it was like to go up against the NFL and now Jenn Sterger is finding out so all of sudden she wants to “clear her name.” Give me a break.

    Whether or not Sterger was a victim of sexual harassment is now moot. There is enough circumstantial evidence that she ‘encouraged’ Favre, again, whether or not she actually did. Favre, will ride off into the sunset in 4 weeks and that will be that. Sterger’s lallygagging around when this first came out has nullified Favre getting any league sanctions…from his wife, now that may be another story.
    Sterger probably has a better chance if she sues the NFL and the jests and leaves Favre out of it…except as a material witless….too bad, both seemingly are guilty as charged here but the real story will be under wraps for some time to come…by that time, Favre will be permanently riding his John Deere and Sterger will be posing for some other publication….

    I’m almost becoming as tired of hearing about this as I am annually about Favre retiring/unretiring etc. Let’s remember how this started with Sterger not doing anything, to going to an attorney skilled in litigating monetary settlements, to now saying she won’t do anything if the league takes action against Favre, to now saying she wants to clear her name and have the league to start a sexual harassment program. My opinion: Trust me, Ms. Sterger has received more than her share of questionable and flirtaceous texts from others than Favre. Someone convinced her she could get rich off the Favre incidents, and now she’s finding out it’s not going to be as easy as the two sides getting together over dinner with Favre’s side agreeing to hand over a multi-million dollar check. She didn’t start out needing to clear her name; she’s now painted herself into a corner. Believe it or not, I’m not a Favre fan but he’s closer to being the victim here than Ms. Sterger.

    So now the Favre camp is bringing up relations with co-workers. Interesting charge if they care to provide proof. But also hypocrisy once again by floor boy. If Sterger’s camp had said that it would have been about how they want to shame Favre. But since its Favre’s camp its perfectly acceptable for them to threaten to bring forth tawdry details of someone.
    Its also good to know that both this site and the Favre camp believe that if a woman (who is not even 30 years old) wants to be a model, well she’s asking for sexual harassment or even worse.

She also had pics of other players as well, Brett was not the only one. She also sided with the guys and blamed Big Bens accuser in one of her blog posts.     SHE’S not the one being looked at by the NFL for conduct….. FAVRE is.

    Everybody keeps missing that point. HE is the one accountable for her actions in this case, not Sterger. And I don’t care how big a skank the woman might be, there is NO place for Brett Favre to be sending a picture of his pecker to ANYONE. The man is a married forty year old legendary NFL quarterback, he has to answer for sexual deviancy like this.

    She’s unemployed because the show that employed her was cancelled, which had nothing to do with Favre’s dik pics.

    There’s a perception that she did something to cause this because she saved the photos of a married man’s penis for two years and then sold them to an internet tabloid. Which is totally f’ing ruthless. I mean, in a sense I commend her for it because of its ruthlessness, but she can’t have her cake and eat it too. What she did was cold as hell, and her reputation will now reflect it. She clearly wasn’t victimized.

    Sure, she may regret saving and selling the photos now. She may now want a settlement, or a Favre suspension to “clear her name” (which by the way it wouldn’t). But that doesn’t change the fact that she saved pictures of a married man’s junk and then those pictures wound up in an internet tabloid only days after she promised them to said tabloid’s producer in a publicly available email chain.

    Personally I really, truly think that she saw her stardom was about to burn out forever, which it obviously was, and this move was simply a publicity stunt to revive her career. Bad attention is better than no attention at all and she may be able to spin this into a celebrity boxing match, Oprah appearance, Letterman show, etc. But it would really help if she won a lawsuit or if Favre was suspended to “prove” she was harrassed by a high profile celeb.

    I swear that most guys posting on this site are bald, fat, ugly guys who never had attractive women hit on them. In all likelihood, Farve was just doing ‘boyz will be boyz’ flirting that likely was in response to encouragement from Sterger. Even if he was pushing the envelope as mid-age men sometimes do, it was likely not going anywhere – he was just feeding his ego. Any NFL wife has to have a thick skin and knows this sort of flirting goes on all the time. They set up certain rules regarding discretion – don’t embarrass the family and know the limits of what is allowed. If this ever goes to court, I ‘m sure Farve’s attorney(s) will bury Sterger with her past shinanigans with various men in and out of sports. They probably have a hotline for men to call. Remember that an ex-boyfriend of Sterger was the person who sent her confidential info from Farve to Deadspin. Who knows if his intention was to embarrass her as payback.

Five years ago I could not have respected Favre more, now all I respect is his athleticism and talent. Even before this garbage with Sterger, I could not imagine him becoming anymore of a petulant little child in an incredibly gifted body. I know not all athletes are role models but this guy is the poster boy for how narcissistic fame can make a person.

    If Sterger wants her name cleared her first order of business should be to fire Phil Reese. I have a difficult time believing this guy is in PR. He is hurting Sterger more than he is helping her in the public relations department. As a matter of fact, if Sterger is upset that her name has been sullied she should be upset with Reese.

    In the Dan Patrick interview Reese said that early in the season Favre would stare at Sterger in the tunnel and she thought it was awkward and uncomfortable. Then Reese actually said that Sterger responded to one of Favre’s texts telling him that if he is going to stare at her not to be creepy about it, to at least smile or something. So there you have it, straight from Sterger’s PR manager, that Sterger didn’t text Favre asking him to stop texting her. She didn’t text Favre telling him the staring is making her uncomfortable and to stop. Nope, she texted Favre telling him to at least smile the next time! I don’t know about anyone else, but if somebody is sexually harassing me and making me feel uncomfortable the last thing I ask for is a smile from them.

    Reese also talks about his conversation with Bus Cook. Reese said that he contacted Cook before the story broke because he didn’t want Favre/Cook to be blindsided. Are we really supposed to believe that Favre did what Sterger alleges, yet Sterger and Reese did not want Favre and his agent to be blindsided by the story?!

When he met with the league, he admitted those were hit voice mails but denied any knowledge of the penis photographs. richm2256 keeps referring to sexting as “deviant sexual behavior,” and you keep insisting that this is about Favre’s bad-boy behavior. No, it isn’t. This is about sexual harassment in the workplace, not whether we as individuals are squeamish about sexting or find adultery immoral.

    Personally, I find sexting bizarre–consensual or not, celebrity or not–given the constant possibility that the photos will go viral. Nor do I approve of adultery. But nothing about Sterger’s handling of these incidents suggests she was being sexually harassed. Her manager’s statements have virtually eliminated the consideration. Her own behavior, and the statements of her attorneys have made clear that her motivation has been self-serving from the moment the story broke. The handful of PFT readers who persist in treating her as a victim because of their dislike for Favre are doing a disservice to legitimate harassment victims.

    Pictures can be deleted!!!! That is why I have no problem with someone sending me pictures, I can delete them! My co-workers are all men, I get nasty e-mail jokes and texts all the time from them…..I delete those e-mails! I don’t keep them and show them off for two freaking years and then decide I was offended by them! He did not touch her and she did not complain. So Favre did not commit a crime, he is just stupid! My story was an example of a crime to make my point clear that this chick is not a victim of a crime!
