Minnesota Court of Appeals rules in favor of NFL in StarCaps case

More than two and a half years after Minnesota defensive linemen Kevin Williams and Pat Williams first failed a drug test for ingesting a supplement called StarCaps, the NFL may finally be able to suspend the two players.

Greg Aiello of the NFL and Brian Murphy of the St. Paul Pioneer Press both pass along word Tuesday that the Minnesota Court of Appeals has affirmed the lower court ruling in favor of the NFL.   In theory, Murphy points out, this should allow the league to follow through on four game suspensions for the players.

The news should also affect Saints defensive end Will Smith.

Frankly, we can’t say anything for certain when it comes to this winding case, which has basically been dragging on since 2008.  Maybe someone with a law degree that understands the issue better can chime in later.

UPDATE: Florio tells me there is still one more level the case could travel to: Minnesota Supreme Court.

    Is Pat Williams even going to play next year? Kevin Williams was a shell of his former self this last season….maybe the NFL should forget the suspensions and punish the Vikings like a college team. Take away their Division Championship from the time the cheaters were playing with the team.

    The Bears still suck.
    The Vikings are the worst franchise in NFL history.
    The Lombardi Trophy is back in its rightful place.

    is it wierd to say that the Vikings should look at the job the Lions have done recently to start rebuilding. i have a urky feeling that the Vikings will have the toughest time in the NFC north trying to withstand the strike/lockout if there is one….

    The Vikings will be rebuilding the next few years anyhow, so this really doesn’t matter. This franchise really seems to be in trouble. Embarrased time after time with player issues, coach issues, off field issues, stadium issues, fan issues, you name it.

    Who cares at this point? They didn’t gain any advantage by having them play last year, so what’s the disadvantage of having them suspended?

    They should still be suspended if only that token justice is done. The Minnesota courts, full of elected judges, cheated just like the Minnesota players. Similarly, the court and the players did win the battle with their cheating and obfuscation, yet the players, the judges, the coaches and their jeering fanbase, all lost the war.

    At this point it should mean more to the Saints than the Vikes. The Saints find themselves in the middle of a tough NFC South, and losing their DE for four games could impact them.

    The Vikes are in rebuilding/transition mode until they find a capable QB and while they may surprise, the chances are that the loss of one or both Williams’ won’t significantly impact their playoff chances in 2011, let alone a SB title.

    The players will get a “stay” of the ruling pending appeal to the Minnesota Supreme Court. So this ruling is practically meaningless, except that it shows at least 2 courts have agreed that the NFL has the better argument.

    They bought a legal over-the-counter product. The product in question (StarCaps) failed to list an NFL banned substance on its ingredient list. Which is a violation Starcaps admitted to.
    How are players responsible for taking something not listed on the label?

    You would think the Vikings would recognize that justice needs to be served if they ever hope to get out of last place. Fight it as you wish, but the franchise will never turn around without a proper level of respect for the rules.
