Saints defensive end Will Smith had a disappointing year on and off the field, with the low point his arrest for a domestic battery incident in November.

District Attorney Mike Harson said this week that he will let a grand jury decide if Smith’s case will go to trial or not, according to the Associated Press.

Police on patrol near an area nightclub witnessed Smith grabbing his wife’s hair while in a dispute. Witnesses have reportedly since come forward with information that could help Smith.

Because of the conflicting testimonies, Smith, Smith’s wife, witnesses and the officers will testify before a grand jury to determine whether Smith is charged.

Smith could also be punished in 2011 for his involved in the StarCaps case. He’s due $6 million next season.
