What you don't get is that is a MANDATORY sentence in New York State for unlicensed gun possession. That dates back to Bernard Goetz in 1984 and before.

I also have always believed there were politics involved in this. The then-about-to-retire DA of Manhattan, Robert Morganthau, had no choice but to get the mandatory sentence, or it would have seriously hurt the chances of the man he hand-picked, Cyrus Vance, Jr. to succeed him as DA because Vance's opponent, Leslie Crocker Snyder would have heavily used Plaxico getting a light sentence against Vance in ad campagins leading up to the Democratic Primary for DA (which in Manhattan if you win, you win the election since it's next-to-impossible for a Republican to win a race like that).

The law is there to prevent a repeat of what Bernard Goetz did in 1984.

"I was under the impression that this was the minimum sentence for the crime. I know that jail time is mandatory in NY for a gun offense."

Yes and no. The majority of people (I think its at least 65%) are allowed to plead down and they end up serving 6 months or less if they serve any time at all. Things that are supposed to be taken into consideration is any criminal history (Plax has none), and reason for carrying a gun. Considering Steve Smith (as in #12 on the Giants) was held at gun point 3 days prior (police are strangely in no rush to find that criminal) at his own home, its not surprising Giants would be packing.
Add in the fact New York City violates both the 2nd amendment (As the McDonald case says its applies to states) and the equal protection clauses of the US constitution by not allowing non NYC citizens to have carry permits, unless of course they pay money, and yes Plax should have gotten less time.

"Burress has actually served less than the two years he was sentenced to; his June 6 release date represents about four months off for good behavior."

Which means Burress has served about 3 times as long as the vast majority of the people convicted of the same crime served if not less. The factors that lead to longer incarceration (previous criminal history, reason for carrying) were not present in Plaxico's case. Which was Eli's point.

Plax got so screwed its amazing. You have a guy like stallworth who killed a man while drunk driving and he got nothing close to what plax did. Same with vick he kills and tortures dogs and he spent less time. You get dumb a** like plax who shoots himself in the leg and he gets two years. All because crappy mayor bloomberg had to try to make a example outta him. Not a plax fan but i dont think hes that bad of a guy and it wont bother me to see him get back in the league nearly as much as say vick or stallworth.

Yea Dante Stallworth kills a man with his car while drunk and gets 30 days and probation. Meanwhile, Plaxico shoots himself with a concealed gun and gets 2 years in prison? Our judicial system makes a whole lot of sense.

ridiculous sentence (only in Zoo York). if i were Plax, i’d pay someone to shoot the judge and his entire family then set the courthouse ablaze:)

I was under the impression that this was the minimum sentence for the crime. I know that jail time is mandatory in NY for a gun offense.

"Eli on Plaxico: He’s served his time, plus some"

No, as MDS points out he actually did a little less. Getting out a little early for good behavior.

Burress experience what some people might call karma. He used his status as an NFL player to take advantage of people.

I hope he comes out understanding that he was the one responsible for landing himself behind bars.

That being said, his debt is paid, and if he still has the skills and physical ability to play a few more years, more power to him. Maybe now he will have a greater appreciation for the blessings he has been given.

Wasn't a huge fan of Plax when he played but there's no doubt he was an awesome receiver. Find it brutal that in a time and age where people are getting in domestic disputes and beating up their spouses, a time where people are pistol whipping and shooting at relatives, a time when people are getting caught with DUI's, etc, etc, etc, we send a guy to jail for shooting himself in the leg. Stupid, yes.....Possibly harmful to others, yes..... Served more than he ever should have and lost way more than was normal, absolutely!!!
