This is all about politics. DeMaurice Smith is up for re-election this month, he didn’t want to lower the cap space for teams in 2012, nor lose his job. So he and Goodell decided to retroactively penalize the Cowboys and Skins (on player contracts that were approved) without merit because 28 other teams kicked and screamed enough. Most of those 28 owners are cheap skates who won’t even use the extra cap room they were given. When did a luxury tax suddenly become a part of the NFL?

In order to maintain some sort of integrity for the 2012 season the teams had to keep it in check for 2011. What it shows is that the league was divided along ethical lines.

With 28 on one side and Jerry and Danny on the other and not surprisingly the Saints and Raiders in the middle.

The uncapped year was not in a void by itself, everyone knew a new deal would get done with a cap and trying to “game” the new agreement is not leadership it is being a punk.

So when the decision is between what you can do vs what you should do, we all know were Jerry and Danny fall.
In the end maybe they can prove they were “legally” right but that still does not make it wrong.
