Go to the t-shirt website, click on the t-shirt in question, and read the description. They are definitely using Tebow's name to sell this t-shirt. While the website doesn't explicitly say it, the implication is that this shirt is endorsed and liked by Tebow. This awful article isn't explaining Tebow's position. Instead they are mocking him. The logo isn't what is being questioned. Using Tebow's name over and over again in the description is. Let's say dolphindan is famous and pro-life. If I make a pro-choice t-shirt, and then repeatedly use dolphindan's name and circumstances to promote the shirt, don't you think he would see that as improperly using his name/likeness? It's not the jets logo that is a problem for Tebow. Go to the website, read the t-shirt description, then come back here and apologize to Tebow.

jets13: iced107, sorry but you dont know anything

when the company starts out (they have taken it down since tim tebow went ater them)…….but starts their t-shirt campaign as “tim tebow new york jets t-shirt”

Tim Tebow has every right to go after them.

Maybe 5 seconds of research would help your internet tough guy status.
----------------------------------------------------

internet tough guy? Because I know what I'm talking about?

Might want to research the copyright laws buddy and how they work. The company didn't just "start out" - they've had many other t-shirts before. And Whether or not there is anything that is "related" to Tebow is irrelevant.

There is no part of Tebow or any kind of direct representation of him that is represented on the shirt. The jets logo is the only thing that is copy righted and trademarked. The NFL is the only party here that potentially has a case.

Helps to know what you're talking about instead of being some loud mouth who watched Law and order once or twice.

I'm far from being either a Jets or Tebow fan. I am not religious at all. However, what nobody seems to be realizing is that if Tebow is as genuinely Christian as he appears to be, then the reason he has a problem with the shirt is not that infringes on any of his copyrights, but that it could be misconstrued that the shirt is suggesting that Tebow = Jesus. This would be blasphemous for any true Christian.

Weird Al has several parodies he can't release because he can't get approval from the performers of the song he's parodying, so that might not be as cut-and-dry as you think.

Lolb,

Didn’t know the Jet’s were the only team that used block lettering and a circle around its name. I don’t even recall a fish being on their logo. Their are obviously some similarities, but their are also difference. The Jets and the NFL are going to make plenty of money this year. Do they really need to go after a small business because they came up with a great idea? And yes, people can be mad at TEBOW. True Christians are not worried about copyright laws, making money, and holding others back. Hippocrates however do.

Parody is not copyright infringement. Quite the contrary, parody is protected speech. Christian T-shirts have take similar forms for decades with designs like "God's Gym" as a parody of "Gold's Gym" etc.

This is the second thing Tebow has done to make himself look bad since the trade. The first was to lie about whether he had the choice of going to NY or Jacksonville.

If people want to see Tebow fall from grace they've got him in the perfect environment for it right now. Personally I wish him the best and hope he holds it together.

Really Tebow? When did you have exclusive right to Jesus or the Jets? Jesus can't benefit any one else publicly other than you?

The NFL and the Jets are legitimate to bring on any law suit but it is not that easy for them to win.

It may resemble the Jets logo and it was intended to but there are many differences that it will be hard for any one to prove it is an infringement to the copyright.

I'm not sure this parody is a copyright infringement. For instance If you do a parody of a song and make money from it your fine, even if you copy the music and melody. As long as the words are different. I'm not expert in this issue. But I never heard the milk industry sue anyone for making their "Got Milk?" slogan into those "Got Jesus?" t-shirts several years ago. I'm sure they copyrighted the commercial and either way it's proven intellectual property if not. This is where Florio really lacks as a writer. Why doesn't he tell us why this has legal traction, and why people like me and over half the people commenting in here are wrong. I assume the NFL wouldn't pursue the issue if they didn't have a chance of winning. In fact they probably wouldn't pursue unless they know they'll win, because of the negative publicity. But it doesn't make sense to me...I mean ever seen an Elvis impersonator? If they were trying to use the Jets logo as a serious attempt to brand or promote a specific product, etc. then it would be a problem. But a parody is very different. Ever see "Scary Movie"? They don't pay anyone for doing parodies of scenes from horror films. Even though they directly copy key elements of the scenes, it is only for the purpose of the parody. Nobody thinks they are trying to "copy" those scenes literally. And that's the difference between stealing and borrowing. And nobody believes that this t-shirt company is trying to copy the Jets logo literally. So I just don't see a case here. This is an unpopular move by the NFL. I'm just wondering if they haven't just foolishly made more bad press for itself

Haha go to the companies site and check out the saints bounty t shirts. Now that’s funny. Also, something the NFL might want to check out.

--------------------------------

That's a really good point. Interesting the league is upset about the Jets "infringement" when the Saints, Redskins, Colts and Patriots are blatantly more obvious (and Andrew Luck. RGIII and Rob Gronkowski have a much bigger gripe than Tebow since, their names are actually used). So why did the league choose to fight the company on the issue of a questionable JETS reference instead of these other teams? Look into this, Florio, and let us know WTF?!

The things is that Tebow is a public figure, so he has no right to expect people to NOT use his name however they like (as long as they don't misrepresent his role in their message or defame his character using factually inaccurate claims)- otherwise he could sue any journalist (or me for mentioning his name here). The company was very careful to be clear that Tebow did NOT endorse the product, so they are free and clear of his gripes.

It will be interesting to see if the league has a strong case. I somehow doubt that they will win on the merits, although they have enough money and smart lawyers to win by brute force. Still, if you understand copyright laws, you understand that even if you can show a clear usage of another person's intellectual property (which is not clear in this case since the copyright covers they text "NY JETS", not "MY JESUS"), an artist can still do it if, 1.) it represents a clearly distinct artistic message or 2.) it seeks to make a socially or politically relevant point that can only be made by the use of the copyright (any questions, ask Andy Warhol). I would suggest this logo meets both of those qualifications. So, even if you can prove that the artist intended to violate the copyright, they would be OK if the point was to show the arrogance of a certain NY Jets player who might automatically assume that such a reference to Jesus was a reference to him. Again, my bet is the NFL will win this one, but not because it has the better legal grounds...

….Please show me where it says Tebow owns the rights to “Jesus” or anything christian related.

The only thing the NFL can sue for is violation of the Jets Logo.

Please stop acting like you know anything about the Law.

Seriously? Please show me where it says the lawsuit is about Tebow claiming to own the rights to “Jesus” or anything christian related? Is that really what you think?

Tebow is suing because they used his name to promote the shirts.

Please stop acting like you know anything about the topic.

Tebow is a huge Christian freak, and you hate him for being so damn happy about it. We all get it. Doesn’t mean you can just blindly hate on the guy without actually reading the articles. Can’t just look at the pictures buddy.

Where did they use his name BUDDY? I don't see one mention of Tebow on the shirt. Do they have some secret ad campaign mailed only to people that have read the cease and desist letter and therefore know everything, like you? Sounds like you have a mad case of man crush on TT and would love to take a knee in front of him to gargle his nut curd.

Well, you non-realists are the ones who think that the trademark would give the NFL a win in court if this went all the way to a completed hearing. This isn't a case of someone trying to trick people into buying it by making it look like a real piece of Jets merchandise. They make the difference clear.

One question: Why? This is a PR nightmare should the NFL pursue it. Yes they may have a legal right but the David v. Goliath press this would get (no biblical pun intended) is not the negative publicity the NFL needs at this time. Especially with all the concussion, suicides, bountygate, Vilma appeal, etc. And for what? So Timmy T. doesn't have his Sunday School view of life questioned? I have been and always have been a Christian. But I have a realistic attitude. Not everyone in the earth will agree with my views. To think they would or that I could change them is unrealistic.
