The allegations are he was doing 100MPH, while intoxicated, with no proof of insurance (which is not the same as not having insurance and will be dropped as soon as he appears in court showing he had insurance, I digress) and with an open container.

He doesn&#039;t get a pass. He needs to be accountable. BUT what if he blew .06, it was an empty beer can and he was just speeding?

Kind of blows the seriousness of the accusations away. Time will tell what exactly was going on and I&#039;m sure he&#039;s going to get 4 games for this offseason, but this is a young man who is doing what young men tend to do. He needs to grow up, just like some of the other guys on this team. That in no way makes him a bust or any of the other nonsense people on this site are claiming.]]></description>

Aldon Smith is a star player, Fairly was injured and didn&#039;t come close to contributing what Smith did last season. So, Aldon Smith stupidity is much worse in terms of how it could effect the team.  A DUI is a DUI. Someone can get killed at 45 mph as they can at 100 mph if there is a drunk behind the wheel. It&#039;s the same offense in my book.  Plenty of first time DUI &quot;offenders&quot; learn the hard way.  

Heck, I could stretch it and say that Fairly had some character questions going to the Lions so no one should be surprised.  He was a lost cause.  However, Smith was a choir boy until he went to the 49ers?

This situation is bigger than football, so the bias should be left out of it. A DUI is an irresponsible thing to do by anyone, no matter who they are.

He was a major contributor to the 49er defense and his idiot behavior damages the 49ers more than Fairly&#039;s idiot behavior. Schwartz isn&#039;t somehow letting the loonies run the asylum because three young players decided to do stupid stuff on their private time. There is a management philosophy to praise in public and punish in private. To address Fairly&#039;s problem as a team problem would be stupid, and to further Fairly&#039;s public humiliation would also be counter productive. In this case it&#039;s best to let the league do the punishing, so if Fairly turns his attitude for football around, his relationship with the head coach won&#039;t be strained.

It&#039;s SCHWARTZ not Shwartz, if you are going to be particular about spelling someone&#039;s name, don&#039;t screw up another name in the same post you correct another&#039;s spelling. 

While Harbaugh and Schwartz are intense that is where the similarities end.  Their personalities are  nothing alike.]]></description>

If you look at the Lions 2011 draft class, they missed on 2 of their first 3 picks. Titus Young is showing signs of turning into a punk, so they may have missed on all 3.]]></description>

2. the gas pedal stuck to the floor due to a can of beer being logdged there, so there is a reason for the excessive speed.
3. It was past his momma&#039;s curfew and he was trying to get home before she found out.
4. He pays a lot of taxes and has the right to drive faster than the rest of us.
5. Its a Cadillac Escalade that only goes a 100 or more. 
6. He was upset over the supreme court vote coming up on ObamaCare.

If a young man comes out of college with a maturity issue, giving him $X millions isn&#039; going to make that better. 

IMHO, teams that put emphasis on measuring maturity end up with better long-term draft results.
