While technically true, it seems to absolve people to an extent from dd if they aren’t wealthy. If you have the money to drink, but not the money for a cab, get wasted at home with your friends, and stay there.

For what very little it’s worth…pleading not guilty at first appearance/ arraignment is entirely routine. Procedural, not substantive. Doing otherwise would have been real news.

Ignorant people should not be on here giving thumbs-up’s and -down’s — let alone commenting! Many of the above comments say things like “his lawyer must be really stupid for advising him to plead Not Guilty,” and those comments have like a 10:1 up:down ratio. Get a clue! ANY lawyer practicing criminal defense will tell ANY client to plead NOT GUILTY and take a look at the evidence, EVERY TIME.

It sure seems like alot of NFL players are getting arrested for DWI’s and DUI’s lately. However, I don’t think it’s any worse than DWI/DUI’s found in the general population (no, I do not have the actual statistics because I only have a limited amount of time to waste here). I do think it’s ridiculous that wealthy professional athletes resort to drinking & driving when they have lots of other options (not always the case with “us regular folks”). The NFL has a program in place where players can get a free ride if they’ve had too much to drink (not sure if this was available since he hasn’t signed with the Jag’s yet). Even if the NFL didn’t offer this, why don’t these guys just rent a limo or call a cab? C’mon, they’ve got the money for it! Speaking of money, isn’t a limo or cab cheaper than being suspended and losing game checks?
Here’s several other options that work: use a designated driver; don’t drink if you’re going drive; or stay home and drink.
The bigger issue is that this irresponsible behavior can kill….not just the selfish, idiotic jack___ who’s driving while impaired. Unfortunately, the drunk often walks away with minor injuries, leaving their victims seriously injured or dead.
This is Blackmon’s SECOND offense…if he’s found guilty, maybe he should spend some time in jail. I hope the NFL suspends him for at least 1 game. This guy just “doesn’t get it” and hopefully will grow up before he kills someone.
The Lions, on the other hand, may need to set up a weekly AA meeting at their facility.

#2 DUI’s and he should go to jail. Most normal people do who don’t have money. Then how about the Community Service, AA meetings and DUI school? Sorry I forgot he has money to pay an attorney to get him off it all. I forgot the driving suspension for 5 years.

The “not guilty” plea was for the preliminary hearing. It doesn’t mean he’ll ultimately plead not guilty at his trial or take a plea from the DA. This is very pro forma. Calm down, people.

And on a 2nd note I would put more faith in how he actually performs in the field sobriety tests then the breathalyzers. Those machines have been proven to be faulty and not long ago, here in Florida they found about 1/3 or 2/3 of the machines were proven to be inaccurate.

Some of the ways they have been inaccurate include misreadings of the volume of air blown (some machines said 5 liters of air – both human lungs combined cannot make this much air) as well as counting one breath double. So theres a possibility he blew a .12

I have serious reservations that he blew .24 – not saying its not possible, but he would have had trouble standing and driving straight at that level unless he’s an alcholic – which then again you could see this through his body stature (health,football shape,etc.)

It all comes down to policy and procedure. If they can find something wrong with one of the steps, it can void any result the officers obtained.
