The federal arson statute basically says as much – malicious (malice being the mens rea, either intent or reckless indifference to an obvious risk) burning of buildings, vehicles, property, etc. used in interstate commerce

In Russell v. United States, the Supreme Court said that rental properties, by definition, fall under the interstate requirement of the statute. Private residences, on the other hand, don’t.
