		<description><![CDATA[In my experience, most police officers are top notch individuals who took an oath to protect and serve and sincerely want to honor that oath in their daily actions.  However, just as in any profession, there is always a few bad apples that can spoil the whole bunch.  However, that being said...I must say...

&quot;Resisting Arrest&quot;???  Really...He&#039;s walking out and get&#039;s gang tackled from behind.  &quot;Come on Man!!!&quot;

Why can&#039;t the bully&#039;s and jerks show a little self control and restraint when someone is standing up to their bullying tactics?  AP doesn&#039;t take crap from anyone.  He&#039;s an honorable young man who usually makes good choices.  There&#039;s gotta be more to the story.  Something is missing here.  Let&#039;s hope it comes out soon.

AP getting drunk appears to be out of character.  The bar Manager defaming AP&#039;s name by saying he was &quot;drunk all night&quot; reveals that he either broke the law by continuing to serve him OR that he broke the law by committing slander/libel (depending on how the statement was delivered) by lying about AP in order to remain in good favor with the local &quot;authorities&quot;.  

Something just doesn&#039;t smell right.  

Let&#039;s hope that the truth comes out and that justice prevails no matter which way it falls.]]></description>

A few things to consider though, bouncers are allowed to place their hands on you.  If you won&#039;t leave as requested, they are allowed to physically remove you from the premises.  They aren&#039;t allowed to get violent unless you do, however, they are allowed to physically remove you.

As far as whether the cop was wearing a uniform or not, is irrelevant, actually.  If he was working as a bouncer, the above applies and if Peterson was asked to leave repeatedly, and initiated contact...that could be assault, on top of resisting arrest.  

Again, this is all entirely dependent upon what actually transpired.  Adrian should&#039;ve left as soon as asked, just like any normal person would, if asked to leave a bar/club.  You simply do not try to fight bouncer&#039;s.]]></description>

He is there as a deterrent to keep trouble makers/low life out so that guys like AP can have a good time in peace. People have commented that they have never seen an off duty officer working in a bar/club. You might consider stepping up a few levels in class from where you are drinking then. You will see one.

Secondly, I&#039;ll play what if like everyone else. A lot of folks are hung up on the whole Assault charge thing. Some think since he wasn&#039;t charged with assault on the officer it must all be BS. What if he happened to be intoxicated to the point he got mouthy. What if he happened to be intoxicated to the point he stupidly bumped/stumbled/brushed into the officer. What if the officer then informed him he was under arrest for Public Intoxication, a Class C misdemeanor. What if AP didn&#039;t agree with being arrested and then resisted. The Class C Public Intox will usually give way to the higher Class A Resisting charge.]]></description>

Off duty officer means an officer IN UNIFORM working a side job at a bar/club/restaurant/hospital/event/neighborhood/etc&#8230;  Not some random schmo in plain clothes.  Adrian tried to big time everyone all night and then big timed the wrong person.  HPD not gonna take s*&amp;( from anyone.  My prediction&#8230; AP hires Rusty Hardin and skates on all charges, and Roger Godell sends down a one game suspension.</p>

		<description><![CDATA[I live in Texas and you don&#039;t mess with the police in Houston.  Adrian is from Texas and knows that already.  Regardless, none of us were there and so we don&#039;t know the facts.

However, it is a fact that a cop is always a cop, off duty, on duty, doesn&#039;t matter.  If he has the uniform on or tells you he&#039;s a cop, he&#039;s a cop and if you touch him you go to jail.  Period.

So if he truly touched him that&#039;s why he got arrested.  

Since they took him to jail they probably did a blood test and if legally drunk he will likely get a Public Intoxication charge added to resisting arrest.

The Harris County District Attorney will review the case and decide whether to go forward or not with prosecution.  He may have touched the officer and deserved to be arrested, but the DA may not think he deserves to be prosecuted.  It happens routinely.  

Also, don&#039;t forget the over 90% of cases are plea bargained and never go to trial.  So don&#039;t be shocked if that happens here if Adrian is guilty.  

We&#039;ll see how it plays out.  Meanwhile, we&#039;ll continue to speculate and try to out do one another with cute one liners... because we have nothing better to do than read comments other people post, most of whom can&#039;t write a complete sentence.]]></description>

I’m a criminal defense lawyer and this guy is GUILTY. This is not about money, the bar manager can’t sue AP for money, this is a criminal case and its obvious what happened. AP can’t handle his liquor, he tried to throw his weight around, he got out of control. I’ve read thousands of police reports and I’d be shocked if anything drastically different comes out.

Additionally, think about this – if the officer KNEW it was AP would he want all the hassle and garbage that came with a WRONGFUL Resisting charge? No way – this has teeth legally IMHO. However, if AP has no record he’ll get a reduced charge and some community service and its over.
