In the wake of the wreck that claimed the life of Cowboys practice squad linebacker Jerry Brown, his family said they didn’t want to see Josh Brent prosecuted.

The Dallas County district attorney’s office does not share that sentiment.

Brent was indicted by a grand jury Wednesday for felony intoxication manslaughter, according to USA Today.

The case will next head to criminal court, but no hearing or trial date has been set, according to a spokeswoman for the Dallas County DA’s office. Brent is free on $100,000 bond.

Brent was arrested on Dec. 8 after flipping his car in a one-vehicle accident. Police said his blood-alcohol level was .189, more than twice the legal limit. He suffered minor injuries, but Brown (his college teammate at Illinois) was pronounced dead at the hospital. Brown’s family said neither player was wearing a seat belt.
