		<description><![CDATA[Apparently all plastic urine sample cups are contaminated with whatever drugs the players test positive for.

The NFL should reverse all suspensions ever handed down since testing began. Who would have thought that the company that made the cups coated the insides of random cups with an array of drugs. Never saw that one coming.]]></description>

		<description><![CDATA[You Chicken Hawk fans kill me, the guy cheated and got caught plain and simple.  The test was deemed INVALID not negative.  He still had a positive test.  The sample was not tainted or contaminated the cup was leaking and he was given a new one just like he should have, Sherman transfered the sample just like he should have.  He got off only because the tech did not follow procedure when he did not include the cracked cup in the report.  
The sample was positive, the guy still cheated.  If he was clean is  his teamate and other corner withdrawing his appeal for the same substance.  Guess his cup was not cracked.]]></description>

The process is inviolate and the sanctity of the procedures is paramount since drug testing has an assumption of guilt based on positive tests. In virtually every other legal proceeding you are presumed innocent regardless of how much evidence there is against you and it is incumbent on the accuser to prove otherwise. Drug testing is the exact opposite -- you are presumed guilty but only sometimes get the opportunity to argue your case otherwise. For this reason the process by which your due process is relinquished -- the actual testing -- must be without flaw and beyond reproach.

If this really happened the way he and the tester says it did it is amazing. This would be an egregious violation of process in the military&#039;s drug testing system and the accused would be immediately vindicated. I would never even conceive of transferring a sample from one cup to another...and especially without documenting it.  And if the tester himself did the transferring it would be infinitely worse. The tester is not allowed to touch the bottle from when it is handed to the subject until it is labelled and sealed.  While the tester, of course, does not have malicious intent and is rarely trying to get people to test positive, for all intents and purposes the tester is the accuser. So it is important that the accuser not have direct access to the sample once it is collected.

Sherman need not argue he didn&#039;t do it. And the fact that he is not saying that means nothing. He and any subject of drug testing is far, far more likely to get off based on procedural irregularities than by pleading innocence.  He (well, his lawyer) did the right thing.

		<description><![CDATA[ok, a few things that seem to be missing from both the articles and the comments is the fact that sherman did indeed proclaim his innocence throughout. he has said that the reason he appealed and hired lawyers and pursued the whole process was because he knew he had not ingested any illegal substance. however, he knew that he needed more than just his word saying he didn&#039;t use to overturn a suspension. almost all the players say that, and they always serve their time.

now, because their argument is about the blunders in the collection department, everyone is assuming that he is getting off on a technicality. &quot;he never said he wasn&#039;t guilty!&quot; but yes, he has. it just wasn&#039;t the main point of his argument, because the technicality was what would overturn the ruling.
