Judge orders Aaron Hernandez to be held without bail

After hearing in detail the evidence discovered during the investigation of the murder of Odin Lloyd, a judge has ordered that Aaron Hernandez be held without bail pending further proceedings.

The decision came swiftly, despite arguments by attorney Michael Fee that the case is “weak” and “circumstantial.”

The ruling caps a dizzying day of developments, starting with the arrest of Hernandez, his release by the Patriots, and the arraignment on murder charges.

The hearing concluded with the judge essentially imposing a gag order, which as a practical matter will be very difficult to enforce.

  2. I can’t imagine that Hernandez helped his cause by giving the DA and judge homicidal glares throughout the proceedings.

    The Pats sure seem to have had a hint of what was coming.

  3. Looking at the evidence, we say there is a very strong case, Mr. Fee. The bullet casing in the car, the man with the gun on the surveillance, etc. You’ll have to pull an O.J. to beat this one.

  8. from watching the arraignment, he seems to be screwed. In this day of video everywhere, it is impossible to do anything and not get caught. The prosecution used the term “execution” of the victim…what an ass if this proves to be true. Good luck with that gag order judge…

    found ammunition that matches casings found at scene in his home, gun not found. Claiming this was a planned murder, from events that happened 2 days before. Plus, they have statements from the people in the car on the conversations…boy, the homies had no problem turning on him. Then the text message from the victim, just before the he was killed.

    He won’t be playing in the nfl…

    Wes Welker must be sick. If Aaron could do this to a friend… imagine his enemies.

  21. You know that the 2 guys in the car are being told that they will also be charged with murder unless they agree to testify against AH. My prediction is that they will do so in return for an obstruction of justice plea.

  22. I’m sure the hearing was laced with innuendo and suspicion, and his lack of cooperation probably irritates the judge. That’s probably why he got no bail. It’s another tactic used to lean on him to get him to talk. It won’t shock me if he gets bail at another hearing down the road, in like 30 days. Otherwise, to get no bail, there had to be something said at that hearing that is damning evidence that indicates a very high probability he will be convicted.

    While we will read about this for a while in the media, the Patriots won’t have to deal with it as much now that they cut him. The road games may be a challenge but hopefully the better fans shame the total idiots into behaving.

  23. Why didn’t commissioner Goodell suspend Hernandez when it was obvious that Hernandez wasn’t cooperating with the authorities? It’s amazing how far the NFL will go to protect the Patriots. What a joke!

  25. Watching this arraignment, AH seemed non-plussed and without any emotion at all. The circumstantial evidence is pretty damning, and it sounds like AH’s “associates” flipped on him. It’s an incredible waste of talent, which is second to the loss of a young man’s life. As a Pats’ fan I hope he rots in prison for the rest of his life.

  26. You all know the types evidence, right? Circumstantial evidence carries weight, homey. Nine times out of ten convictions come on circumstantial evidence. Only TV shows make the word “circumstial” seem unimportant.

  35. Eh, no direct witnesses…he obviously was there, but the fact that they can’t say they have a witness to him pulling the trigger means he’ll most likely walk on the murder charge. Unless his two buddies roll on him. Otherwise his defense attorney is going to drill reasonable doubt into the jury’s skull. The other charges, like the weapons charge however, on that he’s most likely screwed

    Maybe this is like the Ray Lewis situation, charge him with something bigger in the hopes he cops to something lesser and we can avoid a trial

  36. Massachusetts doesnt have the death penalty, but the mandatory punishment for first degree murder is life without the possibility of parole. If guilty, the only way he could ever get out of prison is if a governor pardons him (which is beyond unlikely).

    also, to be guilty, the State does not necessarily have to prove he pulled the trigger. he just has to be involved – if they can show he planned it, was there, helped make sure it happened, then it does not matter whether he actually pulled the trigger.

  37. People today are mesmerized by cop shows where they think if there’s no video of the suspect committing the crime, it’s just ‘circumstantial’ evidence. What they’ve got on Hernandez that we know about is historically enough to send a suspect to the chair.

  38. What sticks out in the evidence that was presented today is that the prosecutor had evidence of conversations that were said in the car.

    So if one/both of the “other 2 men” is/are talking, it may be that he/they ratted on AH and may now be under witness protection type treatment due to gang involvement. And that’s why (along with all the other high-tech evidence) the State felt confident enough to charge him with 1st degree murder.

  39. My gut says this all stems from shooting the guy’s eye out in Florida. They said no charges had been filed because the victim didn’t cooperate. Then he files a suit and a few days later one of Hernandez’s boys ends up dead. I’m betting Odin was a witness to the shooting and Hernandez had reason to think he was going to testify against him in the civil or criminal case. That’s what gang-bangers do, they shut up witnesses.

  44. I’m sure they have more info that has not been released yet. There is some merit to the “circumstantial” evidence angle based on what was said by the ADA in the courtroom. finding the gun ain’t gonna happen, since he’s probably got it stashed by one of his homies… Sad case for both the victim and the perp…

    Innocent until proven guilty doesn’t mean that you aren’t a flight risk and he has the means…that’s why no bail…

  46. I’m an Eagles fan and I was sitting in the stands when a guy said they just signed Mike Vick. I thought he was kidding. I looked it up on my phone and saw that it was true. I remember just sitting there in the stands at The Linc and I just felt bad about myself for being a fan of a team that would force me deal with this person. I can only imagine that Pats fans feel much worse.

The prosecutors only gave the minimum to get him held without bail and even though these jailhouse lawyers weren’t impressed with the evidence thus far……the Judge was and ordered him held without bail. If you would have listened closer to the proceedings, it is obvious that AH’s girlfriend/fiancee has given the cops info also. The cops have motive…..they have opportunity, proof of the gun he owned, the matching shellcasings, etc. etc. Even if one of his other cronies pulled the trigger, AH would still be an accessory to the murder and is looking at some serious time.

  49. For everyone citing Casey Anthony and OJ as examples of why AH will walk, please remember Scott Peterson was convicted on circumstantial evidence.

    Its pretty rare to find video or photographic evidence of a murderer in the act. Just because they don’t have the weapon doesn’t mean anything. People are convicted on circumstantial evidence every single day.

  51. Someone said this is the worst day in Patriots history. I doubt that. I would imagine the death of Marquise Hill was a bigger loss emotionally than losing this turd.

    I’m a correctional officer and I can tell you one thing – gang-banging doesn’t stop just because you get locked up. These guys are loyal to the end to their gangs and and I’m sure Hernandez will slip right in and find a home in prison with other members of his gang.

    We can’t understand how a 23 year old who is set for life from playing a game at its highest level and has so much to lose can throw it all away, but to someone who values his reputation and ego over everything else, it makes perfect sense to him.

    The comment about kicking Wes Welker’s ass should have been a massive red flag to the organization.

  52. I am proud to be a Patriots fan and I am happy that the Patriots released that scum bag. He ruined his life, career, and will not be there for his infant child. I feel bad and give prayers to Lloyd’s family. I feel bad for Hernandez’s child who will grow up without a father. I hope Hernandez rots in prison. A lot of damming evidence to convict him on murder. Hernandez still has the opportunity to be a receiving tight end. There is a huge demand for it in prison!

  59. Even if he didn’t pull the trigger, covering up a murder by destroying evidence would make you an accomplice to that murder.

    If Hernandez is proven to have done that, then he’s guilty of at least aiding and abetting a murder as an accomplice, which is good for a number of years in prison.

  62. Thank god this judge has been paying attention. Maybe this convict is not a flight risk as his attorney did mention, but he is a high risk to society. He recently killed a man, a bit earlier he took someone’s eye after shooting them….this man is an absolute nightmare & should never ever see the light of day…it’s so sad a man lost his life bc he had a bigger package then that insecure pencil pipe AH

    Thejudstir–do you know what a jailhouse lawyer is? Hernandez can afford the ones he has…Fee comes from a prestigious law firm based in Boston but is national and international in practice. The reason his attorney is stating circumstanctial is because the buren of proof is on the prosecutors. Not saying the Commonwealth doesn’t have a strong case against Hernandez but they will plea not guilty for their client until they see the states case. July 24th they could go for a plea bargain if the case is strong. I am by no means defending Hernandez, but he is innocent until proven guilty. Too often people convict a person and pass judgement without having all the facts. Before casting stones wait for the evidence.

  64. It’s sad, but Aaron Hernandez is a lost Soul. I will pray for the person he killed and for him. He needs God’s love now and so,does his little daughter. It’s sad that he had such a bright future but the demons inside him would,let go. His life and future is,over. Heneeded guidance from somewhere but did not,get it. saw the video where he talked about the,Patriots keeping him on the right track. SAD story….so many people on here show so much hatred. We live in a sad cruel world.
