Prosecutor suggests Glock in Hernandez photo was murder weapon

Hernandez Reuters

Could Aaron Hernandez really be so stupid as to take a picture of himself holding a gun and then use that gun to commit a murder? That’s what the prosecutor at Hernandez’s bail hearing suggested on Thursday afternoon.

On Wednesday, TMZ published a photo showing Hernandez standing in front of a mirror with a phone in one hand and a Glock handgun in the other. Less than 24 hours later, Bristol County Assistant District Attorney William McCauley said in court that investigators have reason to believe that Hernandez killed Odin Lloyd with that same gun he’s holding in the picture.

“There was a photo that was shown on the Internet of the defendant holding a Glock .45,” McCauley said. “That Glock — there’s good reason to believe the firearm that killed Mr. Lloyd was a Glock because the Glock has a rifling system that is different than most firearms.”

McCauley also revealed that investigators found more evidence when they executed a search warrant on Wednesday on a condominium leased by Hernandez. That evidence includes ammunition of the same caliber as the ammunition found at the murder scene.

According to McCauley, the prosecution believes it has a very strong case against Hernandez.

“I would suggest the evidence has established an overwhelming amount of evidence demonstrating the defendant’s guilt,” McCauley said.

I’m not a fan of the Patriots, and like most non-patriots fans, don’t really like the Patriots much.

  23. thegreatgabbert says: Jun 27, 2013 2:44 PM

That’s a publicity reach on the part of the prosecutor. There are probably a million Glock .45s sold around the world. Half the cops investigating the crime probably own one.

  24. raiderufan says: Jun 27, 2013 2:44 PM

I honestly cannot think of a more fantastic way for this to end than for him to have taken a photograph of himself with the murder weapon…that would be the icing this whole thing needs.

  25. ccshocktalk says: Jun 27, 2013 2:45 PM

Um, there are probably 100,000,000 glocks just like that floating around in the United States. I personally can account for multiple ones just like it…therefore I also have the same caliber ammunition as was found at Hernandez’s house. Does that make me a suspect too?

This isn’t evidence, this is what the police do when they no credible witnesses and have no metallurgic matches to match the bullet to the gun that Hernandez owns. Bullet casings and guns don’t prove squat. You have to prove that the bullet was actually fired from that gun or you’ll have to go ahead and investigate the other 100,000,000 .45 caliber glocks that are in the United States. Then investigate the rest of the ones around the globe.

If this is all the prosecution has, this dude will be playing in the NFL again in the next 3 years.

Well he was stupid enough to be caught on camera walking through his house with a pistol and holding the same pistol as he got out of his car at his house just minutes after the murder. As the judge said “it’s a very very very strong circumstantial case” against Hernandez. He already know he’s screwed but if they find the gun or have people talking (and I assume people are snitching on Hernandez) then he will never get out, especially if that .45 or the .22 they found are connected to the double murder. But to answer your question, Hernandez has proved he is an absolute moron. Enjoy the rest of your life in prison bro.

    @ccshocktalk

It doesn’t need to be direct evidence. A photo with any type of gun would’ve resulted in the same decision. The fact that it happens to be the same model, just makes it worse for him.
Right now everything’s circumstantial- there just happens to be tons of it.

I have the same gun myself, but that doesn’t make me a murderer either, but if I destoyed my cell phone and my home security tape; had bags of evidence removed from my home, car and condo, etc, etc, etc………. That would be enough.

  44. Rick Spielman is a Magician says: Jun 27, 2013 2:56 PM

To the Gunnutz crowing about there being a bazillion Glocks out there: Every gun leaves a unique pattern on the bullet striations cut by the barrel rifling. Same with the dimple in the primer made by the firing pin. Matching shell casings to a gun is basic forensic science that goes back decades and is basic police work. It may be only a matter of time before they find the gun. Even if they don’t, having matching shell casings from the crime scene and the one recovered from the rental vehicle is very strong circumstantial evidence.

Side note about the selfie showing AH brandishing his piece. This numb-nuts violates the First Rule of Gun Safety:

Keep your finger off the Bang Switch until you’re ready to fire.

  53. halasfan says: Jun 27, 2013 3:02 PM

Maybe there is a better photo than what I saw but how do they know that the Glock he is holding is the same gun. A 9mm, 357sig, 40, 10mm and 45 cal Glock all look pretty much the same. Need to take some photo with my different Glocks and see it i can tell which is which.

Not saying things don’t look bad, just saying the evidence isn’t real strong here, yet.

If this is so the legal system should get this case done sooner than Pennsylvania did with Jerry Sandusky.

However, unlike Sandusky give Hernandez Sandsuky’s maximum of 400 years.

Quite frankly, I hope Hernandez goes to jail because when you’re with an eventual victim and you do nothing to stop his death, don’t report his assailants, and act as if cleaning the house and destroying anything with record (ie sec cameras and phones) is going to solve anything to do you deserve jail time.

Stupidity is one thing, but all actions past Lloyd’s death has shown me how despicable and brazen Hernandez could ever be.

It does not matter if he pulled the trigger himself; if he arranged or participated to conspire to murder, then he is just as guilty.

Don’t kid yourself, they might not have the evidence you junior crime fighters see on “CSI – BF Egypt” every week but most cases get convictions with far less than it looks like AH is facing.

What I don’t understand is how did he think he was going to get away with a crime like this. It doesn’t even sound like it was a spur of the moment thing. I go to bed at night after a bright sunshining day. When I wake up, my driveway is wet, my lawn is wet, my sidewalk is wet, but I did not see it rain, and I did not hear it rain. In addition to the ground being wet, I notice my wife’s umbrella in the corner by the door which was not there when I went to bed. The umbrella is wet. Her suede jacket is flopped over a chair and stained. There’s a message on the answering machine from the dry cleaners, and they say that they are sorry but rain ruins suede.

Question: Did it rain while I was sleeping beyond all reasonable doubt?

Circumstantial evidence is as good as direct evidence if the quantity and quality is of a sufficient amount and kind. A picture of AH with the gun alone is insufficient. Combined with all of the other evidence, you reach beyond a reasonable doubt.

He hasn’t been the wisest individual in handling this but I don’t believe they will ever find that gun. The only thing that law enforcement can hope for is that they can find a casing or slug from somewhere they know Hernandez shot that missing gun and run it through ballistics to try to find a match. If they can put Hernandez, that gun, and ammo in the same place and it matches, then that seals it. But if two people are arrested and three people are involved, somebody is talking.
