At some point before former Patriots tight end Aaron Hernandez has his day in court, former Cowboys defensive lineman Josh Brent will stand trial for intoxication manslaughter. The charges arise from the death of former teammate Jerry Brown, who was killed when Brent, allegedly driving drunk, crashed the car in which Brown was riding.

When it’s time for the case to go to trial, the Cowboys may be without three of their players for a day or two. According to the Associated Press, three current Cowboys and six former Dallas players appear on the prosecution’s witness list.

Those named are safety Danny McCray, safety Barry Church, and cornerback Orlando Scandrick. Also on the list are retired safety Gerald Sensabaugh, Raiders cornerback Michael Jenkins, and free-agent fullback Lawrence Vickers.

Brent’s lawyer, George Milner, told the AP on Friday that the players were with Brent and Brown at the same nightclub on the evening of the accident.

Typically, the names on a witness list far exceed those who actually will be called. Lawyers do this to ensure maximum flexibility, and to keep the other side guessing for as long as possible regarding the evidence that will be presented.
