Judge finds that the Wilfs committed civil fraud and racketeering, more than 21 years ago

AP

At a time when Browns owner Jimmy Haslam faces criminal and civil allegations of fraud, a judge in New Jersey has found that Vikings owners Zygi and Mark Wilf actually committed civil fraud — more than two decades ago.

According to Ben Horowitz of the Newark Star-Ledger, Judge Deanne Wilson summarized on Monday her findings regarding a 21-year-old lawsuit that culminated in a two-year trial.

“To my knowledge, there has never been a case like this in New Jersey jurisprudence,” Judge Wilson said. “We try to move cases along. There is no reason in the world for a case to be tried 20 years after it was filed.”

She delayed her retirement to resolve the case, which still isn’t resolved.  In two weeks Judge Wilson will provide details and list damages.  For now, she found that the Wilfs and their cousin, Leonard, liable for fraud, breach of contract, and breach of fiduciary duty.  She also found that they violated the New Jersey civil racketeering statute.

The case arose from claims that the Wilfs cheated their business partners out of revenues from Rachel Gardens, a 764-unit apartment facility in Montville, New Jersey.  Judge Wilson concluded that the Wilfs engaged in “organized-crime-type activities” in the bookkeeping practices that resulted in the Wilfs making more money than they should have.

The plaintiffs, Ada Reichmann and her brother, Josef Halpern, will receive compensatory damages, punitive damages, treble damages, a redistribution of revenues dating back to 1992, and reimbursement for their attorneys’ fees.

Judge Wilson pointed to the testimony of Zygi Wilf as evidence of “bad faith and evil motive,” and that Wilf admitted that he believed Reichmann got “too good a deal” and “reneged” on the original arrangement that had been made in the 1980s, by Zygi Wilf’s uncle, Harry Wilf.

“The Wilf family has been in business for 58 years and has earned a well-deserved reputation for integrity and honest dealings,” their lawyer, Shep Guryan, told the Star-Ledger.  “As with many businesses, disputes occasionally arise, and since we are currently in the midst of a legal process to resolve this civil lawsuit, we must decline further comment.”

Appeals surely will follow, and the process undoubtedly will continue for at least another year or two.

For now, the key point is that a judge has found that the Wilfs engaged in the same kind of behavior that has Jimmy Haslam currently sweating out a federal indictment.  The best news for the Wilfs is that the statutes of limitations for any potential criminal charges have likely long since expired.

  1. Are you saying that some rich guys with expensive toys may have been less than honest while hoarding money? In America? Come on…

  2. @vikescry1 it’s THEIR not THERE, probably should have learned that in 5th grade. If you’re going to make insults, please come grammatically correct with it.

  3. Doesn’t surprise me when this billionaire threatens to move the team if the state doesn’t pick up the tab on the stadium…and the fans fall for it. Oops guess those pull tabs won’t pay for it after all.

    Any comments vikqueen fans?

I’ve got a comment, has nothing to do with the Vikings. Just another guy that sounds like he fears the Vikings.

  5. With those kind of connections, you’d think they’d be able to find a competent QB by making “an offer he can’t refuse.”

  6. Well Packer “owners” just remember you okay’d this guy when he bought the team — even with the lawsuit going on.

So I’m assuming you were all of aware of it because you’re all so tuned in as “owners” — I’m guessing since it was okay then, it should be ok now…

  7. “The plaintiffs, Ada Reichmann and her brother, Josef Halpern, will receive compensatory damages, punitive damages, treble damages, a redistribution of revenues dating back to 1992, and reimbursement for their attorneys’ fees.”

Something tells me that could get expensive for the Wilfs. 21 years of damages with interest, punitive damages, treble damages (which is just a 3x multiplier), and 21 years of attorney’s fees.

    Yikes.

I wonder what impact this will have on the Vikings and their stadium. I know the recent stories from the StarTribune state that the expected revenues from the lottery and now also the “e-gambling” haven’t gone well. It looks like the state is going to have to raise taxes to pay for their part – are the Wilfs going to be able to front their part?

    Yikes.

  8. So many of yokels would be coming out of the woodwork, screaming for the gub’mint to leave this “job creator” alone because free market Jeebus – but not this time. They own a football team you don’t root for..

  9. The Vikings committed fraud by telling everyone that Joe Webb was a Quarterback

    ____________________________________

And they did it again, while they try to convince everyone about Christian Ponder..

  10. BFD. The owners of the Packers have been arrested thousands of times for domestic violence, drunken disorderly and road-kill-rape.

But you just look the other way…

  11. Is this the same kind of fraud the Packers management engages in when they sell worthless “stock certificates” to their fans?

  12. Nothing against the Vikings team but the NFL ought to get involved in this – seems like these owners have a lot of explaining to do — the NFL doesn’t seem to have done a very good job in the owners background checks. I think maybe the same thing that happened to the 49ers owners should come into play here. Wouldn’t want to tarnish ‘The Shield’ by having owners with mobster like backgrounds.

  13. Not sure how to break this to a lot of you who are obviously way too excited and lathered up about this news.

But most Vikings fans could care less if the owners committed fraud 21 years ago. What is the NFL going to cancel the team? Are the players going to stop trying? Will the coaches quit?

Nothing. Wilf’s will just have a little less money than they did before.

  14. Let’s just be honest. In order to make the amounts of money these NFL owners have, they definitely stepped on people in unethical ways to get to where they are.

  15. Did someone suggest Rush Limbaugh is a man of integrity and character, whose ownership should be welcomed into the NFL? Wow.

  16. I’ve noticed a lot of the WILF’s I’ve known over the years, didn’t have a problem screwing somone over for money either.

    A guy named Zygi.

  18. What do people expect, this is the Vikings, they are the masters of the pillaging and plundering of others. Can’t wait for Goodell to explain how they are fantastic partners with unimaginable levels of integrity and how they are fantastic to the Minnesota community. Well yeah why wouldn’t they be if they are bringing spoils from all of the other towns that got ransacked along the way of Wilf’s greedy quest.

This is just another tale of another billionaire that is essentially encouraged to rape anybody and anything around him. You just can’t touch these guys unless you have a 150 foot golden and diamond encrusted pole. Even then it’s still just a poke. A poke the rest of crippled society will never be able to afford.

  19. Does it come as a surprise that the Viking ownership engages in criminal conduct?

Just look at the history of the franchise; Love Boat, Whizanator, scalping Superbowl tickets.

They say the fish rots from the head down and that is the case in Minnesota.

  20. Rush was declared ineligble for owership of an NFL franchise because he vocalized what most people thought, but didn’t have the balls to say.
Donovan McNabb was given more hype because the NFL wanted there to be more successful black QB’s, not because his play warranted it.
I didn’t and don’t agree with his opinion, but that’s effectively what got him black-balled from NFL ownership.
As for the Wilfs, I could care less what they do or don’t do in their business dealings on the east coast. So long as they play by the rules with the Vikings.

  22. Well… That’s not as bad as all the domestic battery accounts and drunk driving charges filed again packer fans/owners each year. Hundreds of arrest each year by abusive, drunk packer fans who beat and retreat after a loss.

  23. Jeez this case started when the older Bush was in the White House. DeAndre Hopkins wasn’t even born yet!

If Zygi appeals this case the Vikings will probably be looking for yet another stadium by the time it finishes.

Pretty sure we did that a few years ago… I think you’re familiar with him?

Also, I suppose this explains how the Wilfs got the state of MN to foot the stadium bill…

  25. Probably the most useless class in college, Business Ethics.

Of course, a lot of this would go simply go away if some of these guys who are found guilty went to State prisons, and not Club Fed prisons.

If the Wilfs and Haslems went to an “Oz” like prison, it’d be a huge deterrent to white collar crime.

  26. Which will have a bigger impact on the field: a) RT-turned-LT Bulaga going down for the year with an ACL injury, or b) the Wilfs losing some coin (eventually) in a 20-year old lawsuit? As far as the action on the field is concerned, Bulaga’s season-ending injury is a far bigger problem for GB than the Wilfs’ NJ case is for Minnesota. Last time I checked, the Wilf family doesn’t block, tackle, or catch passes. Rodgers will be running for his life this year (already the most-sacked QB over the past 4 years). Advantage: Vikings

  28. The Vikings are like the Packers’ little brother. Sorry lil’ guy, you’re never going to beat us. Then the Pack can just point at the RINGS.

  29. No surprise hearing coments like “no big deal” or deflecting about the Packers from the whiney jealous fans. Now when he cant live up to his committment for the stadium $ the state will impose it on the people through taxes thus making the fans lose once again. That shouldnt be a problem because it is old hat in Minnesota. And you guys laugh about our stable never going anywhre team and ownership. You only wish you had it this good.

  30. Vikings fans know who they are and what they’re team’s history is. Yeah, we have no rings but at least we’re a genuine fan base. When I meet another vikings fan out there I know that they’re a true brother not some bandwagon jumper.

Packer and Cowboy fans can never be truly sure that the fan next to them have always been a fan or if they will be a fan of the next superbowl winner when they next see them. Just sayin’.

  31. Gee,millionaires screwing other millionaires, big deal, its not like rich politicians trying to screw the little guy while all the while paying less taxes than him.

  32. Funny. All the other teams fans come in and start taking shots at Vikings fans. Let me give some of you a clue.

This happened over 20 years ago. The last I knew the Wilfs had nothing to do with the team then. That’s like blaming the Packers for in college.

Give it a rest. I know most of you have nothing better to do then go into a Viking thread and come up with false accusations or find some way to blame them for things that truly have nothing to do with them. So I guess I will have to excuse all of your ignorance.

  35. This case has been in court for 21 years? Sounds like there must be some overwhelming evidence…um, not. If they had a good case, it wouldn’t be taking 21 years. BTW Packer fans, how did you feel when Chumura was caught in the hottub with teenage girls? hmmm

  36. Reading the comments from the people on this site is like clipping your fingernails with a wood-chipper. I can’t believe how ignorant and insensitive these comments are towards Minnesotans and their football team. You should all be ashamed of yourselves, you have absolutely no class.

  37. It seems that the Packer fans are more worked up about this than anyone else. This isn’t going to have any impact on the Vikings’ season whatsoever. I could care less.

  38. @gergie1957 says “Just another guy that sounds like he fears the Vikings.”

That line gets me every time. Fear the Vikings? For what reason? Their string of championships?!

  39. jrmbadger, the answer to your final question is a resounding yes. The Wilfs will easily be able to pony up the almost $500 million dollars they are responsible for. The rest, e-pull tabs, which are falling very short, is the state’s responsibility.

Poking fun at a Vikings fan for the state’s shortcomings, although easy to find, has nothing to do with football. The new stadium is law, it will be built, and thanks to the G3 stadium fund, you are helping the Wilfs build it.

In the meantime, if you would like me to, I can contact one of my local legislators. I’ll tell him or her some guy, likely from Wisconsin is concerned with the Stadium finance shortcomings. I’ll let you know what they have to say.

  40. @vikingboy26 says: “BTW Packer fans, how did you feel when Chumura was caught in the hottub with teenage girls? hmmm”

Just for the record, Chumura played his last down for the Packers before the hot tub incident. So technically, he was a former Packer but don’t let the facts get in the way.

Meanwhile, the Love Boat, Whizanator and scalping Superbowl tickets were done at the time by current Vikings and so the stain remains. Now your owner is convicted of fraud, just trying to keep up with their players.

  47. Actually, Chmura was released after June 1, and after he was charged for his alleged crimes. So, yes he was still a Packer, but don’t the facts get in the way.

  51. What matters in the context of this site is who they have been as owners of an NFL team, and they have been outstanding. I’d take the Wilfs, with a few skeletons in their closet, over a 100% clean rap sheet McCombs any day.

Pack fans need to focus on understanding how lucky they are for the NFL to allow them to be the only team to get a pass on how ownership in the NFL works, as a business they didn’t have to do that, they could have broken that up years ago. Don’t make fun of other teams because they can’t do something they were never allowed to do in the first place. Please try harder at exuding the class you think your fanbase is known for, it doesn’t show around here.

  53. Jbuck, you are wasting your time trying to be civil on this board. Read the comments section about Bulaga’s injury. 90% of the posts by Vikes fans are wishing Bulaga a quick recovery, but of course there is the 10%.

Next read the comments section of pretty much any Vikings article. 90% of the Pack fans posts are repetitive, snide, a-hole remarks. About 10% of them are constructive well thought out posts.

Most of the Pack fan base posting on this site seems to think that they are “Packers”, and they have a sense of accomplishment for cheering for a football team. My theory is that they have a bad case of little man’s complex, and if you have spent anytime in that state, you would probably understand why.

You lose Jennings cause you won’t pay him, then Bulaga gets hurt, Nelson hurt etc etc and you paid Rodgers to much (although he does deserve it) and can’t replace what you lost. Even though you own the division I see a shifting of the tide. The Vikings and packers split the regular season games last year and yeah you beat our backup qb in the playoffs. Minnesota will win the division this year but will still suck according to you packer fans. It never ends. …Ha! We are so frustrated as Packers fans! It is frustrating that it’s been a few years since they last won a Super Bowl.

I’m not saying your a bad team. I’m just saying fact. If your a true packers fan you have to know that your team had issues this year. More than last year. … your qb gets sacked more than just about any qb in the league. Your offensive line needs help but they put all thier eggs I’m Rodgers basket in hopes he can over shadow a poor line. I just keep it real man. I’m not saying my Vikings are the best team ever but they have a more solid well rounded team this year than the packers do. Yeah we have an unproven Qb but he has only played a year and a half of football. Remember where your qb was the first few years he was In the nfl. ….. riding the bench and learning. Ponder never had that luxury..

Arguing that the vikes will beat the Packers is an opinion, not a fact. The only facts in hand are that the Packers ended the Vikings season last year and have actually won NFL championships. While the Packers do have their issues, I will take them and Rodgers any day over Peterson and the Vikes.

  67. HAHAHA, how does something that happened over 20 years ago affect the Vikings team today. IT DOESNT! I love how people try to reach at anything to troll. Hey Packer fans, hows that karma from Rodgers not paying his debt treating your team TODAY!?

  68. I’m not arguing I’m simply sticking up for the team I love regardless of whether or not they have won a championship. It’s just a shame packers fans can’t stick to their own sites and they have to resort to trolling Vikings articles. You all talk about how classless we are but hey I get it. Enjoy your time reading our articles and talking team.

Big deal. I’m sure there are a lot of Packer owners who have done a lot worse than this.

Name one. You have nearly 365,000 to choose from. Just name one.

Well Packer “owners” just remember you okay’d this guy when he bought the team — even with the lawsuit going on. So I’m assuming you were all of aware of it because you’re all so tuned in as “owners” — I’m guessing since it was okay then, it should be ok now…

Maybe one of your closest friends can share this with you……(desperation has an odor.)

OH really? Seriously get over yourselves..ever read a Packer article? It usually had the most hits and most of the negative,jr high remarks are from Viking fans…hello pot..meet kettle..jeez

All of you fake stock holders across the Mississippi can kick your feet up and pollute your britches with joy because you don’t have a crook owner for your team.

How can it be fake if I’m holding it in my hand?

Packer fans should really be more concerned about Bulaga………. and Jordy?

We got it covered. Next man up.

The NFL is contemplating punishing the Vikings by stripping them of all their participant ribbons.

Have someone literate read it for you, especially the small print. Pssst… it’s not real stock

  77. Wisconsin is the arm pit of Minnesota… say what you want about the vikes, but the great state of Minnesota is and always will be superior..

  78. No surprise. They are currently cheating the people of MN out of millions of dollars on another real estate venture. Enjoy your shiny new stadium, Billionaires, some of us work for a living.

  79. Now that was uncalled for filthy saying viking fans are scumbags, you packer fans and others bashing the viking fans so not classy, and for saying viking fans only went to the 5th grade I graduated from high school.
Its also sad that this happened over 21 years ago and you think like others are saying it will not affect the players.
I am sure everyone has a past. I am not sure why this had to become public knowledge. It has nothing to do with football.

  80. And the Vikings do have an NFL Championship. So when the Packer fans say they have 13 championships and the Vikings have none, they are wrong. Superbowls, they have none. Championships they have 1.

  81. I’m a Packer fan, but the way some of you post you’d think the Packers were perfect. Let’s see:

    Purple Drank Jolly
Picking up Koren Robinson awaiting DUI charges
    Drafting Tyrone “Drive By” Williams
    Leshon Johnson and his pitbulls
Mossy Cade, Charles Martin, Eddy Lee Ivery, and James Lofton all accused of assault in a short span in the 80’s
    American Chewie
Brandon Underwood and the “escorts” at the cabin
    Havner crashing his motorcycle drunk
    Marco Rivera DUI
    Philbin’s kid’s assault
Chris Jacke hitting on Holmgren’s underage daughter and being cut loose
    Ahman Green domestic abuse
    Al Harris strip club problems
    Eric Walden domestic abuse

That’s just off the top my head. I have no idea who was actually convicted of what.

  82. @ judsonjr

As a Viking fan I appreciate your attempt to put people in their place. I would be the first to do so as far as Viking fans are concerned if they warrant it. The fact is, if people would concentrate on talking about football instead of making crap up or just talking smack, these sites would be a lot more fun to be in.

I don’t mind the occasional smack talk after a game but to trash any fans because of what someone on the team does is truly ridiculous as far as I’m concerned.

  83. As a Viking fan from Oregon I have never liked Ziggy (however you spell his name) after the horrible way he fired Mike Tice on live TV. But these rich Bastards are all the same… take take take.
