Judge finds that the Wilfs committed civil fraud and racketeering, more than 21 years ago

At a time when Browns owner Jimmy Haslam faces criminal and civil allegations of fraud, a judge in New Jersey has found that Vikings owners Zygi and Mark Wilf actually committed civil fraud — more than two decades ago.

According to Ben Horowitz of the Newark Star-Ledger, Judge Deanne Wilson summarized on Monday her findings regarding a 21-year-old lawsuit that culminated in a two-year trial.

“To my knowledge, there has never been a case like this in New Jersey jurisprudence,” Judge Wilson said. “We try to move cases along. There is no reason in the world for a case to be tried 20 years after it was filed.”

She delayed her retirement to resolve the case, which still isn’t resolved.  In two weeks Judge Wilson will provide details and list damages.  For now, she found that the Wilfs and their cousin, Leonard, liable for fraud, breach of contract, and breach of fiduciary duty.  She also found that they violated the New Jersey civil racketeering statute.

The case arose from claims that the Wilfs cheated their business partners out of revenues from Rachel Gardens, a 764-unit apartment facility in Montville, New Jersey.  Judge Wilson concluded that the Wilfs engaged in “organized-crime-type activities” in the bookkeeping practices that resulted in the Wilfs making more money than they should have.

The plaintiffs, Ada Reichmann and her brother, Josef Halpern, will receive compensatory damages, punitive damages, treble damages, a redistribution of revenues dating back to 1992, and reimbursement for their attorneys’ fees.

Judge Wilson pointed to the testimony of Zygi Wilf as evidence of “bad faith and evil motive,” and that Wilf admitted that he believed Reichmann got “too good a deal” and “reneged” on the original arrangement that had been made in the 1980s, by Zygi Wilf’s uncle, Harry Wilf.

“The Wilf family has been in business for 58 years and has earned a well-deserved reputation for integrity and honest dealings,” their lawyer, Shep Guryan, told the Star-Ledger.  “As with many businesses, disputes occasionally arise, and since we are currently in the midst of a legal process to resolve this civil lawsuit, we must decline further comment.”

Appeals surely will follow, and the process undoubtedly will continue for at least another year or two.

For now, the key point is that a judge has found that the Wilfs engaged in the same kind of behavior that has Jimmy Haslam currently sweating out a federal indictment.  The best news for the Wilfs is that the statutes of limitations for any potential criminal charges have likely long since expired.

    Something tells me that could get expensive for the Wilfs. 21 years of damages with interest, punitive damages, treble damages (which is just a 3x multiplier), and 21 years of attorney’s fees.

    Yikes.

    I wonder what impact this will have on the Vikings and their stadium. I know the recent stories from the StarTribune state that the expected revenues from the lottery and now also the “e-gambling” haven’t gone well. It looks like the state is going to have to raise taxes to pay for their part – are the Wilfs going to be able to front their part?

    Nothing against the Vikings team but the NFL ought to get involved in this – seems like these owners have a lot of explaining to do — the NFL doesn’t seem to have done a very good job in the owners background checks. I think maybe the same thing that happened to the 49ers owners should come into play here. Wouldn’t want to tarnish ‘The Shield’ by having owners with mobster like backgrounds.

    But most Vikings fans could care less if the owners committed fraud 21 years ago. What is the NFL going to cancel the team? Are the players going to stop trying? Will the coaches quit?

    What do people expect, this is the Vikings, they are the masters of the pillaging and plundering of others.     Rush was declared ineligble for owership of an NFL franchise because he vocalized what most people thought, but didn’t have the balls to say.
    Donovan McNabb was given more hype because the NFL wanted there to be more successful black QB’s, not because his play warranted it.
    I didn’t and don’t agree with his opinion, but that’s effectively what got him black-balled from NFL ownership.
    As for the Wilfs, I could care less what they do or don’t do in their business dealings on the east coast. So long as they play by the rules with the Vikings.

As far as the action on the field is concerned, Bulaga’s season-ending injury is a far bigger problem for GB than the Wilfs’ NJ case is for Minnesota. Last time I checked, the Wilf family doesn’t block, tackle, or catch passes. Rodgers will be running for his life this year (already the most-sacked QB over the past 4 years). Advantage: Vikings

    jrmbadger, the answer to your final question is a resounding yes. The Wilfs will easily be able to pony up the almost $500 million dollars they are responsible for. The rest, e-pull tabs, which are falling very short, is the state’s responsibility.

    Poking fun at a Vikings fan for the state’s shortcomings, although easy to find, has nothing to do with football. The new stadium is law, it will be built, and thanks to the G3 stadium fund, you are helping the Wilfs build it.

    In the meantime, if you would like me to, I can contact one of my local legislators. I’ll tell him or her some guy, likely from Wisconsin is concerned with the Stadium finance shortcomings. I’ll let you know what they have to say.

    What matters in the context of this site is who they have been as owners of an NFL team, and they have been outstanding. I’d take the Wilfs, with a few skeletons in their closet, over a 100% clean rap sheet McCombs any day.

    Pack fans need to focus on understanding how lucky they are for the NFL to allow them to be the only team to get a pass on how ownership in the NFL works, as a business they didn’t have to do that, they could have broken that up years ago. Don’t make fun of other teams because they can’t do something they were never allowed to do in the first place. Please try harder at exuding the class you think your fanbase is known for, it doesn’t show around here.

    Jbuck, you are wasting your time trying to be civil on this board. Read the comments section about Bulaga’s injury. 90% of the posts by Vikes fans are wishing Bulaga a quick recovery, but of course there is the 10%.

    Next read the comments section of pretty much any Vikings article. 90% of the Pack fans posts are repetitive, snide, a-hole remarks. About 10% of them are constructive well thought out posts.

    Most of the Pack fan base posting on this site seems to think that they are “Packers”, and they have a sense of accomplishment for cheering for a football team. My theory is that they have a bad case of little man’s complex, and if you have spent anytime in that state, you would probably understand why.

More than last year. … your qb gets sacked more than just about any qb in the league. Your offensive line needs help but they put all thier eggs I’m Rodgers basket in hopes he can over shadow a poor line. I just keep it real man. I’m not saying my Vikings are the best team ever but they have a more solid well rounded team this year than the packers do. Yeah we have an unproven Qb but he has only played a year and a half of football. Remember where your qb was the first few years he was In the nfl. ….. riding the bench and learning.     Arguing that the vikes will beat the Packers is an opinion, not a fact. The only facts in hand are that the Packers ended the Vikings season last year and have actually won NFL championships. While the Packers do have their issues, I will take them and Rodgers any day over Peterson and the Vikes.

    As a Viking fan I appreciate your attempt to put people in their place. I would be the first to do so as far as Viking fans are concerned if they warrant it. The fact is, if people would concentrate on talking about football instead of making crap up or just talking smack, these sites would be a lot more fun to be in.

    I don’t mind the occasional smack talk after a game but to trash any fans because of what someone on the team does is truly ridiculous as far as I’m concerned.
