Niners acknowledge Aldon Smith lawsuit, have no comment

On Tuesday, 49ers linebacker Aldon Smith and former 49ers (now Titans) tight end Delanie Walker landed on the wrong side of a lawsuit alleging that they instigated a crossfire at a party that resulted in two men being shot.

Predictably, neither team has much to say about the situation.

“The 49ers organization has been aware of this matter concerning Aldon Smith for some time,” 49ers G.M. Trent Baalke said in a statement issued to PFT.  “We will continue to monitor the situation closely, but will have no further comment at this time, as this is an ongoing legal matter.”

The Titans had no comment, and the league office has said it is looking into the matter.

No criminal charges were filed, possibly because it will be difficult if not impossible to identify the shooter.  Still, the lawsuit alleges that guns were possessed and fired illegally by Smith and Walker; if true, criminal charges unrelated to the firing of the bullet(s) that hit the plaintiff could easily be pursued.

    It was pointed out elsewhere that the police investigation cleared Aldon of any wrongdoing in the party after he was stabbed and two others were shot. So either the story has some hint of BS on it or someone in on the investigation team REALLY blundered.

    Since I found the answer as to why it would take over a year this story brings on another question. Like where is the other shooting victim? Why is this person not involved here either? Also I just find it odd that the lawsuit was filed Tuesday. I feel like the lawsuit was going to happen regardless but the Lawyer decided to wait until a time that would maximize the money he gets out of the two.

    Probably didn’t do the Super Bowl because the Crabtree accuser beat him to the punch. And who knows was probably going to wait until after the super bowl but then the Delanie’s Aunt and Uncle were killed by the drunk driver which would have made him look more sympathetic in the eyes of a civil suit jury?

    So true or not I think the lawyer might have been smart and waited until a few days before the start of the next season knowing that true or not Aldon and Delanie would be more prone to pay up now? I mean now the games for 2013 begin to count so an athlete is likely to settle to end the distraction.

    I smell bs. According to lawsuit, bullets were flying everywhere and no police were called? I’m sure Aldon lives in decent neighborhood and no one called the police. Also, you get hit with “crossfire” and you dont dial 911 for an ambulance???

    No police report, no ambulance, NO ONE DIALING 911. The lawsuit smells fishy.

    eastcoastniner the cops had to have been called if there was a police investigation. And if someone is stabbed at a party let alone one stabbing and two shots fired the cops had to have been called.

    Also to bring more to the long post I made earlier the story coming out now not only gives more incentive to pay up to end it but also if the accusations are true and they still have said handguns then it would be in their best interest to kill the story before anything incriminating comes out that would lead to a Plaxico situation.

    Delanie just got a big contract and Aldon is on pace for a big contract so you know it’s in their best interest to settle out of court now.

    This sounds like a money grab to me. In this day and age no one has video of this going on. I’m sure someone would have come forward before. Aldon lives in the same affluent hills that Alex Smith did. Many Judges, Attorneys, Doctors live on the same streets. If bullets were flying, Aldon would have been arrested. One of the crappy things about this country is that ANYONE can be named in a lawsuit. I’m sure it will be settled out of court to keep this quite. Happens everyday.

    The DUI alone ok you made a mistake. The instigating a shootout alone probably a extortion attempt.

    Put them together and things are starting to add up that maybe Aldon Smith has some character issues. We’ll have to keep watching to see if he stays out of trouble. Aaron Hernandez 2.0?

    This guy just lives in the perpetual “gray area”. He’s been accused — and his name has been brought up — in numerous other things but he always manages to avoid any conviction. Either somebody really has it out for this guy….he has extremely good lawyers or is just plain lucky.

    Didn’t Alex live in Los Gatos? I believe Aldon lives on the eastside. Obviously not in the little Vietnam part but also not in the best part of San Jose.

    Why is it so hard to figure out that just because it’s legal, the NFL automatically allows it. The league can ban whatever it wants whether or not it’s legal. It’s a business not some sort of god (gov) given right. Get a clue…

    The bogus money grab lawsuit aside, what legs do the seekawks trolls have to stand on. So the same “Greatness” Harbaugh inherited was something Mike Singletary could only get 8-8 & 6-10 out of.

    Fact is that every organization he has coached has improved upon his arrival (USD, Stanford, 49ers). Unlike sleaze bags like Pete Carroll who bolted from USC in order to avoid an NCAA investigation and left his players out to dry.

    When pot was legalized in Colorado the NFL said that even though it was legal in Colorado it is still a banned substance so everyone who has a positive test for weed is subject to a violation of the drug policy. If that weren’t the case every pothead who is talented would take a paycut to go to denver pre-Peyton.

    Alex bought a home in Los Gatos when he got married. I believe initially he lived up Quimby Rd near the Eastridge Mall. Yes it is East San Jose but there are many multi-million dollar homes on that hill. Everything from Ruby Rd up is big money. I know the area well, my grandfather owned 55 acres of walnut orchards on that hill for 40 years.

    I love how the Seahawk fans can’t wait to chime in! It’s like the fans up there in cloudy Seattle have nothing better to do than hate and troll on the 49ers. Must be raining haterade again. Last I checked, Aldon and Delanie were never found guilty of any wrong doing or even detained by police. I believe they are innocent until proven guilty…as all respectful Americans should.

    I just love the FACT that the Seahawks have NEVER won a Superbowl and it drives their “fans” insane. We have the better teams in Cali and the weather is fantastic all year long. You Seattle fans should put all your hateful efforts into something positive. Maybe, work on getting an NBA team…again. Oh yeah, Sacramento took that possibility away from them as well. The city of Seattle is cool, I must say…for a short vacation.

    Uh, Harbaugh was the one who convened the Niners to move up in the second round to draft Colin Kaepernick a few years ago. he then alled his dad that night and said he drafted the best player in the draft. Is there some sort of NFL history school we can send Seahawk fans to?

    Bad stuff happens to every team out there. We should just focus on what happens on the field, since everything else is unpredictable. Week 2 is what we should all be looking forward to.

    this guy was stabbed by people at his house, I know id be popping off some rounds to get these people to leave. this was something that happened last year, im pretty sure if aldon had been recklessly shooting at people, we would have heard of it by now, obviously a money grab. but we all are aware you Seahawks fans got your fingers crossed.

    Are you serious? Have you ever been to Cali?? I’m from the Bay. I went to school in San Luis Obispo while taking winter off to work in Lake Tahoe @ Heavenly. After school I moved to San Diego for a position with Gallo Wine. Now I’m back in the Bay because I love the diversity… Cali is great! I would rather live in any of those places than any place in Washington state. Not to mention cities like Malibu, Newport Beach, Santa Barbara even SF. Next time think before you type. Oh yeah, I love how all the women in Washington are covered up with big jackets and sweaters 85% of the time. Give this guy Cali where the women like to show off what they have…any day!

    Oh man, you live in Ohio. Well I would much rather live in Washington over Ohio. Lebron had the right idea getting out of that state. Not trying to bash Ohio, I had to catch a connecting flight there once. Back in the day I also watched Cops on TV, they were always in Ohio.     WHAT??? You were the one speaking in absolutes about Cali only being worth a short visit…so you say. I was speaking about Washington state at first. Which I have been to half a dozen times. My wife is a chef and she does like the city of Seattle and its nightlife. You are correct I have not spent much time in Ohio nor do I have any desire to make it a vacation destination.
