Aldon Smith faces felony weapons charges from June 2012 party

Aldon Smith’s legal problems just got a lot worse.

Already facing fresh DUI charges along with a lawsuit arising from an alleged shooting that occurred at his house in June 2012, Smith now faces criminal charges relating to the shooting.

According to NBCBayArea.com, prosecutors in Santa Clara County have filed three felony charges for possession of assault weapons against Smith.

Smith was stabbed at the party.  He and former 49ers tight end Delanie Walker have been named in the two lawsuits filed by alleged victims of the shooting.  They are not accused in the civil lawsuits of firing the shots, but of instigating the shootings.

Smith remains on indefinite leave from the 49ers, more than two weeks after entering in-patient rehab for substance abuse.

  1. Wonder if Harbaugh would rather he had just taken some adderall instead of being a felon involved in 7 am drunken driving, hoarding assault weapons illegally, and being involved in shootings/stabbings?

  4. Given the controversy about “Assault weapons”, I doubt there is much to this. If he could stop breaking the law and driving drunk, he would be fine.

  5. You are already a successful famous millionaire superstar athlete. Where does this desire to be a “gangster” for these guys come from?

    I know he is getting help for his issues now but he needs to be punished legally like an average person would be in this situation. Little Jimmy Harbaugh can’t talk about the integrity of any team when his is a mess.

    I couldn’t agree more. Harbaugh, who normally does his best to avoid the media, had a lot to say about the Seahawks. He hasn’t been as vocal concerning Aldon Smith and this situation.

    Aldon will be best served doing his time, treating his alcoholic demons and healing on all fronts

  10. I mean at the same time I don’t think charges from a party that the team found out about last year should get him cut.

    At the same time I do think Roger should suspend him the rest of the year to set an example to players.

    But it is not within his constitutional rights to fire those firearms into the air as he is alleged to have done. What goes up, must come down. Had those bullets come down on a person he’d have been Aaron Hernandez before Aaron Hernandez.

    With filing a year after the fact by publicity hungry DA’s, felonies have a way of being pled down to misdemeanors… with a good lawyer.

    The bigger issue: is this kid ever going to grow up? It was known that he was immature at Mizzou coming out for the draft. Hanging out with the wrong crowd seems to be at work here (along with the two DUIs, he was also in a solo traffic accident where a friend-the driver-got hurt). A pattern of reckless behavior is well established and undeniable.

    Where’s his parents/family in all of this?

    As far as his NFL future is concerned, the main questions are when and how long Goodell will suspend him for. Hopefully, Smith will get his life straightened out by then. As long as he doesn’t pull a Hernandez, he’ll get another chance to sack a QB, if he doesn’t sack himself first.

  14. I think I’ve come to the realization that the majority of professional athletes are just bad guys. Obviously I know that’s not really true, but it sure does feel that way. When they are on the field, the fact that most of them are some sort of criminal, but when they are put on the pre and post-game shows, I can’t take it anymore and won’t watch.

    Ray Lewis, Warren Sapp, Deion, Michael Irvin….seriously, can’t we enforce passing a successful background check before we decide to put these guys all over our TV?

    Probably time to let Aldon Smith go when he comes out of rehab. This is by no means over. What a great ‘ad’ being a felon 3 times. It’s easy to blame it on the booze and the pills I suppose.

  20. Aldon Smith will be back on the roster after the bye week. Book it. He’ll probably be discharged from rehab while the team is in London, surrender, make bail, then the legal system runs its course. He’ll have about 10 days to work back into playing shape.

    He’ll get popped big by Sheriff Goodell eventually . . . it just won’t be this year.
