L.A. district attorney refers Aldon Smith case to city attorney


The case of Aldon Smith’s fake bomb threat is being passed around like a real hot potato.

First, LAX police gave the file to the LAPD Criminal Conspiracy Unit.  Now, the L.A. County district attorney’s office has punted the prosecution to the L.A. city attorney.

According to the Associated Press, the case has been sent from the county D.A. to the city D.A. for “misdemeanor consideration.”  That’s good news for Smith, who previously was facing a potential felony charge.

There’s a chance Smith ultimately faces no prosecution at all, if the powers-that-be decide he was making a really dumb joke.  But if they decide to deter non-celebrities from making similarly dumb jokes in an airport security line, they should consider pushing the issue.

    I wonder if it would be considered a misdemeanor if a normal citizen and not an NFL player would have attempted something like this?

    Aldon Smith is obviously not a threat to national security.

    He was just making a joke.

    As I’ve said before, as a rich celebrity he will not face consequences for an act that you or I would do jail time for. Makes an American proud.

    100% sure there will be no prosecution. just a bunch of uptight people overreacting to an obvious joke.

    An obvious joke. Huh. To me it is obvious that a person with anything resembling good judgement would not make a joke about a having a bomb in an airport to airport security/the police.
    I guess I’m uptight.

    Doubt it was a joke, just Aldon being a jerk.
    But there are laws against saying you have a bomb in an airport, and being a jerk is not a defense.

    How much longer of a leash is this guy gonna get? He is on a fast track to doing permanent harm to himself (or worse, someone else) yet no one apparently has the stones to step in and do anything about it.

    That is pretty standard and is not punting. In Los Angeles the District Attorney handles felonies and the City Attorney handles misdemeanors.
