Kluwe to sue Vikings

In a press conference that likely will have begun by the time I press “publish” on this post, former Vikings punter Chris Kluwe will announce that he plans to sue the Vikings as a result of the team’s failure to make public the report of the investigation regarding his claim of homophobic comments and a discriminatory animus against Kluwe when he was cut last year.

“It’s transparently obvious to me that the Vikings are covering up the truth,” Kluwe’s attorney, Clayton Halunen, told KFAN.  “We have no choice but to litigate at this point.  Kluwe willingly cooperated with the Vikings’ investigation — all he ever wanted was for the truth to come out.”

“It’s outrageous to me that the Vikings would choose to hide the facts of the investigation from me and from their fans,” Kluwe added.  “Minnesota Vikings fans are the real losers in this sad affair.  The fans deserve to know that what I said about Priefer and the way the Vikings let me go was the truth.  I was persecuted and then fired for standing up for what I believe in, all because some small-minded, bigoted people think that homophobia is OK in the NFL. It is not OK, and now it seems like we’ll have to go to court to force the Vikings to admit that.”

Going to court will introduce plenty of other angles and complications into the situation, possibly leading to one or more unintended outcomes.  Kluwe presumably understands that.  If doesn’t know it now, he inevitably will.

    so sick of this story and now it will go into the next season as a distraction to our front office at least. We will lose a head coach, for sharing an opinion. Maybe a little insensitive to some.

    Only a punter would get sucked into this over litigation nation of PC witch hunts and looking to BLAME anyone for something happening to him.

    Saw this coming a while back didn’t we? We already knew the results of the investigation, conducted by outsiders although set up by the Vikes, were going to favor Kluwe. PFT prepped us on that a while back. Apparently so much so that the Vikes are afraid to come clean on it. It’s ironic that they didn’t even have to go the abuse route, since he was old and about to get beaten out by a cheaper, younger and better player anyways. Bad calls by the Vikings all the way around and now they’re going to pay for them.

    First, under many aspects of MN employment law, personnel investigations must remain private. This is a private employment investigation, and even if Priefer is a bigot, he still has confidentiality rights as an employee. Like any employment setting, if the investigation proved wrongful acts, the Vikes will likely discipline the guy privately.

    Second, Kluwe’s claim of adverse employment action lacks not only a strong legal basis, but a proper factual application to the law. Priefer is probably a bigot, and said dumb crap, but Kluwe’e contract was up and he wasn’t renewed because they found a cheaper, younger, better punter — an every day occurrence in the NFL. He was paid and didn’t lose his job while his contract was valid. Looks like we’ll have to endure another round of Kluwe and his attorney howling at the moon.

    So, perhaps the report that is coming out this Thursday must not be to Kluwe’s liking. They just won’t play his game and he doesn’t like it.

    Earlier today from the Vikings:

    “As Magnuson and Madel confirmed today, the Vikings have never made or broken promises as Kluwe and his attorney Clayton Halunen have claimed. The Vikings have also never engaged in the various comments that Kluwe and Halunen have provided to the media over the past six months. This Thursday, July 17, the team has a meeting scheduled between Halunen and Vikings attorneys to discuss next steps

    As we have consistently communicated throughout this process, the Vikings will have further comment when the investigation is entirely complete and the team has made determinations on next steps.”

    Eden Prairie, MN (July 15, 2014) – Since Chris Kluwe’s allegations first appeared in Deadspin on January 2, 2014, the Minnesota Vikings have taken them very seriously, which is why the team immediately retained former Chief Justice of the Minnesota Supreme Court Eric Magnuson and former U.S. Department of Justice Trial Attorney Chris Madel, two partners of Robins, Kaplan, Miller & Ciresi, L.L.P. (RKMC), to perform an independent review of these allegations. Magnuson and Madel were asked to thoroughly and comprehensively investigate three particular allegations by Kluwe and Kluwe’s counsel:

    As Magnuson and Madel confirmed today, the Vikings have never made or broken promises as Kluwe and his attorney Clayton Halunen have claimed.     I’m not sure if innuendo is the correct word, but it’s possible that Kluwe’s phone and text conversations with in-the-closet gay NFL players would be revealed during a trial (assuming such conversations exist), or at the very least texts involving some VERY unflattering comments about some of his former teammates.

    He’s not calling the fans “losers” in general, he’s merely saying they are taking a forced loss of enlightenment of truth with regard to his allegations of the way things truly were. That may not hold a lot of value with some people, but it’s still something that individuals have a right to and Kluwe has a passionate conviction about restoring that for all because it’s the right thing to do. Let’s see what truths come out of this case and if there is indeed a benefit on the horizon as Kluwe sees.

    So, I assume if he sues the Vikings, the Oakland Raider coaching staff/front office will be drawn into testify since Kluwe’s point is he got fired for his off the field stance and not his performance.

    So basically Kluwe is going to F-Up anyone and everyone over his lost paychecks.

    What’s next? Sue every NFL team for not returning his agents calls? I hope he’s ready for the counter-suits that will follow if he’s unsuccessful, then again…he’ll probably hide in bankruptcy to avoid any judgement against him.

    Either way, you know Kluwe relishes in the attention…….something he so desperately craved all these years…..who knows, this might launch his reality tv show.

    Kluwe is going to have a really hard time proving this.

    #1 The Vikings had already set precedent a couple years prior when they drafted BWalsh and then cut Longwell a couple days later. They just followed the same procedure after drafting JLocke.

    #2 Locke (2013) and Kluwe (2012) had similar numbers, however Locke was 1 million a year cheaper.

    #3 Kluwe was signed by the Raiders and cut before the season started, so the argument that he wasn’t up to scratch with performance was confirmed by a team other than the Vikings.

    #4 The Vikings had already set precedent when Kluwe was a loud advocate prior to this particular case. They hadn’t cut him then.

    #5 Interestingly enough, even if he can prove that they fired him because of his advocacy, he admitted that the coaches had already asked him to tone it down because he was acting in a manner that wasn’t consistent with the team’s beliefs of trying to stay out of the political arena. They are allowed to ask him that, as he was representing them as well as himself. So the fact that he didn’t could be construed as insubordination. Which is an offense that can result in termination.

    How exactly is he going to win this case?

    Kluwe has nothing to lose going forward and everything to gain.

    Once it goes into court this scandal will fester and surface every couple of months every time there is a development in the case.

    The vikings are playing this all wrong.

    A closed case is won’t affect the rest of the NFL.

    Eventually other owners are going to force the vikings to release the report in order to keep this a viking problem and not an NFL problem.

How about the punt coverage teams having to cover line drive kicks and kicks with no hang time? These folks were persecuted by Kluwe’s declining focus and skills.

    I don’t know if the Vikings need more whistle blowers, but I know they don’t need anymore bad punts that come with political excuses. You are gone because you thought didn’t have to earn the right to stay.

    When he loses this case and is forced to cover the legal costs for the Vikings as well – it will be interesting to see what happens then.

    I agree with much of what he talked about – I do NOT agree that he was fired over it or that he is part of some protected class and can’t be fired over it.

    I hope the Vikings can turn the tables on this guy. Only one indoor punter had a worse average and net in 2012 (Nick Harris) and he also lost his job. If a guy punts indoors for at least half of his games and is not in the top 50% in stats, he is not good, and any team in that situation would try to replace him.

    We all know that in the NFL it most often does not matter what you do or what you say, it’s the production on the field. Enough guys with criminal records are around that it makes it laughable to think that had this guy been able to punt that he would be out of a job because of his views. We all know that if he could punt he would have a job.

    Here’s what I don’t get about this whole thing.

    When the Ravens beat the Patriots in January of 2013 to advance to the Super Bowl, the first thing that Brendan Ayandbadejo says is something to the effect of, “great, I can go to New Orleans now and get the message of gay rights to a broader audience.” Huh?

    As a Ravens fan, I had a real problem with that. Your team just won the AFC Championship and is going to the Super Bowl, and all you want is to get gay rights to a broader audience? Here’s a crazy idea…why don’t you concentrate on trying to, you know, win a SUPER BOWL!

    Mind you, I have no problem with gay rights. To each his/her own, but a football team should be 47 guys working together for a common goal. That goal is NOT the furthering of gay rights, gun rights, class rights, etc… If it’s anything other than about football – especially when your team is going to the Super Bowl – then it doesn’t belong in the locker room.

    Kluwe is just like Ayanbadejo. He want to use the NFL as a pulpit to advance an agenda. I gotta tell ya, if I was a coach I’d have fired him.
