Aldon Smith sentencing hearing happens today

Smith Getty Images

In the legal system, delays happen almost all the time.  Rarely do things occur more quickly than scheduled.

Things will happen more quickly than scheduled for 49ers linebacker Aldon Smith.  His sentencing hearing has been moved from Friday, July 25 to Friday, July 18.

Via Cam Inman of the Bay Area News Group, Smith will receive the good news or bad news or good news/bad news at 4:30 p.m. ET.

In May, Smith pleaded no contest to a trio of felony weapons charges and a misdemeanor count of DUI.  Even if he avoids jail time, the NFL undoubtedly will take action, most likely suspending him under the personal conduct policy for one or more games to start the season.

The expedited sentencing process gives the league more time to reach a conclusion before Week One.  The decision will be influenced in part by the sentence that Smith receives.

If Aldon Smith was on the Seahawks roster…

He would easily be the classiest guy.

    Above Reproach.

  3. vincelombardisghost says: Jul 18, 2014 3:35 PM

Poet. Why so snarky? But, I guess if I was a Vikings fan, I’d be jealous of the Seahawks (and the 13 time World Champion Green Bay Packers).

    Dude is a head case

  5. mcmccii says: Jul 18, 2014 3:37 PM

This idiot should be kicked out of the league before they have another Aaron Hernandez on their hands.

Its the first time PFTPoet had more thumbs up than down for a post.

He never said the word bomb.
    He purchased his weapons legally.
    He’s averages a sack every game; you’re jealous ;)

  8. kd75 says: Jul 18, 2014 3:41 PM

I know a dude facing serious time in Federal prison.

He had his sentencing delayed twice.

  9. icallbs81 says: Jul 18, 2014 3:43 PM

Florio should be outside the courtroom interviewing people like on the People’s Court.

  10. schmitty2 says: Jul 18, 2014 3:43 PM

Based on how this criminal system works when it comes to pro athletes he will probably get 20 hours of community service and a 250 dollar fine. If it was you or I that had done it we would be in jail for 25 years to life with chance of parole in 15 years.

  11. sjsuguy says: Jul 18, 2014 3:45 PM

Its probably be 4-6 games. As long as he comes back for the playoffs they should be fine. They went undefeated when he was out last season.

  12. tap79 says: Jul 18, 2014 3:47 PM

If you or I did half the stuff Smith has done then we would be sitting our happy butt in federal prison.. Bottom line the guy belongs behind bars but I am sure the SF front office will pay a pretty penny to make this go away….. Just like they did with Rapernicks molestation charges.

  13. davebgovikes says: Jul 18, 2014 3:47 PM

Not sure about the rest of you but as long as PFT poet doesn’t have a top 5 list associated with his comment I am happy…..I am from MN and don’t worry not all of us are morons or think that the Vikes are any good. Captain and Xavier top 5 CB, Kyle Rudolph top TE and who can forget Patterson and Jennings both in top 10 WR. Embarassing for me to live in MN when I see those posts…

  14. themilliondollarbackfield says: Jul 18, 2014 3:48 PM

He was stabbed at his home, and he fired a shot in the air because they wouldn’t leave his home. He deserves to be free

  15. RegisHawk says: Jul 18, 2014 3:52 PM

If Aldon Smith was on the Seahawks roster…

He probably would have come from the Vikings and be looking to start with a winner.

  16. tap79 says: Jul 18, 2014 3:56 PM

Smith deserves to be prison. If he gets out then it is a failure of our justice system hands down and proves that the rich elite can do whatever they want.

Kind of surprised that with all the libs in SF screaming about equality they would let something like this just slide……….. I guess its cool if it is one of their own that is a criminal.

  17. humb0lt says: Jul 18, 2014 3:56 PM

A knucklehead on a team led by a knucklehead (Kaepernick) and coached by a knucklehead.

GOOD! Justice should be swift. Whether for good ill, defendants shouldn’t be left hanging.

  19. cri33 says: Jul 18, 2014 4:03 PM

themilliondollarbackfield ..you’re so funny. Smith didn’t say he had a bomb. He said “I have a device that is going to go boom”. Haha. Well maybe his contract will also explode.

  22. skytzo425 says: Jul 18, 2014 4:12 PM

Milliondollarbackfield The fact that assault rifles are illegal in California makes your claim ludicrous. He did say the word bomb and he also shot someone at his home after shooting an assault rifle in the air. The guy deserves prison and the fact he’s still on the Vaginers roster is despicable.

  23. lutch57 says: Jul 18, 2014 4:12 PM

Charges will be reduced and he’ll get probation. Usually what happens in cases like this. Stop getting excited spastic Seahawk fans he’s not going to jail or getting suspended.

  24. hackphx says: Jul 18, 2014 4:17 PM

Early sentencing is for the convenience of reporting to camp and fits with a scenario of probation/community service. Hopefully, Smith’s knucklehead days are behind him. His misadventures have more of a tone of stupid choices than meanness. Still, the NFL is committed to reduce the shenanigans and will go 6-8 games,…but he’ll get credit for his 5 week 49er induced rehab. Net 2-3 games with some stern talk.

  25. lutch57 says: Jul 18, 2014 4:20 PM

skytzo4251 – Aldon Smith is a boy scout compared to Marshawn Lynch who ran over and nearly killed a lady drunk at 3am. 2 DUIs, 2 different sets of weapons charges in two different states. Suspended only three games. Also Aldon Smith did not shoot anyone….

  26. lutch57 says: Jul 18, 2014 4:22 PM

Aldon Smith has missed five games for all this already. He was not charged in the airport incident. Considering Marshawn Lynch was suspended only 3 games for nearly killing a lady drunk at 3am running her over with his car. 2 DUIs, 2 different sets of weapons charges in two different states. Smith should not get suspended.

  27. trollhammer20 says: Jul 18, 2014 4:24 PM

It was moved up because, surprise, surprise, the judge has a tee time next Friday at Pebble Beach, playing a foursome with Jed York, Baalke, and Harbaugh.

  28. senoreno says: Jul 18, 2014 4:27 PM

pedhawk fans wishful thinking is more like mindless dreaming..

I guess harbs could encourage his team to be below reproach like pharmacists pete, with his league leading ped suspensions since 2011.

    cheers!

  29. nypd1056 says: Jul 18, 2014 4:28 PM

    He purchased his weapons legally.

I guess then by NRA standards he must be a RESPONSIBLE GUN OWNER

  30. norcalmafia says: Jul 18, 2014 4:30 PM

And yet, he is being sentenced on 3 felony gun charges and a DWI. You’re not making much of a case my friend.

Actually the lady only had a few stitches. The charge was reduced to a misdemeanor and a fine of 100 dollars.
He only had one weapons charge, also reduced to a misdemeanor…
And the last DUI, was pled down to a misdemeanor…

So Marshawn basically had the equivalent of 3 tickets.

Aldon’s last DUI included crashing his vehicle into a tree… he is lucky it wasn’t a pedestrian.

That charge alone should net him 6 months in jail.

We’ll see what happens. We all know athletes tend to have easier sentences.

Aldon Smith could never be on the Vikings. They are the class of the NFL. They are above reproach. They invented the game as you know it. They are the most historic franchise in all of sports. Every player on their team has been selected for knighthood. They save puppies from fires and kittens from trees. Your 17 time defending Super Bowl champion Vikings.

  37. lutch57 says: Jul 18, 2014 4:59 PM

snoqualmkanem – huh? Marshawn Lynch ran over a lady at 3am. He was convicted of two dif sets of weapons charges in two dif states. Aldon Smith was lucky he didnt hit a pedestrian? Marshawn Lynch did at 3am….blacked out drunk. At least Aldon attempted to sleep it off.

You realize Aldons DUI was reduced to a misdemeanor but “In 2008, Lynch pled guilty to a felony hit-and-run accident in Buffalo where he struck a person with his vehicle.” oh whoops…

    Just stop posting.

I was there too and Niner fans did a lot of talking before the game. Afterwards…

  45. sonoco says: Jul 18, 2014 5:17 PM

First, he’d need to be charged by the Feds to have a chance to land in federal prison. Second, do any of you realize that if he owned these guns and played for any team other than California or NY teams (maybe one or two others) he wouldn’t have been hit with gun charges? Splitting hairs? Yes, but it’s still against California law, but it’s not like owning three assault rifles (that could be made legal in Calif too with minor mods) is some horribly heinous crime. Some of you watch too much TV.

  46. norcalmafia says: Jul 18, 2014 5:23 PM

Bet you he doesnt even get suspended..Goodell said suspensions are not punishment but meant to give the player time to think about his actions..He voluntarily missed 5 games last year and entered rehab …He will get probation from the court and chasing Romo down week 1

  47. lutch57 says: Jul 18, 2014 5:27 PM

Seahawk fans tough on messageboards since 2013

  48. snoqualmkanem says: Jul 18, 2014 5:45 PM

My guess is a six month sentence, of which he’ll serve 30 days. The NFL suspension will be upwards of 8 games.
If 5 games didn’t work, it won’t be a shorter time frame, it will be longer.
It will also be the best thing for Aldon, he needs to get it through that he is ruining what is a great career.

  49. snoqualmkanem says: Jul 18, 2014 5:48 PM

One more thing lutch57, the hit and run in Buffalo was not alcohol related.
