Report: Police search Ray McDonald’s home

As part of a rape investigation, San Jose police have served a search warrant at the home of 49ers defensive lineman Ray McDonald, according to ABC 7.

Per the report, an adult female received treatment at a local hospital for a possible sexual assault that occurred on Tuesday.  The hospital contacted San Jose police.

The victim reportedly alleged that she was “possibly sexually assaulted.”  Based on the preliminary investigation, the alleged suspect is McDonald.

McDonald was investigated in August and September for domestic violence.  He was never charged with any crime.

Just as McDonald provided the first potential case under the then-new domestic violence and sexual assault policy, McDonald now becomes the first potential case under the new personal conduct policy.  If charged or if the league determines via an investigation that McDonald may have committed a violent crime, he’ll be suspended with pay.

With only two games left in the 2014 regular season, the team and the league soon will have the entire offseason to determine whether and to what extent McDonald should be placed on paid leave or otherwise disciplined.

    He plays for the 49ers, and isn’t a big name player. He only puts small market teams’ best players on the commish exempt list to ensure they don’t make the playoffs, which loses the NFL money. Then again, the 49ers are out of the playoffs anyways at this point, so this could be a good opportunity for the NFL to “crack down” and make themselves look objective. The league office is a farce.

    I’m mostly on board with the new policy, but doesn’t an independent NFL investigation have the potential for harming either a prosecution or defense case? Minimally, the end result of either a suspension or non suspension would taint the jury pool one way or another.

    And the criminal justice system is also strange. You don’t put out the names of the victims of these crimes, so why do you put out the names of the suspects? If a guy is innocent of a crime that bad, then just being a suspect will ruin your life. We need to respect the idea of innocent until proven guilty and stop dragging the suspects through the mud before they are convicted. And if your argument is that people should know about the suspected rapist, then he should be arrested and put behind bars because he is not a trusted part of society anymore. There is no reason to slander someone before his guilt is ascertained.

    If there’s anything I’ve learned so far about crap like this, it’s to wait until all the facts come in before jumping to judgement. This can go either way and women lie every bit as much as men. There are far too many gold digging weasels out there these days.

    Since the NFL has decided they won’t give anyone anything for time served anyways, it’s foolish to give them any.

    Hooo boy. The authorities were searching for something used in a crime. Specifically a rape. Rape tools? Date rape drugs? In any case, they got a warrant pretty quickly. That’s not a good sign.

    Still, due process; I’m not going to pile on the guy until we know more. Gotta respect the process and not jump to conclusions. NFL players/rich and famous people in general are a target for extortion and blackmail. Gotta let this one play out before condemning anyone.

    The lesson to learn here is the NFL and the 9ers had the opportunity to suspend him and take action. They decided not to, and now look what he does. What a joke.     Just like the rest of the commentators on this site I have no idea what happened. I suspect Ray has found himself in a relationship with a complete nut case who will wind up destroying his career. NASCAR driver Kurt Busch has found himself in a similar situation. I’m still waiting for the female version of the “no more” spots on TV.

    When she wakes up, realizes she doesn’t know how she got home, thinks she might have been drugged, and has evidence that sex might have occurred without her consent. And if she felt that she was drugged, and hospital tests showed the presence of drugs in her system, the first action taken by police would be to search the home and vehicle of the accused to see if they have said drugs in their possession.

    Seems pretty simple to me.

    at this point it’s still an accusation, unfortunately we live in a society where false accusations are made all the time, if he’s guilty the NFL should give a lifetime ban in addition to whatever legal penalties he may receive. The 49ers should suspend him the rest of the year ala Hardy and Peterson, and if there’s any truth to the allegations part ways.

    I think the NFL should add to the policy an out clause where if a team cuts a man for criminal acts (assault, etc…) that his salary doesn’t count against the cap at all.

    If I were the niners, I wouldn’t do any discipline at all with McDonald until all the facts come out. Innocent until proven guilty is the American way, after all. Guilty or not, you won’t get credit for any games you suspended your player from Goodell, so don’t volunteer any games to him. What the league’s policy says a penalty should be never seems to end up what the NFL decides to hand out.

    I am going to wait until a few more facts come out before I make a judgement on Ray McDonald. If you remember, a few weeks back, a lady (and I use the term loosely) made an assault accusation against Marshwn Lynch, only to find out he was in the team hotel all night long with multiple witnesses. So those of you that are piling on the poor guy need to hold your horses until there is more info. Everyone rails against the media for piling on without all the facts, and most folks here are doing the same thing.

    I think you will see a different stance from the 49ers and their fans. While this sounds like it is very new, it still does link a person of question before. Since the 49ers are out of the playoffs, I suspect they may have a harsher stance this time. Nonetheless, this one has less shadiness on questionable police involvement vs. the earlier, so I side on “get the facts” before judgement.

    To all the people who keep claiming it is impossible for someone to be uncertain if they were raped or not:

    Women today live with the reality that you can be drugged, pass out, and be sexually assaulted with little or no memory of what occurred. This is exactly what happens in the majority of rape cases, in fact.

    For further evidence of this, see Bill Cosby and Darren Sharper. Two celebrities who drugged and raped multiple women, many of whom lived with the uncertainty and shame for years before realizing it really did happen, and to a LOT of people.

    Whenever a rape is reported to police, the victim is tested to determine if drugs are present in their blood. This is because the majority of rape cases involve the drugging of victims. When blood tests show the presence of various “date rape drugs” in the blood of a potential rape victim – the accusation is investigated as a rape case because 99.9999999% of the time, that’s exactly what happened.

    Before you accuse victims of fabricating rape charges, please educate yourself. Rape is not a joke. Stop blaming victims.

    All that suspended with pay does is punish financially the team and the owner of the team that a player is on.all it amounts to is a paid vacation. if a player is under suspicion allow him to play and make him earn his money and help his team if he isnt in jail,why should a team be penalized with paying his salary when he sits home counting his unearned cash,its not the teams fault he is being investigated so stop taking millions away from the team for any crimes a player is suspected of but has not been found innocent of.WAKE UP NFL!

    Actually the “innocent until proven guilty is “in a court of law” which you conveniently left out. Employers and society as a whole can and will decide guilt based on their opinions.
