Benson never intended to testify in San Antonio lawsuit

A hearing this week in San Antonio provided the latest venue for the Benson Family Feud. But some found it odd that Saints owner Tom Benson opted not to testify in a hearing regarding his competence to manage a trust that holds various of his properties other than the sports teams he owns.

“We never had any intention of Mr Benson testifying,” lawyer Phil Wittman said in a statement issued Thursday night. “He flew here Wednesday night on his plane to meet with his legal team and have dinner. He is very engaged in this Texas hearing and wanted to meet with us face to face . . . it is that important to him. He flew back to New Orleans as scheduled early Thursday morning.”

The lawsuit in San Antonio is separate from the action that challenges Mr. Benson’s capacity to change his will, shifting plans for transfer of the Saints and the NBA’s Pelicans upon his death from his daughter and her two children to his current wife, Gayle Benson.
