Ballers spawns lawsuit against Mark Wahlberg, Dwayne Johnson

Last year, it appeared that HBO and the makers of Ballers were running the risk of getting sued by the NFL, for using team names and logos without authorization. Litigation finally has arrived, but not from the NFL.

Via E! News, Mark Wahlberg and Dwayne “The Rock” Johnson stand accused of stealing the idea from a pair of plaintiffs who allegedly devised a show named Off Season in 2007. Everette Silas and Sherri Littleton contend that they approached Wahlberg and Johnson with the idea in 2008, but that the deal fell through in 2009 after they were denied a “created by” credit in connection with the show.

Silas and Littleton seek $200 million, and they cite 27 similarities between Off Season and Ballers, including the primary basis for the show — a former player who retires, becomes a businessman, and mentors current players in Miami.

Wahlberg and Johnson surely will deny the allegations and vow to fight the case aggressively.

    You have way too many attorney’s graduating, into a career with a 57% employment rate, this is the byproduct of a bunch of lawyers looking for something to do. Back in the 1700’s it was surveying that people got into when they wanted a middle class insurance policy.

    I like those guys but this is slimeball city. This smells like Facebook.

    They could’ve gotten rich either way but instead they deny the actual creators credit for what they created and then just steal the idea.

    I hope they pay dearly. I smell what The Rock is cookin’…unfortunately.

    What’s the connection between Marky Mark and The Rock in 2008? Yes, Whalberg was producing “Entourage” and acting in various shoot em’ up films. But, Johnson was fresh off a “Hannah Montana” guest spot and on his way to making “The Game Plan.” Whalberg had a fun half hour show on HBO and Johnson had a future at Disney. I just don’t see why they would even be approached with an idea like this at that time. Let alone together.

    Even if the Plaintiffs have a solid NDA, courts usually won’t uphold them longer than 5 years.

    Thievery in Hollywood is well known and an everyday occurrence. I’m sure they stole it. I’m sure others stole it and couldn’t get it to production.

    Hope you get paid but welcome to the real world.


    The show will be cancelled because it is not that good and looks quite expensive to produce.

    Have you see Ballers? Any football fan could come up with that concept for a show in 5 min. The script would be everything. If they wrote a script and it was closely copied for a pilot then maybe. Otherwise I don’t see how the lawsuit will succeed.

    $200 million these guys must be joking. The entire production budget for this show is no more than $2 mil per episode. Even if these guys are successful with their suit they will get no more than $50k and cnsidering how much they are asking for it will probably get thrown out all together..!
