Roethlisberger accuser now targets Harrah's

Lost in news accounts of a recent court filing characterizing the woman accusing Steelers quarterback Ben Roethlisberger of sexual assault as a “woman scorned” is that the same filing opposes a motion by the accuser to join Harrah’s as a defendant.

In other words, the plaintiff, who initially did not sue Harrah’s, is now attempting to do so.

We’ve confirmed via a source with knowledge of the case that, indeed, the accuser is now attempting to sue Harrah’s.

Gregg Rosenthal, whose efforts were instrumental in our ability to break the story of the civil suit in July, had been hearing that the claim against Harrah’s was coming, but we had been unable to substantiate it.

The motion apparently comes after Roethlisberger’s lawyers filed a motion to dismiss the entire lawsuit because the accuser had failed to sue an “indispensable” party to the controversy — Harrah’s.

And it might be that this was a rope-a-dope tactic aimed at securing an outright victory.  The argument will be, based on a 2005 case from the Nevada Supreme Court, that the state workers’ compensation laws provide the exclusive remedy for the injuries that the accuser allegedly suffered. 

The open question is whether the exclusivity applies only to Harrah’s and its employees, or whether the perpetrator of the alleged assault — Roethlisberger — benefits from the exclusivity, too.

Moreover, it’s unclear why the accuser’s co-workers would choose to fight the attempt to join Harrah’s, if joining Harrah’s provides a silver bullet.

Still, the bottom line is that Harrah’s is now potentially on the hook, which likely makes a quick and easy resolution only more difficult for Roethlisberger to obtain.

    Would she then have a stronger case against Harrah’s?
    Probably why she didn’t want money from Ben in the deal since she could just get it out of Harrahs.

  4. Just IMO — With Roethlisberger’s team playing hardball because they want ZERO admission of guilt Harrah’s is much more likely to pay a moderate sum to make everything go away. Not the initial four million or whatever but like $200,000 just to end it.

    A lawyer for several Lake Tahoe hotel employees named in a civil suit that accuses Pittsburgh Steelers quarterback Ben Roethlisberger of rape says the lawsuit and timing of events are the “cold, calculated vengeance of a woman scorned.”
    Margo Piscevich, in a motion filed Monday in Washoe District Court in Reno, further argues that the woman’s affidavit, filed last week, is “nothing more or less than media grandstanding” and should be stricken from the court record.
    In the same filing, she opposed an earlier motion by the woman’s lawyer, Cal Dunlap, to amend his suit to name Harrah’s corporate entity as a defendant.
    Dunlap, who has repeatedly refused to comment on the case, could not be immediately reached Monday afternoon.
    A VIP hostess at the Lake Tahoe hotel-casino, the woman filed her lawsuit in July, alleging the two-time Super Bowl winner assaulted her July 11, 2008, in his hotel penthouse while attending a celebrity golf tournament. The Associated Press, as a matter of policy, does not identify people who say they have been sexually assaulted.
    The suit also names Harrah’s President John Koster, security chief Guy Hyder, and six other current or former employees as defendants, alleging they orchestrated a cover-up of the incident.
    The woman says she was repeatedly hospitalized for emotional distress in the weeks and months afterward. Her suit seeks a minimum of $440,000 in damages from Roethlisberger, at least $50,000 in damages from the Harrah’s officials and an unspecified amount of punitive damages.
    Roethlisberger has denied the allegation and his lawyers have suggested the woman is mentally unstable.
    In her 54-page affidavit, the woman said Roethlisberger lured her to his suite, saying his television wasn’t working properly, and assaulted her. She said she reported the incident to Hyder the next day, but that he insisted it was “no big deal” and never followed up with an investigation.
    The woman never filed a criminal report with police, something advocates for sexual assault victims say is not uncommon.
    But lawyers for Roethlisberger and the Harrah’s defendants counter that e-mails contained in the court record from the woman to Hyder and others show she was infatuated with Roethlisberger and boasted of having sex with him.
    The e-mails, Piscevich said in Monday’s motions, tell the “whole pathetic story.”
    Piscevich said the chronology of events suggests the actions of a woman scorned.
    After having sex with Roethlisberger in July 2008 and telling a friend, former Harrah’s hotel director Stacy Dingman, that Roethlisberger is “hot,” Roethlisberger then ignores her, Piscevich said.
    In January, after the Steelers win the AFC Championship and prepare for the Super Bowl, she changes her story, telling Dingman that Roethlisberger assaulted her, Piscevich said in the motion.
    Piscevich said the woman’s suit was filed just as the NFL preseason was about to open, and that her affidavit was filed one day before the Steelers’ 2009 opener last Thursday.
    “The timing appears to be more than coincidence – it seems to be rather the cold, calculated vengeance of a woman scorned,” Piscevich wrote.
    Dingman’s lawyers, in a separate motion filed Monday, argue the allegations against her lack merit and should be dismissed.
    The woman alleges besides participating in the cover-up, Dingman told others at some point that the woman was treated for schizophrenia, attorney Dora Lane said.
    Lane said Dingman denies the allegation, and attached an exhibit showing the accuser in late 2008 had been prescribed anti-psychotic medications that are used to treat schizophrenia, among other things.
    Previous filings from Dunlap, the woman’s lawyer, included medical records and notes from a doctor who in December 2008 concluded she suffered from post-traumatic stress disorder and had suffered hallucinations after she learned that a soldier she had been courting via the Internet turned out to be a hoax.
    Later handwritten notes by the doctor in January 2009 include a notation, “describes a sexual assault that occurred last summer

The evidence doesn’t seem to support her claim, and she is working against Big Ben’s checkbook…and, last I heard, Harrah’s checkbook is a lot bigger and their lawyers are a lot better. Unless she’s been fixing her attorney’s t.v., she’ll probably run out of cash before she can file a civil suit.

    Doesn’t that say right there that even if she wanted the people who participated held accountable rather than the corporation (with the deep pockets), she could have her lawsuit dismissed altogether if she doesn’t sue them too?
    I’m curious to see how the previous worker’s comp ruling plays into this. If she primarily wants her medical costs paid for, including her hospital stays and doctor visits, then it should be granted if they find Harrah’s and its employees complicit in fault. In that case, it might be clearer whether she bears a personal grudge against Roethlisberger or not – though all she might want is an apology.
    Such a shame that basic civility has been abandoned in favor of people “lawyering up”. I haven’t even seen any indication of whether Roethlisberger even admits to having sex with her. It seems to me that so many of these matters spiral out of control because a guy follows a moment of intimacy with “talk to my attorney” instead of “I’m sorry you feel that I behaved inappropriately.” Whether she didn’t want sex with him at all, or just didn’t want it the way he did, there’s really no brush off like a celebrity brush off, when the lawyers coldly handle the details as he rather visibly enjoys his life despite how she feels. Everyday women would do well to steer clear of famous men altogether.

    Yeah, I’m “hatin”.
    In fact, the only people who hate Ben more than I do are Browns (or maybe Seahawks) fans.
    That said, I have to say you’re absolutely right. I think it’s more than obvious now he did absolutely nothing wrong here, and the accuser should either be placed in a psych ward, or taken out and shot.
    Women like that only make it more difficult for ACTUAL rape victims to get closure, and are nothing short of a full-blown disgrace to their gender. Despicable.

  12. The lesson here is that when you are planning on being…intimate with some one you should make sure both parties involved have a clear understanding of what it means. I’m not saying that she didn’t want to and Ben did anyway, I think its more probable that he didn’t want it to mean anything and she did and it looks like as far as scorn goes…
    This case has reached the point of sheer annoyance for everyone involved, including us. Even those who hate Ben are probably bored at this point. can she please do us all a favor and just drop it and let Ben’s legal team go to town on Cal Dunlap, apparently they are drooling in wait for the eventual kill.

    thats exactly what her and Dumblap are after , they tried to make a settlement offer with the Hotel on July6, and i think when that did not work they decided to drag Ben in this thinking that would produce big payday ,,,welll guess what dumbass that aint happening either.
    What i find stange is that Dumblap stated that the 2.8 million they were asking Harrahs to settle for was a work related thing. Well here is my point , When has the accuser’s attorney ever set up a settlement offer, My best friend was involved in a civil suit after she was involved in a car accident, that was up against a big company and she was advised to seek legal counsel because of her injuries and she lost a daughter,and she lost 2 other family memebers in the accident, Well I dont recall her attorney ever telling the company that they wanted a set amount of money to make it go away…they were thecompany at fault was the one that made the offer to settle out of court . So that is what is really getting me on this , It sounds like money all along and then Dumblap says that when she made the settlement offer to Ben it was to show that she wasnt after the money (contridiction at best) and then on the same day he files a motion oppossing the motion to dismiss from Bens attorneys ,and attached is a sworn affidavit from her. I never did believe her story to begin with after reading her new affidavit it convinced me even more that she is lying. That is what the workers attorney is pointing out that it is more grandstanding. So note to Dumblap and Mcnutty , you are only digging yourselves in deeper . I hope that Ben ‘s attorneys and your co-workers attorneys make examples of you both,,, I hope that you both get what you deserve…

    How you can say that the steeler fans are the least deserving in the league just shows how little you know about football. You would be hard pressed to find a fanbase more devoted to their team then Steeler fans, so do some research before you put your foot in your mouth. I’m sorry there are so many people out there that are jealous that Pittsburgh has the most Lombardi’s, but that’s just the way it is for now. Get over it.
