Lawyers for Roethlisberger's alleged Milledgeville victim issue statement

During Monday’s press conference regarding the status of the investigation into the latest sexual assault allegations made against Steelers quarterback Ben Roethlisberger, authorities disclosed that the alleged victim has hired legal representation.

And those lawyers have now issued a statement.

Here it is, straight from the Milledgeville (Ga.) Union-Recorder:  “Their daughter has done the right thing and reported this matter to
the police.  She has been, and will be, available
to the authorities to assist them in the criminal investigation.  While
the matter is under investigation, we ask you to respect her privacy,
keep her name out of the press and allow the family space and time to
heal.”

The lawyers, from the small Atlanta firm of Parks, Chesin & Walbert, also have asked that the victim’s name not be released to the media, something that we will respect.

So why has the victim hired counsel?  Regardless of whether criminal charges are filed, it’s safe to say that a civil lawsuit is coming.

By all accounts, she went to the hospital immediately afterwards and has been available to the police as needed.     How is this crime something one can prove in court? Doesn’t it always amount to his word against hers, even if DNA comes into the picture?
    As a father of daughters, I would hope this type of situation never befell one of them because from my vantage point, I just don’t see how you prove anything or charge anything.

  12. Regardless as a Pats fan how much I enjoy watching bad things happening to the Steelers (Jests,Fins, Colts and Bills) BR is truly a despicable human being.
    My wife’s family(born/raised) Pittsburgh/Ohio Valley , diehard Steelers fans were sharing stories last night on how Ben thinks he has a huge sense of entitlement. I heard stories about how he doesn’t pay his bills at local burger joints,walking out without paying b/c he’s BR, having young women asking for his picture and then asking them is that all they want? When the girl said just a picture, he called her a F–in C–t.
    There is something wrong when a 28 year old professional athlete has to cruise college bars looking for 20 year old students. Based on numerous reports Ben seems not to accept the word NO.
    Someone with common sense would say that if he cannot get women by normal means maybe he should just get escorts like the Vikings did on their boat trip.
    It is apparent that the rules that we live by as a society do not exist for him in his opinion.
    Any parent would know based on the facts that this girl has been so traumatized that something wrong occurred behind the curtains at this club.
    Steeler fans sling alot of nonsense about the Pats on this board but at least our QB does not have to troll bars looking for underage girls to force himself upon.
    If this is true, I hope he gets the maximum he deserves.
    It is now not hard to understand why it has been reported for several years that his teammates don’t like him. Right Hines Ward??

  14. I thought Ben may have been guilty … Until this. By hiring a civil lawyer, this woman is definitely after money and she will do Anything and everything to make sure he is guilty not because she wants justice ( which she could have gotten without civil attorneys) but she wants the moula.
    Expect this case to end with no criminal charges ever filed. (but a nice behind the scene settlement will be made to ensure that criminal charges are not filed)
    this happens all the time to doctors and other people every day. It’s otherwise called extortion and blackmail but lawyers call it justice.

  15. You can’t assume a civil suit is coming just because she hired counsel. This is a high-profile case, and I’m sure Ben’s attorneys will do everything they can to attack her character, etc. She and her family were wise to lawyer up to prepare for the brutal battle she’s in for.

  19. It’s not uncommon for a victim in a high-profile case to hire counsel. It allows her (or him) to maintain anonymity but still have someone to issue statements and serve as a liaison. Plus, given the fact that Big Ben countersued the Nevada woman, it’s reasonable for this victim to have a lawyer in case Big Ben takes similar civil action.
    Until she files a suit seeking money, DonTerrelli, it’s not gold digging.

  28. If another college student had done this to her…would she have hired a civil attorney? I doubt it…because that person wouldn’t have money to take. But because Ben has money, she hires a civil attorney…that means only one thing…she’s is definitely after his money. Otherwise…why do it this soon? She must not be that traumatized if she’s clear enough to hire an attorney 2 days later.
    It still baffles me that she was able to describe Ben’s height and weight EXACTLY like it’s listed on the Steelers website. That is very suspicious to me!!

  29. She may have a lawyer because she knows this case is going to trial and she will face a tidal wave of media and legal scrutiny in what could be a very high profile case. A two time Super Bowl winning QB on trial for a sex related crime? That’ll grab a headline.
    Anyway, it makes sense to have someone who knows the law and can handle that onslaught for you while you prepare to face your attacker in what could be a lengthy and draining trial.
    Now he hasn’t been charged yet. So he can’t be guilty of something he hasn’t been indicted for.
    It looks like the authorities are looking at everything before they make that decision. So, in my mind, if he does get charged, there is obviously something significant there and he will be in a very difficult position.
    Until then, we wait……and speculate.

Roethlisberger has hired a high-powered criminal defense lawyer, who will use everything available to benefit his client. He will have investigators digging into the young woman’s background. We don’t know what experience the Milledgeville police and the local prosecutor have in dealing with high profile sexual assault cases (none I’m guessing). A lawyer will help protect her interests. Parks, Chesin & Walbert is a firm with a specialty in sexual harassment cases, which can cut either way–they are best able to advise a victim, and best able to file a suit on behalf of the victim. But, as Liz Cheney has discovered, everyone is entitled to representation in our legal system without regard to motive.

  47. @27rice – Without knowing the details of the events that occurred, we can’t know that DNA would mean anything at all. He very well could have had relations with the young woman and could fully admit it. But sexual assault/rape is an issue of consent. If they had relations and he doesn’t deny it, but she is claiming it wasn’t consensual then DNA evidence isn’t relevant. It would only come into play if he denies having had sexual contact with her at all.

    I worked 3rd shift in hospital ERs for 10 years, and I can tell you from experience that people go to the Hospital for a whole range of B.S. reasons. I’ve seen drunk girls come in claiming to have been beaten by their husbands and not have a mark on them. They are called drama queens and they exist. I’m not trying to say Ben is completely innocent , he probably did behave inappropriately, but just because she went to the hospital does not make him guilty. Spend a little time in a county hospital on the night shift and you will see all kinds of crazy walk through the door.

  52. I’m a college guy and one of my best girl-friends was just raped about 2 weeks ago in her dorm room. This girl is following the exact same thing that I saw with my friend in the following days. She went to the hospital immediately after, where they performed the rape exam which is extremely stressful. She wouldn’t leave the room for days, and is still terrified of facing the judgement of her peers. She isn’t filing criminal charges against the guy because the likelihood of winning a he said she said case are very slim, and sometimes it’s easier to just try and move past it. Obviously this girl want him to be punished for his alleged actions, and he is by having his name smeared and permanantly tarnished. Criminal charges most likely won’t be filed because in order to win that case they need to prove beyond reasonable doubt. For a civil case all you need to do is prove that there is suspision of something. This is the best course of action for her.

  59. Rape is a different crime than Sexual Assault. That said, groping a woman could be sexual assault. Kissing her could be sexual assault My question to the guys though, is, if you knew a woman was dangerous in that regard, lets say she had a habit of screaming rape, claiming to be pregnant to get married, or claiming you had an STD, wouldn’t you stay away from her? Same for the ladies. If some guy is accused of rape, or sexual assault, or even domestic violence, wouldn’t you go out of your way to avoid this guy? I personally think it says something about the accuser if she knew who he was, and did not avoid him. It is similar to being near an obviously drunk driver on the road. What do you do? Would you be happy if your daughter acted like that, even is she was not “assaulted”.

  69. AMPATS. Time will hopefully tell if this was indeed tragic. If anything happened to this young girl that was beyond her consent or willful participation I truly hope that Mr. Roethlisberger is prosectured to fullest extent of the law. I would expect the NFL and the Pittsburgh Steelers organiztion to act in concert. Hopefully levying severe disciplinary actions involving but not limited to suspensions and fines as well as the possible financial remunerations to the club and contract nullifications.
    However, if it is found that no crime on the part of Mr. Roethlisberger occured it moves from a tragedy to a case of more poor judgement from a young man who should be more mature and responsbile than this at this stage in his life given his experiences and age. Many in the Steeler Nation struggle to understand why their 2 time Super Bowl champion and 100 million dollar quaterback is trolling college bars and long lining drunk sorority girls.
    I don’t care if he is rude. I don’t have to be his friend and he is not my family. I don’t care if he doesn’t respect people in general for the same reasons. I don’t agree with that personality but I have met many famour personalities that were less than receptive and quite frankly rude. It doesn’t mean I won’t but a ticket to watch their movie or witness a sporting event.
    I do care if he has a broad disrespect for women. I do care if he is (apparently) in the habit of disrespecting the Steelers Franchise and Steeler fans; many of the most enthusiastic of them are women. 3 of them are my sisters, 1 of them is my neice, 1 of whom is my own daughter and another was my deceased mother.
    In this day and age, especially as some of us mature, respect and pride for organiztions we support become a much larger reason why continue to support them, especially as our disposable time and attention shrinks. We look for these organizations or teams not merely to win but to do so while projecting a respectful and socially responsible image that we would want our children to witness and mimick.
    I have been a Steeler fan my entire life. I have been a football fan for that same span. More often than not, especially recently, the organizaions and league managment have done a reasonably good job of policing their image. The Pittsburgh Steelers have done a better job than most and seem to excel at setting a better example.
    I can speak for the reasonably intelligent members of the Steeler Nation when I say that this is not something that we take lightly but can merely voice our displeasure and are not in a material position of true decision making. Were are strong. We support our team. we support each other and we support an ethical and meanginful resolution to this issue.
    There are many outstanding franchises in this league and that is what make it great. Ownership and league management have to make sure that integrity, social responsibility and respect (in general) are exhibited by the people who have the privilege to have so much fame and wealth because of it.

Without these provisions most of them would go out of business because there are just not enough 21+ patrons who want to hang out in college bars.     2. If this was an incident between two college students, the alleged victim probably would not need to hire a civil attorney. However, since the alleged suspect is a high-profile celebrity, it makes sense for her to have representation to deal with public scrutiny AND the investigators.
    3. I would guess that you are predicting that the alleged victim will file a civil suit regardless of the outcome of the criminal investigation. However, if the victim does not – will you apologize to her and her counsel- Senor Florio?

He brings with him the full resources of the State of Georgia, including crime labs, the investigative resources of the Georgia Bureau of Investigation, police protection, etc. It’s rare for an assault victim to hire private counsel.
    Her lawyers have no criminal experience. They are civil litigators specializing in personal injury. In most jurisdictions assault victims have up to two years to file civil suit. This young woman was represented by prominent civil attorneys within 48 hours.
    She did not go straight to the hospital. She and her friends approached a police officer, told him her allegations, and he told her to go to the hospital.
    Mooch asked what all of us would do in that situation. I can only speak for myself. If a monetary settlement were an option, I wouldn’t want it. It wouldn’t fix, heal, or restore anything.
    My brother and I talked late into the night about all the rape victims we’ve known–me through my experiences and him through his criminal practice. Not one sought monetary compensation. All either wanted to forget it … or they wanted the guy dead, mutilated, or imprisoned. Not one wanted money.
    To me that would be the ultimate indignity–groveling for a tip for services rendered.

    Just a couple of points I’d like to note:
    Can we please stop calling this girl underage, she was underage to be in a bar yes, but that statement implies under the age of 18. Ben leaves that to guys like Rey Maualuga. Side note, it is ridiculous that we have citizens who can serve their military yet not drink beer legally.
    This is a big point in my mind, and could help explain some of the issues with women that Ben has. His mother is dead, and has been for a while. I am not sure at what age she died, definitely HS years or earlier. I remember this being mentioned during his draft year, he was raised solely by his father, who is a very successful businessman. The system of balance was not present for most of his life, instead he had a father who was used to getting his way role modeling for Big (and lil) Ben.
    Last point, he is a football player, and a well paid one at that. Aside from the occasional Drew Brees, Kurt Warner, and smattering of others they are all arrogant assholes who expect preferential treatment, especially from women. I lived in State College(PSU) for a number of years and seeing the way those players treated women in the bars made me sick. Kijana Carter was notoriously rude to the ladies, pulling his junk out at the bar as he pleased.
    The individuals need to take some responsibility for their lives, but I do not blame them wholly. I blame the society we have that has created this aura of invincibility for football players and the hero worship that fills their large (yet empty) egomaniacal heads.
    I hope this is all a scam, but not because I am supporting Ben (I am a Steelers fan as well), but rather I hope this girl is truly not a victim.

    My post to RAVANATION may have answered some of your question. Can’t answer for my brother, but yes, a couple of the women I’ve known were assaulted by wealthy men–though not as wealthy as Roethlisberger.
    Don’t get me wrong–I support filing civil suits when monetary damages really can punish the guilty and inflict compensatory damages for harm inflicted.
    Say a company decides not to correct a machine design flaw knowing the result could be injury or death. Yes, victims should be compensated for actual loss of life, property, earning power, etc., caused by resulting accidents. The monetary punishment would also serve as a warning to other corporations.
    Rape is not a sexual act. Men don’t rape because they’re horny. It’s an act of violence, domination, and control. They don’t get off on the sex–they get off on the control. Requiring one sex offender to pay money won’t send messages to others. Getting money won’t help you recoup a lost piece of your soul. It won’t make you feel safe. It won’t give you peace. But it will allow him to write you off like a bar bill.
    My views are based on my life experience, and I can’t hold other women to my standard. Ben sounds like an overgrown frat boy. But after the court filings in McNulty … plus Kobe, Duke, Hofstra … I can’t help being skeptical of a woman who immediately hires civil litigators when money was the last thing on the mind of every real victim I’ve known.

That being said though there are plenty of reasons to hire a lawyer – help keep her anonymous, help defend her from places like TMZ and the rest once her name does become public, protect her from all the agents that will be hounding her. Yes a lawyer is not going to handle all her needs such as PR but it’s the logical place to start. I’m surprised, being the sister of a lawyer I would think you would know more.

I have NEVER referred to them as ambulance chasers. They’re not. I said it’s a prominent Atlanta firm–very prominent–specializing in personal injury, among other things. But somehow I don’t think she’s hiring them to handle a wrongful dismissal, medical malpractice, or voting rights case. I could be wrong.
    If protecting my name were my concern, I’d hire an attorney with some specialty in libel and defamation. But that’s just me.

  104. I love reading your posts Deb!! You’re about the only logical and intelligent person posting in here. All the others are anti-Ben or anti-Steelers people that are just loving that this is going on.
    I totally agree with your comment about her attorneys. If she hired them to handle PR and to make sure her name doesn’t get out there, then why didn’t she hire a PR firm or lawyers specializing in libel and defamation?? Instead she hired lawyers that specialize in Personal Injury…which leads me to believe this is heading towards a civil lawsuit. I really don’t understand why some of these other boneheads can’t see that!!

    My my … just can’t admit being wrong, can you? My comments in THIS thread–which you claim to have read–referred to her attorneys as civil litigators (not ambulance chasers) and mentioned that I was speaking from experience. So if you’d just stayed here and paid attention, you’d have been able to catch on. But you were to anxious to throw stones at me to practice fundamental reading comprehension. And now you’re just not willing to man up to the fact that you got it all wrong. I don’t really expect that, by the way, but there is a saying that once you find yourself in a ditch, you should stop digging.
    As for the hours of research … hate to disillusion you, but on Saturday, I found a news outlet that was on top of the story, bookmarked it, and click on it a few times a day while I’m working. When they named her lawyers, I googled the names, clicked on the firm’s site, and read the info. Took less than five minutes.

    First degree sexual assault is rape… Criminal Rule 3-305: “A person may not engage in a sexual act with another by force, or threat of force, without the consent of the other.” Also grabbing a girls ass, as you have admitted to, without permission is also a crime. It’s considered a 3rd degree sexual assault here in Maryland. Criminal Rule 3-307: “A person may not engage in sexual contact with another without consent of the other.” Watch yourself or you may wind up in a cell with Big Ben…

    Ben’s case isn’t being investigated under the criminal codes of Maryland. The Georgia police said in their first press conference that it was not rape but “sexual assault/sexual manipulation” and that’s what’s in the police report.

  108. Dan Rooney is back in Pittsburgh from Ireland this weekend for an annual St. Patrick’s Day fundraiser. I think he, Art and Tomlin will be having a serious sit down meeting while Dan’s home.
    I’m a fan of the Steeler organization since the Steel Curtain days of the 1970’s, but I’m disgusted with Ben’s and Jeff Reed’s antics – conduct unbecoming. At best, they’re arrogant, undisciplined and immature. They may be good football players on the field, but they’re both dumb as posts about how to conduct themselves off the field.
    Ben admitted he had “sexual contact” with this girl (aka Bill Clinton play) in a college bar. If he hasn’t figured out by now that readily available sexual favors doesn’t mean “free”, then he can’t afford anymore blows to the head.
    I’d rather see the Steelers go through 5 years of rebuilding than keep putting up with the distractions of these overgrown frat boys.

    Dan Rooney being back in town is the best news I’ve heard through all of this. Though I’d like to salvage the overgrown frat boys, I agree it’s ridiculous that someone in Ben’s position hasn’t figured out there’s no such thing as a free romp in a bar. I’m assuming Ben is innocent of the assault, but even so, serious intervention is required, and Dan Rooney is the best person to initiate that. I’m only sorry that wasn’t done long before now.
