Sterger lawyer blasts NFL’s decision on Favre

Lawyer Joseph Conway, in a press release sent to multiple members of the media, criticized the NFL’s decision to fine quarterback Brett Favre $50,000 for lack of candor and failure to cooperate (i.e., lying) to the league and, ultimately, to impose no discipline on him for sexual harassment.

“My client and I are extremely disappointed, but not surprised, at today’s NFL announcement that Brett Favre did not violate the NFL ‘workplace conduct’ policy,” Conway said.  “While I am not privy to how Mr. Goodell reached such a finding, we strongly disagree with his conclusion that there was insufficient evidence to support a violation of the policy.  To the contrary, our evidence and the personal testimony of Ms. Sterger clearly showed a pattern of lewd and offensive behavior by Mr. Favre that lasted all of the 2008 season.

“As noted in the NFL’s release, ‘there was no evidence to suggest that Sterger engaged in any inappropriate conduct.’  In addition to the offensive messages, there was ample evidence to show that the sexually explicit photographs were part of Favre’s inappropriate behavior.  Our evidence clearly showed that the photos were sent by Favre.

“Likewise, Mr. Goodell completely failed to address the complicity of the New York Jet organization in Favre’s conduct.  The evidence was explicit that Ms. Sterger’s personal telephone numbers were provided to Favre by still-current employees of the New York Jets.  This was done without Ms. Sterger’s knowledge and consent.

“Furthermore, the fact that the League took the step of fining Favre for ‘not being candid in several respects during the investigation’ is disturbing in the message it sends.  It clearly shows that an NFL star player was given preferential treatment and tells all other players that failure to cooperate may cost you some money but will not result in other punishment.  Additionally, today’s decision is an affront to all females and shows once again that, despite tough talk, the NFL remains the good old boys’ league.”

It’s hard to disagree with much of Conway’s statement.  (We’ve already offered up our views on the matter.)  We’re not sure, however, that we share Conway’s concern that the Jets have “complicity” via the fact that an employee of the team (probably not a management-level employee) gave Sterger’s phone number to Favre.  Unless Favre told the employee that he wanted the number so that he could sexually harass Sterger, who cares if a Jets employee gave Sterger’s number to Favre?

Except, of course, Mrs. Favre.

    For those of you unfamiliar with this, her first telling of this was to Gawker and the question was if she had received any pictures of men’s private areas. She said she has received multiple from many players, but the only name she gave was Favre’s.

He constantly mishandles everything that come across his desk! In all the years of following the NFL, I have never seen the commissioner be in the news, or have so many complaints from so many areas. Fans, players, media, owners, all wonder what he is doing. When all aspects of the community are complaining about job performance, how does he manage to keep his? I thought with the way he handles the whole Spygate issue, he would not be long for his job, but apparently incompetence is rewarded in the NoFunLeague!!!

It’s always been about the $$$,$$$,$$$.$$, why else bring this all up TWO YEARS after (statute of limitations perhaps)? Enjoy your money and all the other fun things that will come your way.

    For the record, I do think the punishment was too light and the way Brett acted was deplorable and embarrassing. As with concussions and “player safety”, the NFL needs to step up and do more to prevent issues like this before they happen at all.

  8. Mike, Why do you assume that it was a lower level employee? If in fact a member of the JETS MGMT. gave him the number then they would be responsible to a degree in the mistreatment of one of their own. As long as it was Farve, then all rights are forgone under your logic.

    As a lawyer you should know that employers, whose employees have access to sensitive information, are liable if that employees (s) misuse that information. Thats why all employees should receive training in the correct way to handle that data. Im sure Ms Sterger’s lawyers, when they file their papers, will focus on how the Jets train their employees in handling this data, how many times did Jets employees pass sensitive data to players, and does the League hold any liability in this?
    Its unfortunate, but the Jets should have not been asleep at the switch in this.

  13. For the most part, I have been a supporter of Goodell, but lately he seems to be losing control. This was terribly mishandled, and smells funny, similar to the Patriots spygate investigation and the quick destruction of the evidence.

  14. I’m a fan of Favre. Grew up watching old gray beard. But if this was Jay Cutler, Matt Cassel, Michael Vick, or any player not named Brady, Manning, or Favre, they all would have been suspended. I think Goodell’s ruling has to making guys like Vincent Jackson question whether there is a double standard in the NFL. This may be Goodell’s first BIG mistake.

  21. While I agree that the NFL did not punish Favre enought for supposedly lying (ie not being candid), I think this tramp and her attorney should either sue or STFU. OF COURSE, if the NFL said Favre did commit some violation of conduct due to sexual harrassment, that would have led to an immediate lawsuit by this tramp and her attorney. I don’t have a problem with the NFL not ruling that way, since I think this was something that happened between 2 adults, private between them, and she didn’t say boo even to this day (ie she still has not sued). I am sure they were hoping the NFL would help them. Again, although the NFL should have had a bigger punishment for the lying aspect, I am glad they didn’t say it was sexual harrassment since the tramp and her attorney are not doing anything to even justify the allegation. Now, they should just go away.

    As far as the other stuff, please. There was no sexual harrassment. She joked with her friends, waited two years to report and only did so after her career was going down hill. She tried to cash in on the pics she saved for a rainy day and had an epic fail.

    How often does this happen with the exchanging of pics like this? I have never done it personally, but it happens. To me it looks like two adults being people and one of them tried to pull a fast one and fail.

    Thats it. If she reports it right away, then Id give the story credence. But she didnt. And since she didnt, theres no way to prove harrassment, because the elapse time shows she wasnt very offended. Usually if someone is offended, they dont wait two years to say so.

The NFL may sweep it under the rug but Sterger’s camp is not satisfied yet and the ominously silent Mrs. Favre has yet to be heard.   26. I don’t know what or who Joseph Conway is but in my opinion he clearly didn’t serve his client’s cause very well.
    If he truly believed he had a sexual harassment claim he should have filed it. His obsession with league discipline upon Favre is perplexing, to say the least. Any experienced attorney would know that any disciplinary sanctions by the NFL would have absolutely NO RELEVANCY on the issue of sexual harassment in a court of law and a court would estoppe the plaintiff from ever mentioning it.
    I think we can assume by Mr. Conway’s ressponse that there was never going to be a lawsuit in the first place.

  28. Not sure where all these people get off saying Favre lied. The statement from the NFL specifically says that forensics experts could not determine whether the offensive pics came from Favre’s phone. He claims he did not send her photos. So how, exactly, is he lying? It sounds to me like the forensics experts backed up Favre’s statements.

    I expect Favre was cautious in what he told the NFL b/c of advice from his lawyers. And the NFL couldn’t pin anything on him, didn’t want to do nothing, and of course had to pay for the aforementioned forensics experts. So they fined Favre for some bogus “non-cooperation” charge, when we all know he met with Goodell willingly, unlike his accuser, who dragged her feet for weeks, waiting for a payout from Favre, which never came.

    This is the NFL punishing Favre for the bad publicity for the league. Nothing else.

  29. In my opinion, Sterger’s failure to take this to a real courtroom is an admission on her part that her lawyers did not believe that this violated New Jersey sexual harrassment laws. Period. End of story. They knew this wasn’t sexual harrassment and going to court and losing would have cost Jenn more money and precious “face”.

    As for the personal conduct policy of the NFL. Look, I hate to be a realist here, but Goodell is the one that decides if it is in violation. He decided that it is not. He doesn’t owe Sterger a damned thing. They can huff and puff all they want.

    I guarantee you that the reason Brett got off is because Jenn Sterger was unable to provide a single piece of evidence indicating that she told Brett the advances were unwanted. Nothing. Nada. Zilch. Furthermore, she failed to provide any evidence that she was emotionally hurt by his advances.

    Does Conway just ignore the FACT that Sterger in a recorded email chain to Deadspin told the editor there that she thought it was just funny the whole time and that she held onto the pics to share laughs with friends? Seriously. Jenn went on record saying that none of it bothered her. There is no evidence of her wishing it away.

    I really am starting to think that this whole situation was an attempt by this Sterger goofball to get in the headlines. If her showbiz career were flourishing you would have never heard of this. I mean she came out with this stuff merely weeks after her show was canceled, and nearly years after the incidents actually took place.

    Sterger did her damage. Got her name in the papers. Now it is time for her to spin this into a playboy centerfold and then disappear out of the public eye forever. There are more interesting and talented hotties out there for us to give attention to.

    All personal information given by an employee to an employer is implicitly confidential unless the employer explicitly informs the employee that it could be released. I believe a personal phone number would fall under this.

    Under no circumstances should any Jet employee have given out Sterger’s number without her express permission.

  35. I don’t appreciate the melodramatic declaration that Goodell’s actions are an affront to all females. Jenn Sterger is hardly representative of all females. Most women, upon receiving unsolicited photos of a coworker’s privates, would at least report the incident to management to ensure her rights and interests were protected. Had she acted appropriately at the time, she wouldn’t be viewed as complicit now. She has only herself and her greed to blame for any harm to her career.

    But, Mike, I disagree with your comment about her coworkers. It’s one thing if a friend with whom she happened to work passed along her phone number to Favre, assuming she’d be okay with that. But if an HR employee passed along confidential contact info from her personnel files, that’s a problem no matter what the employee thought Favre would do with the number. Teams need to be sure employees are cautioned against giving out private information on other employees, which could leave the company liable in a harassment suit.

She was still taking his calls 6 months after both of them had left the Jets, suggesting she was involved somehow with him. It’s fairly obvious that she didn’t sue him because she didn’t want details to come out in court. He almost certainly has similiar incriminating pics & info of her but can’t disclose that without implicating himself. This is nothing more than a fling turned into blackmail.

    As far as the fine, I am confused how they could fine him if they can’t prove anything. They can’t just fine someone just because they BELIEVE he lied. Unless, he just said I don’t want to discuss it (most likely what happened)…in which case, that’s his right.

  48. We all know what Brett did and said in his texts to Sterger, but, I hardly believe that he did this ALL season and she was giving him the cold shoulder and asking him to stop. We need to see(or at least hear) what her texts said in response. I think it was more of a mutual thing, and she may have been persuaded by someone else to pursue this investigation and possible lawsuit.

    It’s been a one sided “he did this” soap opera. I don’t believe for a second Sterger is innocent.

  50. People are too funny. “Sterger only did it for the money”. Well that can’t be the case, because extortion would mean Favre didn’t do anything. Now we know he did. See when you take a pic with a phone, the phone model gets saved in the pics data. You can transfer the pic (as Sterger did), and that information stays with the pic. From what the league has said it seems obvious the model listed in the pics and Favre phone model at the time were the same (probably even matched the phone numbers). Now then how do you prove Favre himself sent the pics? Well you can’t, least without an admission. Thats why he copped to the voicemails. You can tell who’s talking on a voicemail (using voice analysis software), you cannot tell who presses the send button on a phone.
    The NFL has said Sterger didn’t lie, but that Favre did. Its obvious then Favre sexually harassed Sterger and Goodell won’t do anything about it.

    Actually it is totally the issue, and not the only issue.

    The NFL said it is not their interest to pursue peoples personal lives and did not have a policy to control such moral actions. Because Brett is married with kids is completely irrelevant to anything that took place. How would you like it if your boss suspended you because you banged a woman in a bars bathroom? I’d sue in a heartbeat! None of their damn business if she was an employee or not unless they have a specific policy prohibiting such behavior. The NFL did not…end of story!

    Sorry Super, the league did not say that. They said that “forensic analysis could not establish that Favre sent the objectionable photographs to Sterger”. The League also said “nor was there anything to suggest that Sterger engaged in any inappropriate conduct,”. So if Sterger did nothing wrong we know some things are true (or else Sterger would have been called out for lying). She received the photos that she described. She received the photos from Favre’s phone. Either those 2 statements are true, or Sterger engaged in inappropriate conduct. So what the league couldn’t prove, was that Favre hit the send button to send the pics to Sterger.
    Also learn the definition of “candid”. Not being candid does not mean stalling. It means one is not “honest; impartial, frank; outspoken; open and sincere”. I’m willing to bet Favre lied about his phone, and whether it was within reach of himself when the pics were sent.

  55. i dont know how anybody could say goodell is a impartial and fair commisioner.. for a guy who goes on and on about personal conduct and not tarnishing the shield, he sure let all this drag out to the end of the season.. i mean i called up my cell phone company today and they said i could get transcripts of my texts to me within 2 weeks.. and hes tryin to pass it off that the multi billion dollar company with high price lawyers and former fbi and cops could not find out if favre sent voicemails and pics from his cell phone??? yeah right.. HYPOCRITE.. so they fine him for not being forthcoming… but if he didnt do anything why not clear his name and fine him at all… and if he did then come out and say that.. you cant say with all the months went by that they didnt find ANYTHING out about what really happened

    Mike, as a lawyer, you know well that administrative proceedings like this one do not require criminal procedures, nor a criminal burden of proof. In fact, this is exactly the type of case of where a preponderance of the evidence should be utilized. In other words… if it walks like a duck, looks like a duck, and quacks like a duck, then is is a damn duck! Why are they acting like they need proof to match a capital offense, or to meet war crimes standards???

    I swear the NFL is just making this crap up as it goes along, and doesn’t have the brass to take on a supposed living legend… they took the path of least resistance and I for one am sick of it. This is a sport that is tops in America and has the best potential product, yet fails miserably to create the policies and procedures to insure the integrity of that product. This is the case in player discipline, in fines for hits, and how the NFL handles officiating. All this league is concerned with is cash and using PR to keep its cash. I am very disappointed in the Commissioner and in the League.

    There ares no double standards. Ben raped at least one female. Brett never touched any. It is not proven whether he sent dick pics to Sterger. It is only proven he left her voice messages. The NFL is not responsible for that especially if Sterger’s camp couldn’t prove sexual harrassment. The last I heard voice messages are still legal in the US.

    Now Deanna should take action being Favre is married to her.

    If I were Sterger I would sue her lawyer and publicist. They have screwed her more than Brett even planned to.

  60. All in all, it really doesn’t make any difference how many magazines Sterger posed for, how many GB groupies Favre slept with in WI, or whether Sterger was enticing Favre or vice-versa. The only issue that really matters is the fact that Favre sent pics of his horn to a female employee of the company he was employed by. If I were to do that in my office, I’d be fired for sexual harassment regardless of the circumstances. The fact that the league seems to worry more about how hard a player gets tackled by another player doing his job than it does about how female employees are viewed and/or treated in the workplace goes a long way to show what an utterly useless putz Gutless Goodell really is. Fire him now!
