Panthers linebacker Thomas Davis may not reach free agency for another season because of a barely-known loophole in the last CBA.
As pointed out by Darin Gantt of the Charlotte Observer, the previous CBA said any player who was not activated from the PUP list while in the last year of his contract would have that contract carry over into the next season.
This rule would apply to Davis and Eagles defensive end Victor Abiamiri, and means the Panthers could keep Davis under contract at $3.268 million for 2011.
This seems like a tough break for Davis, although it’s worth noting that Davis is coming off two torn ACLs in as many seasons. We doubt that he would get big money on a long-term contract this offseason until he can prove he’s healthy.
Davis’ agent Todd France acknowledged the rule to Gantt but didn’t comment on whether it applies to his client.
