Prosecutors contend they have photos of Hernandez with murder weapon


Prosecutors don’t have the gun that killed Odin Lloyd.  But they think they have photos of it.

On Thursday, via multiple reports, documents that were released publicly include still frames from Hernandez’s video surveillance system, which prosecutors contend show Hernandez holding the murder weapon.

Per FOX 25 in Boston, the images were included in a 104-page affidavit that was “heavily redacted.”  During Hernandez’s initial court appearance last month, prosecutors mentioned that surveillance video included images of Hernandez holding a gun.

The gun that killed Lloyd, a .45-caliber handgun, has not been found.

    I don’t see them getting a conviction without it and evidence it contains

    Their star witness even said that Hernandez and Lloyd made up in the car. And that he handed Hernandez a gun from beneath the seat. If that’s the gun in the video, it wasn’t used to kill Lloyd if it was under a seat for Ortiz to grab. I also wasn’t aware that they could prove it was the murder weapon based on video.

    Hernandez can be placed at the scene but I don’t see proof that he pulled the trigger or had motive. They made up and Hernandez changed his mind 20 minutes later and decided to off him?

    Whole story sounds confused. They’re right to delay to try to buy time to find the gun.

    I really hope they don’t screw this case up if Hernandez did pull the trigger.

  2. All I can think of is if I had earned the chance at a great football career (like he had) I would have felt blessed and determined to show it in life. This guy disgusts me.

    Yea having pictures of a .45 and getting the actual scientific, ballistic evidence to match it are completely two different things.

    This is the prosecutors trying to boast their case and possibly scare hernandez into a plea deal – see this crap all the time.

    Anyone who has shot a gun or knows the first dam thing about guns knows this.

  5. I just saw some photos. It definitely looks like he is holding a gun (if not a gun then a black weapon resembling one) in his left hand.

    It’s not looking good for him.

  6. My God- a .45 caliber handgun is a cannon. From personal experience a .45 round could go through anything. Whoever shot this poor man that way-standing over him and firing is an animal.

  7. The defense contends that wasn’t a gun in his hand but a bag of Skittles. Has anyone accounted for the whereabouts of George Zimmerman the night of this murder?

Since the weapon used to kill Lloyd was a Glock .45 and the weapon Hernandez is holding in the photos is nowhere to be found, I really hope the prosecution brings in the best experts on weapon identification as well as engineers from Glock directly so they can correctly identify the weapon from the photos and pound another nail in this loser’s coffin.

    C’mon guy how Naïve are you. Shots were fired less than a mile from the Hernandez home. % min later, Hernandez walks in the door holding a gun that just so happened to be the same caliber as the bullet that killed Lloyd. I mean HERRO! 2, the witness in car stated they “made up.” Oh Well GEE WHIZ lets wrap this up shall we, I guess it wasn’t Hernandez then. lol cmon, you think Hernandez is going to let him know his intention? You think sinister dudes like 81 is going to give someone the courtesy of a heads up that they were going to get popped? Circumstantial evidence is STACKED against him. It’s beyond obvious he was in on it. The actual weapon would be nice, but you absolutely do not need it to convict

  12. Some of you people are honestly dense. They do not have to have that gun to convict him. There are people who have been convicted of murder without even the benefit of having a DEAD BODY!

    Also, the forensic people were able to salvage some footage from the surveillance system. He tried to destroy it but didn’t do a thorough enough job.

  13. Reasonable doubt could be that Hernandez grabbed the gun and tried to hide it for another person. There are way too many unanswered questions and every single witness has a criminal history. That won’t hold up well.

  18. I guess all you folks saying “not enough evidence” are correct.

    I mean no guilty person would film himself on his own surveillance system, returning home from a murder, holding the murder weapon, then destroy the surveillance system and lose the weapon. I’m sure there is a way better explanation for the police finding pictures that make it look like that’s exactly what happened.

    But damn, nice security system Hernandy! I bet the criminals have no chance to destroy it if the homeowner can’t!

  19. if they have a picture of him with a gun right after the murder. all they have to do is ask him to produce the gun in the picture to eliminate it from suspicion. when he can’t produce the gun it won’t look good for him. it’s almost as good as recovering the murder weapon. i’m sure the jury will believe that he just happen to lose that gun one hour after the murder. it will be no problem to convict him without the murder weapon. one more nail in the circumstantial coffin.

    5 gun charges and the murder weapon hasn’t been found but they know that from video surveillance he is holding the murder weapon, I’m not a lawyer but something tells me that can’t hold up, right, any lawyers here?

  22. People who think Hernandez will one day soon get out of jail and come play on their team…oh, and win a superbowl, are dreaming dreaming dreaming.

    If you notice, neither Hernandez or his attorney’s have said point blank – he didn’t do it. Nor have they come up with a credible alternative of what could have happened.

    Within minutes of both Hernandez and the victim leaving Hernandez’s home, the victim was shot, and then minutes later Hernandez and boys came home without victim…oh, and H has a gun in his hand that matches the same gun used.

    Open/shut – life in prison.

    Even if you could conclusively identify the weapon as a Glock .45, it would still be circumstantial evidence. Does he have a registered .45 that he can’t produce ? Because to the best of my knowledge they only found a .22, along with matching ammo at his home, but Lloyd was murdered with a .45.

    While anyone could come to the logical conclusion that Hernandez was involved and/or pulled the trigger from all this “evidence”, it’s not conclusive. Dude is gonna walk.

  24. Even if by any chance he gets away with this murder and the double homicide he is being investigated for. Lets remember they added the 5 gun counts which would equal a lot of time in jail (I think this these counts were added to make sure he serves plenty of time, just in case he walks from murder).

    Uhhh…. No. Did you know Lloyd? Did you associate with Lloyd? Were you known to be with him on the night of his murder? Did you have any potential motive to kill Lloyd? Did he text someone that he was with “23chameleons. Just so you know.”?
    I hope you aren’t a defense attorney. People have been convicted on circumstantial evidence, don’t you know?

  26. The only reason it is even remotely possible to believe Hernandez is innocent is because to throw away what he had would be so stupid that it defies the logic that 99% of us live our lives by.

    Knowing what we know now, it’s easy to see it. Until you throw in $40 million contract. Appeared in Super Bowl. New England Patriot. Promising NFL career.

    What an idiot. He belongs in jail for the opportunity he flushed alone.

  27. The photo is too blurry. Even with good zooming, you will still need to run ballistics to nail this as the weapon used. If everything hinges on the weapon (guilt v acquittal), they need to prosecute all three as co-conspirators. I don’t know how much jail time that is, but this might prompt the other two to give AH a good push under the bus.

    Lots has been made about the gun. If Wallace witnessed the shooting, why is the gun still so important as the only provision for a conviction. For AH case defenders, if Wallace was the shooter, AH is still good as a co-conspirator. He will not walk.

    And wait until the race baters get involved in this. White hispanic kills black guy and walks. Sounds familiar? Unlike the FL case, this man was marched to his killing. How the prosecution charges all three will be crucial.

  28. Prosecutor isn’t ready to present evidence in court, but is ready to present claims to media. Hernandez is probably guilty, but this kind of behavior by the prosecution is pretty dubious.

  29. All I’m saying is this they clearly say he has what appears to be a gun but that its the murder weapon. If you can’t clearly make out that its a gun then you got zero all this other nonsense may make him look really guilty but let the whole thing play out. I mean look at all the circumstantial evidence against OJ. We all know how that ended. Robert Blake was a slam dunk its called reasonable doubt and from what they are putting forward a defense team will rip all of this up and show reasonable doubt. Innocent until proven guilty

  30. And their star witness has a record so long he was a j walking ticket from doing life claims he slept trough the whole thing and tested positive for every drug known to man except birth control yeah this although seems like its a slam dunk is starting to look pretty shabby

  31. I dont like AH, and he probably he alot to do with this murder… but you cant start convicting people on pictures. The circumstantial evidence and snitching is a more solid case than using a picture… this is an attempt to shake the defense and manipulate public opinion.

  32. I bet OJ thinks he’s innocent. Hernandez is probably already penning a hypothetical book in jail titled something like “I didn’t shoot and kill my friend, but if I did, here’s how it happened”

  33. When you have 9 million to spend on attorneys finding the murder weapon would help. if the gun in his hand is not the murder weapon then where is it?

  34. How can a picture determine the gun that killed a person ?… The prosecution better find the gun to match bullet fragments .. Other wise the defense will turn this story backwards

  35. 23chameleons, they found the matching ammo at his “flop house”. As has been mentioned by some other commenters, there is plenty of evidence that Hernandez owns a gun that was potentially used in a murder. He is on his own surveillance system holding this gun (not to mention the “selfie” with the gun). If he cant produce the gun (but has ammo for it), it seems pretty logical to think that the gun in the pictures is the gun used in the murder. It seems illogical that in the 12 hours between the murder and when the cops arrived at his house that he misplaced his gun and cant remember where he last had it…

I think most of you are having a problem distinguishing circumstantial evidence and direct evidence…does the footage of him carrying a gun, of which the caliber cannot be determined by the video, prove to a reasonable person beyond a reasonable doubt that he murdered Odin Lloyd? You can assume it, but I really don’t think a jury would see that and without the murder weapon with Hernandez’s fingerprints on it, it would be tough to prove…the State needs whoever was with Hernandez when Odin Lloyd was killed to break and testify that he was the shooter and where the weapon is
