Incognito files grievance against Dolphins

Eleven days ago, the Dolphins suspended guard Richie Incognito.  On Thursday, he officially launched an attack against the suspension.

According to Chris Mortensen of ESPN, Incognito has filed a non-injury grievance under the CBA.  The grievance will be heard by an independent arbitrator.

Over the weekend, we reported that the suspension is indefinite, but that the Dolphins can keep him away for a maximum of four games.  As of Monday, December 2, they have to reinstate him or cut him.

Per Mort, Incognito wants an expedited hearing.  This could reduced his absence, forcing the Dolphins to bring him back or cut him sooner than December 2.

He already has missed one game.  If the arbitrator finds that no suspension was warranted, Incognito would be eligible to receive his game check for the Week 10 contest at Tampa, and for any other games he misses before he is reinstated.

The Dolphins immediately suspended Incognito after receiving evidence from tackle Jonathan Martin regarding alleged harassment, including a voice message in which Incognito uses a racial slur.

“I was appalled, I think anybody would be appalled,” owner Stephen Ross said earlier this week.  “When you first read that text that was reported, to me I didn’t realize people would talk, text or speak that way to people.”

Whether that warrants a four-game suspension — or any suspension — will be determined by an arbitrator.  Either way, it remains unlikely that Incognito will play for the Dolphins again.

I’m no Labor Law whiz, but it’ll be interesting to see who the NFLPA union sides with – given that players’ union represents Incognito in his claim against the Dolphins who are resting their termination of the Incognito attack on the basis of allegations brought to the fore by another player the NFLPA represents (Martin).

  3. Continues to demonstrate the foolishness of unions. If I cuss someone out and threaten there life security could not escort me out sooner, as should the base. So these pompous athletes who all things they are above the law continue to get extra protection for criminal behavior which is a joke.

LMFAO, this whole thing is just comical… Maybe had you acted like a grown man, and not threatened, and harassed someone at your place of employment you wouldn’t be suspended… Anyone else, at any other job would be fired, and have a lawsuit brought against them. Being as threatening, and harassment are both illegal. The funniest part is all the proof is against him, LOL. What a nasty fat POS… Some of you clowns think because these guys play a kids game for a living it’s ok… Go do the same thing at your job, see why happens, HAHA.

  6. The Dolphins knew signing Incognito was a gamble based on his days with the Bills. He has always been a hothead. However, the more that comes out about this the more I think we all rushed to judgement.

    Martin walked out on the team after the OL ask him to sit down with THEM at lunch … when Martin sat down … ALL of them got up and left.
    Here is my question … why was only Incognito suspended and not the whole OL.

  12. Riding the wave coming off his puff piece by his buddy Jay Glazer on Fox, Ingonito thinks he has plenty of ammunition to successfully fight this. I wonder if Glazer will get a piece of his paychecks he gets back for acting as his pseudo PR agent.

  13. I’m more annoyed and appalled by the reaction of NFL fans to this story, than the story itself. Talk about a bunch of meatheads. It seems like a lot of people have made up their mind that Richie Incognito is a bad person. It’s absurd to think you know someone based on what the media tells you about them. Wait for the facts, then make your assumptions. Not the other way around.

  16. Dolphins messed this one up. They should have asked Martin if he wanted to be released early on, done so, and taken the $1 million cap hit…and then invited Incognito back prior to Monday night game. Every day this prolongs digs them deeper in the muck.

  17. Martin is just a huge baby. He is not made for the NFL and realized he was going to be cut. The writing was on the wall with Clabo and McKinney.

    The guy was making $600k a year, but ESPN says he could sue for $17M. He knew he wasn’t going to last on the Dolphins, so took a guy down with him.

    His Harvard educated parents probably instructed him that he needed to go big or go home, so he drug the guy with the worst rap on the team down with him.

    Dolphins knee jerk reaction was to take Martin’s side and immediately suspend him. Martin was doing a money grab, while Incognito is going for getting drug through the mud.

  22. I don’t blame him for filing a grievance. How can you suspend a guy without giving him a chance to defend himself? This is America and everyone is innocent until proven guilty.
    There are two sides to every story and no matter how it looks on the surface, you have to hear all sides before taking away paychecks.

  24. Read the text again. The suspension was justified. People were trying to criticize Martin for poising for a lawsuit, but Incognito’s actions today reek of it.

    It appears that you don’t understand that Incognito is fighting an unpaid suspension, not a roster cut or a criminal charge.

    But don’t let facts get in the way of a bad anti-union rant.

  28. The Dolphins should be worried, very worried. If Igcognito had any conversations with his coaches about toughening up Martin then they are going to face punishment like no team has ever felt. The Patriots’ and Saints’ punishments will look like nothing compared to what the Dolphins may face.

    Thank you! I was talking about this exact thing earlier today with a friend. His lawyer parents are trying to help him get his $ because his future in the NFL is bleak. He is a terrible LT and he is even suspect at RT. Why else would you bring up a text months after it was sent, and right after you lost your position as the starting LT? The same text that he showed to the team in the locker room and everyone laughed about it (according to Dolphins players that are actually in the locker room).

  30. They better be careful. What happens when someone, say Ndamukong Suh, trash talks someone, say Ritchie Incognito, with “I’m Gonna F- You Up”, for the first half of a game. Incognito gets pissed off, and the first play of the second half, cuts Suh. Suh gets up, pissed off, and says, “I’m gonna kill you”. Does Incognito have a grievance and can walk off the field because of “workplace harassment”?

  32. If anyone is guilty of “conduct detrimental to the team” its Martin. Martin went AWOL and immediately started leaking info to the media how a harassment claim might be filed.. He never went to his peers, coach, or GM until he was sitting on his couch for days thinking about how to strike. Incognito being a bull in a china shop or locker room in this case is being used as a scapegoat for Martin to collect a settlement from the team and get released from his contract so he can “double dip” as the players like to say.

    I’m certainly not saying this entire thing is solely Martin’s fault or his family’s. I’m sure the blame can be placed on many people within the organization. And yes, you’re right, it is speculation. But then again, what we are all doing on here is speculating and giving our opinion. Most people on here just resort to “Richie is a scumbag” and leave it at that. Some of us like to speculate and delve a little deeper. The fact is Martin left the team high and dry, and you can see how the Dolphins players (the ones that aren’t just speculating) have stuck up for Incognito, not Martin. That should speak volumes to everyone. Why wouldn’t the team be more concerned about Martin? Maybe it’s because they know him more than you and I, and they know Richie too. Why would almost an entire team stick up for “the bully” if things were really getting that bad?

  41. I’ve changed positions on this. I think they were friends and things spiraled out of control. What incognito did happens in every locker room, etc. Ritchie is going down for something that happens all day. It’s a bunch of bs

  42. Martin walked away from the team, yet I have no doubt he isn’t missing any paychecks. Let’s not forget Martin was demoted right before he walked, and that was the first real failure of his life. If there is one thing I know he learned at Stanford, it is the culture of victimhood. Sorry, it just feels like Duke Lacrosse all over again.

  43. It’s not illegal when one employee harasses another. It’s only illegal when management does it. I originally jumped to the conclusion that it was all Incognito the racist bully, who I never liked but I think he genuinely, in his own mind, thought that Martin was a friend and that his “style of talking” to him was understood as being a buddy not a threatening bully. I think he was shocked when it was suggested that he had any malice toward Martin, because Martin was so insecure and so wanted to have friends on the team that he played along w/ this banter as if it was acceptable to him. Very unfortunate for both guys going forward

  45. An excerpt from more of our great NFL history.. again.. I say, what did incognito due, when compared to Ray Lewis:

    :Their murders remain unsolved. But as the anniversary of their deaths approaches — and as Lewis dances into the sunset of his NFL career — the victims’ relatives are still seething at him. While Priscilla Lollar says she’s “numb” to Lewis, others want answers. And justice.

    “My nephew was brutally beaten and murdered and nobody is paying for it,” Baker’s uncle, Greg Wilson, told USA TODAY Sports. “Everything is so fresh in our mind, it’s just like it happened yesterday. We’ll never forget this.”

    Only Lewis pleaded guilty in relation to the case: for obstruction of justice, a misdemeanor. He originally was charged with two counts of murder but struck a deal with prosecutors in exchange for his testimony against two of his companions that night, Reginald Oakley and Joseph Sweeting.

  46. Aside from the racist remarks, Incognito is beginning to look like the real victim. If the media reports up to this point are accurate, he definitely has a strong case.

  48. This is horrible. Incognito got himself into this. This is a very simple case to arbitrate. Simply ask… was Incognito FORCED (via substantial financial and/or life threats) by anyone OTHER THAN his own inner voice to say/write the words of harassment to Jonathan Martin? If yes, then, by all means, proceed with investigation. If no, then no amount defense on his part can diminish the fact that he chose to make the harassing statements himself. Interestingly, he already admitted publicly that he made those harassing statements. Therefore, no need to drag this out any further. His past (and present) obviously suggest he does not possess desirable character, especially in a professional environment. In my opinion, I would support a decision by the NFL to ban him from the NFL for life on the basis of unprofessional character in a highly publicized professional sport. Certainly no need to promote his character, or lack thereof, any further.

  50. It seems evident to me that Martin played Incognito and the Dolphins. When he realized that he wasn’t playing on a team with championship talent, he decided that he could use Incognito to win big money without having to work for it. He and his Harvard law degree parents decided to use the courts, no only to make money, but to make a name for themselves and pave the way for future book sales. As for the text messages, although the racism crosses the line, vulgarity among men in locker rooms, in the military, and among law enforcement officers is not unusual. In addition, Incognito has shared vulgar text messages from Martin to him with the press. Thus far, a significantly larger percentage of NFL players would prefer to have Incognito on their team than Martin. He just doesn’t belong.

  51. I’d bet he wins. And the NFLPA is going to back him because suspensions at the drop of a hat with basically no investigation prior aren’t how players want to see things done, even if it turns out Incognito was totally guilty in this case.
