Like Broncos linebacker Von Miller earlier this year, Seahawks cornerback Brandon Browner faces a lengthy suspension.  Unlike Miller, Brandon hasn’t worked out a deal.

Yet.

According to Mike Garafolo of FOX Sports, Browner has rejected an offer that would have suspended him until early October 2014.  That arrangement would have blocked Browner’s opportunity to hit the free-agent market in March.

It’s possible that further negotiations will result in a compromise.

Per Garafolo, Browner disputes not only his placement in Stage Three of the substance-abuse program upon his return to the NFL in 2011 but also the test that triggered the current violation.  Browner claims that the “urine collector used a damaged cup and then poured his urine from that cup into another one,” according to Garafolo, and that Browner’s request to compel testimony from the urine collector at the appeal hearing was denied.

The league’s Medical Review Officer testified at the hearing that he had spoken with the urine collector, who disputed Browner’s contentions.

It’s possible that the league regarded Browner’s allegation as dubious, given that Seahawks cornerback Richard Sherman successfully used precisely same argument last year to beat a four-game suspension for violation of the performance-enhancing substances policy.  For Browner, who knew he was in Stage Three at the time he provided the sample that tested positive, the high stakes created to a natural temptation to embellish.

The appeal hearing concluded nine days ago.  The substance-abuse policy requires that a decision be issued within a reasonable time.

  2. The opportunity to cross-examine an adverse witness is a fundamental tenet of any fair justice system. So before you all begin ripping BB, give some thought to how you would feel if your ability to work in your chosen field was being threatened and your employer refused to produce a key witness who provided the so-called damning evidence that was being used against you.

    1) We’re still coming down on people for smoking marijuana. It’s 2013, not 1953. Get over it. It’s no worse than getting stupid-drunk, in fact it’s probably better.

    2) How on Earth is the NFL able to subject someone who was not part of the league to any sort of expectation of conduct, and furthermore to participate in the drug testing program?

Think about it, all we hear about Seattle players is how aggressive , full of energy, how they “fly around the field” and then we hear about all the PED and other illegal substances their players are found to be using.     His next contract is probably the max. money he is going to make.

    In drug testing, the threshold level is huge. So cup to cup contamination might yield trace amounts but not enough for a positive result.

I bet many if you would be surprised with how many of your favorite players on your team and athletes smoke and have been caught without consequence bc technicalities ..   14. Browner has no one to blame but himself. But since no one in America excepts blame anymore… he should blame his agent. The NFL has rules about drug testing… if you want to play in their league you must abide by them. (Every ‘league’ has its own rules… see Michael Phelps and his reentering the olympic drug testing program, just in case he wants to try for the games ever again). Browners whining about not being in the NFL therefore not subject to their rules is BS. And his ‘my girlfriend’s dog ate my homework’ excuse is just silly. His agent (or Browner himself) has to know if he misses drug tests, he can’t return to the NFL without consequences. Browner is 100% at fault for being in stage 3. He has to know the rules if he wants to return to the NFL. It’s the equivalent of someone filing a tax return in the US . The IRS then sending you multiple notices that you owe $10000 in taxes but you never receive them, because you moved to Canada. Then you return to the US years later and claim you don’t owe the $10000 because you didn’t receive the notices… Try that with the IRS sometime

    Giving him the benefit of the doubt, the testing notices were sent to the address of an ex-girlfriend.

    Yeah, I am sure she was thrilled to be able to forward the letters to him.

    Anything like a notice for testing should have a confirmation of receipt attached to it.

  24. Sooo what’s to stop a guy like Browner from taking the cup to pee, knowing damn well he’ll pee dirty, and cracking it in his hand prior to filling? Reaction of the tester would be to pour into another cup and they get off on a technicality. If they’re smart enough to deem the test invalid and request a second sample it allows a stall tactic for the player. And it’s not that they’d be hindering the sample process like Von Miller, just seems to the collector that its a simple mistake to give a busted cup. Cheap way out? Yup. But a dirty player isn’t looking for a legit solution, just an easy way to keep doing what they know they shouldn’t be doing without getting busted.

    In the Army, when we take drug tests, the collector hands us a cup with our information on it, then watches us go into a stall, and come out with it filled. We have every opportunity to examine it to ensure it is clean (sometimes they are still in the sterile wrap, and we watch them label the filled ample cup after we hand it back). If he took a damaged cup and used it, that is on Browner! Idiot.

    The league must really not take their drug program seriously if it is really this sloppy. Of course, it’s must be hard to find people with enough integrity to test players who routinely write checks for $10s of thousands for illegal hits during games. Most of us would be pretty challenged to reject a bribe offer of $10k to look the other way on a drug test. Imagine if your job was to take cups full of pee from millionaire players. I hope they get pay upwards of 6 figures to do so. Otherwise, how would this system’s integrity EVER be beyond suspicion?

    1) yes it’s 2013 not 1953 and weed is illegal. End of story. It doesn’t matter how righteous you think it is or what a couple of states do, until the federal government says its legal, it’s not. You don’t like it? Put the joint down and run for congress.

    2) it’s called collective bargaining. No, I don’t think it’s really fair either but the union agreed to it so, again, end if story.

    Fair or not the man was at stage 3 with that much money on the line if anything screwy happens during a test, before anyone leaves the facility I’m calling my union rep and filing a claim, not waiting for a fail and claiming a Braun happened.

  37. This isn’t an alleged PED violation, so those of you that are talking about cheating should excuse yourselves from this blog.

    This is about a substance abuse issue and while we shouldn’t condone it, his argument is somewhat compelling. This is in a first time violation that without due process is being unfairly treated as a third time violation.

    I truly hope that he is not able to compete on the FA market next spring. I hope that it is due to his being treated fairly and getting a 4 game suspension, as typically is handed out. Then, I hope that the Seahawks sign him or franchise him and lock him up for next season and beyond.

  44. I moved here from the Bay Area when I was 15 and have live in Seattle for 31 years. Seattle is a wonderful city but it’s impossible to handle the same cloudy, dreary gray sky day after day for 8 months in a row. We’ve been lucky for the last few years to get a few days of sunlight in the winter (probably global warming), but generally by February I’m ready to jump out of a window of the tallest building I can find.

    I don’t fault anyone here for taking drugs because you need to do whatever you can to cope. Yes, some people like the weather, but most of us need to see the sun for more than the period between July 5th (it almost always rains on the 4th of July) and September 30th. The weather is definitely the reason why Seattle is the suicide capital of the United States.

If you truly have ADHD then yes it’s a God’s sent. But it’s impossible to switch from one container to the next and create a positive test.     In over 20 years in the military and direct involvement with the testing program for 4 years, I never saw a single damaged cup. I guarantee the players are cracking the cups.

    1. It makes no difference what you or anyone else thinks about weed. The federal law says its illegal.
    So until it’s changed why do you and others keep bringing it up? Or are you just ignorant of the federal law?

    2. Ask the players why they allowed this in the latest CBA? The NFL league is just following what the players signed and agreed to. Ask De Morris why, don’t blame the league.

  52. The PED comments on Browner prove most people don’t understand there’s a difference between the NFL’s policies on PED and substance abuse OR they have extremely poor reading comprehension skills.
    Browner was/is in ‘Stage Three’ of the substance abuse program for failure to submit to a test while he was out of the league — unemployed. So while his current test may/may not contain drugs or alcohol, automatic dismissal for a year should and must be challenged.

    Pete Carrol should be charged with fraud, he very specifically said at the beginning of the season “we’re cleaner” as in the team is cleaner. Then he exploded spraying Adderall all over the field.

  63. zonarob sorry to burst your bubble but our owner is the richest man in professional sports which means he can afford to pay bonuses that other owners can’t. This means the salaries can be prorated over 6 years at much lower cap numbers than other teams. Couple that with the 2015 rise in the salary cap & the Seahawks should be able to keep all their stars with room to spare. Add to that their continuing ability to find guys in the lower rounds & we’re looking at 2 of the next 4 Super Bowls at a minimum. There are guys on our practice squad that you’ve never heard of that are better than your starters.

    Get used to seeing the Seahawks playing in February pal.

    It is against the CBA for a team or for the League to say what specifically the suspension is for, so that leaves it up to the player and his agent to say whatever they want to say it was.

  72. Looks like the Seahawks would be foolish to re-sign him, because he may be suspended. Richard Sherman is another potential free agent. So, their defense can take a big hit next years because of free agency.
